ORDINANCE NO. ____

AN ORDINANCE PRESCRIBING THE IMPOSITION AND COLLECTION OF FEES AND CHARGES


FOR THE USE OF THE ORMOC CITY PUBLIC TRANSPORT TERMINAL AND ITS STALLS AND FOR
OTHER PURPOSES

Be it enacted by the 14thSangguniangPanlungsod that:

ARTICLE I
TITLE, POLICY, SCOPE, DEFINITION OF TERMS

SECTION 1. TITLE This Ordinance shall be known as FEES AND CHARGES FOR THE USE OF
THE ORMOC CITY PUBLIC TRANSPORT TERMINAL AND ITS STALLS ORDINANCE.

SECTION 2. DECLARATION OF POLICY It is hereby declared as a policy of the City


Government of Ormoc to promote adequate public transport facilities which shall be responsive and
conducive to the needs of the riding public travelling by land to nearby provinces, or coming there
from. Further, to provide an improved facility for orderly and easy vehicular transfer and
interconnections to the various routes and destinations for the commuting public.

SECTION 3. SCOPE OF ORDINANCE This ordinance shall govern the rules and guidelines in
the imposition and collection of fees and charges for the use of the Ormoc City Public Terminal and
its stalls. Including the adjudication and grant for the use of thereof and providing reasonable fees
thereon.

SECTION 4. DEFINITION OF TERMS- For purposes of this Ordinance, the following terms are
hereby defined:

a) City Public Transport Terminal refers to the buildings, facilities and other structures that
are erected along Real, Rizal, Bonifacio and Ebony Streets that are used to service Public
Utility Vehicles (PUVs) and are owned and operated by the City Government of Ormoc.
b) Central Business District or Downtown refers to the central place of Ormoc City where
high intensity urban conditions are served in providing convenient and accessible goods and
services.
c) Delinquent Stallholder any person who occupies an allotted space, stand, compartment in
the terminal and failed to pay the required stall fees for two (2) months after five (5) days
from receiving the notice of delinquency.
d) Dispatcher -means any person employed to solicit passengers for a given public conveyance.
e) Driver refers to any person who drives motor vehicles and the likes and duly licensed as
such by the Land Transportation Office.
f) Garage means a building or compartment of a building used for housing an automotive
vehicle; a repair shop for automotive vehicles.
g) Landing fee refers to a fee charged and/or collected from any person selling in trucks,
transient/ambulant vendors of any commodity or merchandise being brought into the City
Public Terminal for commercial purposes in the basis of weight, bundle, sack, can, cartload,
carton, bakat or any convenient unit of measure, including buses not registered with the City
of Ormoc and drops off passenger at the Public Terminal.
h) Notice - a legal notification giving the stallholder five days to pay the two (2) months
overdue payment of stall fee.
i) Operator - a natural or juridical person who is either a holder of a Certificate of Public
Conveyance (CPC) or a holder of a valid business permit and engage in legal activity within
the terminal area; means a person who is a holder of a certificate of public convenience to
conduct the business of transporting passengers within a given line or route.
j) Overnight Parking shall mean to be the parking of a vehicle in the premises of the terminal
from the early hours of the evening until and up to anytime past twelve oclock (12:00)
midnight.
k) Paved Bay an area within the terminal building allocated for Public Utility Vehicles (PUV) for
the purpose of loading and unloading passengers.
l) Public Terminal 1 - refers to the building, facilities and other structures that cater to PUV
vans, multicabs, tricycles and jeepneys in the City Public Terminal.
m) Public Terminal 2 - refers to the building, facilities and other structures that cater to PUV
buses and mini-buses in the City Public Terminal.
n) Public Utility Vehicle (PUV) any vehicle operated for the conveyance of persons or the
transport of properties of goods subject to certain government regulations but limited to
Public Utility Buses, Public Utility Jeepneys, Public Utility Multicabs, Public Utility Shuttles, and
Public Utility Tricycles.
o) Rental Space refers to stalls for lease.

p) Services shall mean to include all the facilities in the terminal that could be afforded and
would inure to the benefit of the riding public.
q) Stall shall refer to any allotted space, stand, compartment, store or any place wherein
merchandise is sold, offered for sale, or for such purpose in the public market.
r) TMO Terminal Management Office

ARTICLE II
TERMINAL MANAGEMENT OFFICE

SECTION 5. TERMINAL MANAGEMENT OFFICE - The Terminal Management Office (TMO),


which is under the Office of the City Administrator, shall perform the administration, operation and
maintenance of the City Public Transport Terminal under existing laws and ordinances to fully
implement the terminal rules and regulations.

