Children with Special Needs May Be Eligible for

Federal Benefits

If you have a child with special needs, he or she may be eligible for payments from
certain federal benefit programs.

Social Security Benefits for a Child under Age 18

Any child under age 18 - or age 19 if a full-time student - may receive dependent
payments if a parent is receiving Social Security Disability (SSD) or Retirement benefits.
The amount of these payments will be based on the parent's earnings record.

SSD Benefits May Be Awarded to an Adult Disabled Child Who Became Disabled
Before Age 22

This SSD benefit is called a "child's benefit" because it is based on a parent's earnings.
The adult disabled child must qualify based on the SSD adult disability rules.

Eligibility for the adult disabled child who became disabled before age 22 is dependent
on the Social Security status of the parent; for example, eligibility may be gained if a
parent is receiving SSD or Retirement benefits, or if a parent who worked long enough to
qualify for these benefits has died.

Supplemental Security Income

Supplemental Security Income (SSI) is available for those with low income and limited
resources and who are disabled, age 65 and over or blind.

A disabled child under age 18 may be eligible for SSI payments if he:

Earns less than the monthly income maximum ($1,170 in 2017) and meets
resource limits. The income and resources of all family members in the household
as well as the child's will be considered.
Has "marked and severe functional limitations." Generally this means a physical or
mental disability, or both, that severely limits the child's activities.
Has a disability serious enough to last at least 12 months or result in death.

When reaching age 18, the child may be eligible for SSI as an adult. This means that the
child must qualify based on adult disability rules, and the resources and income of
household family members will not be taken into account.

Need Help?

Eligibility for these programs can be difficult to determine because of their complex rules.
The Social Security Administration has helpful information in their Benefits for Children
with Disabilities and Supplemental Security Income (SSI) brochures.

Our experienced attorneys can help you determine if any of these programs can help
your family, or contact your original attorney or representative if you were referred
to us for your appeal.

Am I Eligible for any Other Benefit Programs?

Individuals with disabilities may be eligible for other benefit programs other than Social
Security Disability (SSD).

Supplemental Security Income (SSI) is a program for those who are disabled and
who qualify based on income and resources limits. Others who have not worked
long enough to qualify for SSD may be eligible too. Generally, the maximum SSI
monthly payment is $735 for an individual, but SSI benefits are coordinated with
SSD. For example, if you receive an SSD benefit of $600 per month, you may be
eligible for an SSI payment of $135 - the difference between $735 and $600.
Medicare provides hospitalization and other health care benefits. An individual who
has received SSD payments for 24 months or more is eligible for Medicare, as are
those aged 65 or over. The 4 parts of Medicare are Part A - hospital insurance; Part
B - doctors, testing and medical supplies; Part C - for HMOs, PPOs and other
private plans; Part D - prescription drugs.
Medicaid is a health insurance program jointly funded by federal and state
governments. In New York, individuals receiving SSI payments are covered by
Medicaid. Generally, for those with a disability in Florida, you will have to satisfy
income requirements for Medicaid eligibility.
Workers' Compensation benefits may be available if you were injured on the job.
Eligible recipients can collect both these payments and SSD benefits; in this case,
one of these payments may be offset or reduced by the other.

There are other disability programs for which you may be eligible along with SSD
payments. These include Veterans disability benefits, an employer long term disability
plan or benefits based on an insurance policy.

Recipe of the Month

Grilled Asparagus

There's nothing better than fresh, grilled asparagus. Healthy, easy, delicious -- what
more could you want?

Ingredients
1 pound asparagus (estimate 1/4 pound per person), thick spears
1-2 Tbsp Olive oil
Kosher salt

Method
1 Preheat your grill for high, direct heat.

2 Prep asparagus, coat with olive oil, sprinkle with salt: Prepare the asparagus by
breaking or cutting off any tough bottom ends (can save for stock, or discard).

Place the asparagus in a grill pan lightly brushed with olive oil. This is the easiest way to
contain the spears while on the grill.

Coat the asparagus spears with olive oil and sprinkle salt over them.

3 Grill on high, direct heat: Place the grill pan on the grill so that the thickest ends are
aimed toward the hottest part of the grill.

Grill the asparagus spears for 2-5 minutes, until lightly charred and just fork tender,
turning them often so that they brown on all sides.
