In this letter, State Attorney Bernie McCabe was asked in very broad terms to provide any records or lists of law enforcement officers that have a history of misconduct that may pose a problem for the prosecutor if that officer was to be called upon to testify. There have been literally hundreds of law enforcement officers who have committed crimes, lied, falsified records or have involved themselves in misconduct that would cause their testimony to be considered less than reliable and potentially perjury. The local police agencies like the Pinellas County Sheriff have a duty to disclose these unethical officers to the State Attorney's office and then Bernie McCabe has a duty under Brady vs. Maryland and Giglio vs United States to provide that information to any defense attorney in any case where these tainted officers may be called as a witness. However, both the Pinellas County Sheriff's Office and State Attorney Bernie McCabe ignored these important landmark U.S. Supreme Court Rulings to continue convicting the people of Pinellas and Pasco counties using the testimony of these unethical officers and deputies.