SECTION 6. ISSUANCE OF TERMINAL REGULATION PERMIT The Terminal Management


Office shall issue a terminal regulation permit to associations applying for accreditation to perform a
particular service in the terminal. The Terminal Regulation Permit shall be valid for one year and shall
be subject to renewal every year thereafter, approval of which shall be upon the discretion of the
Terminal Management Office based on the associations performance. The services covered by the
Terminal Regulation Permit include barkers, dispatchers, porters, and other ancillary services.

All officers of associations applying for Terminal Regulation Permit or after approval thereof
shall have responsibility and obligation to discipline their members with respect to the use of said
terminals or its facilities.

ARTICLE III
IMPOSITION AND COLLECTION OF TERMINAL FEES AND CHARGES

SECTION 7. COLLECTION AND IMPOSITION OF FEES The fees and charges herein
provided shall be collected by the City Treasurer or his/her duly authorized or assigned deputies.

SECTION 8. TERMINAL FEES There shall be levied upon and imposed from operators, a
terminal fee per trip categorized as follows:

a) GT Express/Van 50.00 per trip


b) Passenger Jeepney 15.00 per trip
c) Passenger Multi- cab 10.00 per trip
d) Tricycle 5.00 per trip
e) Passenger bus and mini-buses vehicles with routes as follows:

1) Ormoc to Manila 400.00 per trip


2) Ormoc to Tacloban 100.00 per trip
3) Ormoc to Isabel 50.00 per trip
4) Ormoc to Palompon 50.00 per trip
5) Ormoc to Villaba 50.00 per trip
6) Ormoc to Tabango 50.00 per trip
7) Ormoc to San Isidro 50.00 per trip
8) Ormoc to Calubian 50.00 per trip
9) Ormoc to Naval 50.00 per trip
10) Ormoc to Baybay 50.00 per trip
11) Ormoc to Maasin 100.00 per trip
12) Ormoc to Silago 100.00 per trip
13) Ormoc to Davao 300.00 per trip

SECTION 9. BUSINESS CENTER AND PASSENGER LOUNGE WITHIN THE PUBLIC


TERMINAL 2 BUILDING The ground floor of the Public Terminal 2 building shall be a designated as
a business center and shall be leased to qualified occupants with the following fees:

1) Ticketing booths measuring 180 X 150 centimeters at a monthly rental of One


Thousand Five Hundred Pesos (P1, 500.00) each booth; and
2) Rentable hallway space with the area of Five Hundred Pesos (P500.00) per square
meters.

The second floor of the Public Terminal 2 building shall be the passengers lounge.

Each passenger, seven (7) years old and above entering the business center and /or
passenger lounge at the Public Terminal 1 & 2 building shall pay Twenty Pesos (P20.00) and shall be
issued a terminal ticket to serve as pass for the free use of terminal facilities.
There shall be deposit fee of twenty pesos 20.00 for each passenger who shall deposit their
baggage, bags, suitcases, etc. in the terminal baggage booth.

SECTION 10. LEASE OF SPACES AND/OR STALLS Lessee of stalls measuring 180 X 150
centimeters at the sides and/or within the City Public Terminal shall pay Forty Pesos (P40.00) per day
per stall. The adjudication, awarding and lease of such space and/or stall shall be governed by Article
V hereof.

SECTION 11. LANDING FEE There shall be a Landing fee of Two Hundred Pesos (P200.00)
per arrival for those Buses which are unregistered in the City Public Transport Terminal.

There shall be a fee or charge for any commodity and merchandise brought into the City
Public Terminal for commercial purposes in the amount of Ten Pesos (P10.00) per bundle, sack, can,
cartload, carton, bakat or any unit of measure.
ARTICLE IV
TERMINAL OPERATIONS

SECTION 12. ASSIGNMENT OF BAYS The assignment of bays for Public Utility Vehicles
shall be performed and determined by the Terminal Management Office. PUVs sharing the same or
common routes shall occupy one bay, and shall be parked in a manner as instructed by the Terminal
management.

SECTION 13. PORTERAGE AND CARGO HANDLING The porterage and cargo handling
shall be governed by the following:

a. Porterage and cargo handling shall be provided by individuals to be selected by the


Terminal Management Office, and in this connection, the latter shall employ means and
methods that are fair, objective and expedient.
b. Porters shall at all times wear a prescribed uniform and an official Identification (ID) Card
issued by the Terminal Management Office.
c. Porterage and cargo handling fees shall be regulated by an ordinance fixing and
establishing the same;
d. Passengers who desire to carry their own luggage or cargoes shall not be obliged to avail
of the services of porters.
e. Responsibility of loss or damage to goods and cargoes of the passengers shall solely be
upon the PUV operators.

SECTION 14. DISPATCHING The following provides for the guidelines on dispatching:

a. Barkers and private dispatchers for all PUVs shall not be allowed inside the Terminal.
b. Every PUV shall be assigned to a bay and shall have a permanent occupancy number to
be determined by the drawing of lots.
c. The Terminal Management Office shall assign dispatchers for Passenger Jeepneys,
Multicabs, GT Express, Passenger Buses and Mini-buses who shall dispatch vehicles
according to the assigned permanent occupancy number.
d. Personnel assigned at the gate shall record all departing and arriving Passenger Jeepneys,
Multicabs, GT Express, Passenger Buses and Mini-buses in order to monitor the order of
dispatching.

SECTION 15. PROHIBITION TO HAWK, SELL OR PEDDLE ALONG SIDEWALKS No person


shall hawk or peddle his/her wares along the sidewalks, alleys, aisles, corridors and in other
unauthorized areas inside the Terminal.

SECTION 16. PROHIBITION ON ILLEGAL STRUCTURES No person shall put up any


structure, shanty, barong-barong, shed, and table or push cart within the premises of the Terminal
for the purpose of selling or keeping his wares or articles for sale to the public.

SECTION 17. DEPARTURE TICKETS. The City Treasurer shall prepare the issuance of
departure tickets which shall be color-coded in the following manner:

a. Red for Multicabs;


b. Orange for Passenger jeepneys;
c. Yellow for Vans;
d. Green for Passenger bus; and

e. Blue for mini-buses.

SECTION 18. DEPARTURE TIME INTERVAL. The departure time interval per unit shall be the
following:

a) Passenger bus and mini-buses 25 minutes


b) Passenger Jeepney 20 minutes
c) Vans and Passenger Multi- cabs 15 minutes

SECTION 19. INSPECTION OF DEPARTURE TICKETS. The operators or drivers shall subject
themselves to inspection of their departure tickets at the designated City Treasurers Office (CTO)
Ticket Checkpoints located strategically for the outbound PUVs. The operator or driver shall present
the CTO and Operators Copy of the departure ticket. The CTO inspector shall detach the CTO copy of
the departure ticket and stamp the operators copy as used and sign the same as proof of
inspection.

ARTICLE V
ADJUDICATION AND AWARDING AND LEASE OF SPACES AND STALLS

SECTION 20. VACANCY. Vacant spaces and stalls in the terminal shall be adjudicated in the
following manner:
A notice of vacancy of the office spaces or stalls shall be made for a period of fifteen (15) days
immediately preceding the date fixed for the award to a qualified applicant to apprise the public of
the fact that such office space or stall is unoccupied and available for lease. Such notice shall be
posted conspicuously on the unoccupied office space or stall and three other conspicuous places in
the following form:

NOTICE is hereby given that Stall No. ______ of Ormoc City Terminal is vacant. Any
person, 18 years of age or more and is not legally incapacitated desiring to lease this stall, shall
file an application thereof on the prescribed form (copies may be obtained from the Business
Permits and Licensing Office during office hours). In case there are more than one applicant vying
for the same stall or office space, the awarding of the lease shall be determined thru public
bidding for the lease thereof to be conducted on ________________, 20____ at _____ oclock _________
at the Session Hall, this City.

SECTION 21. PUBLIC BIDDING. In cases where a vacant stall has two or more competing
applicants desiring to lease out a specific office space or stall in the terminal, a public bidding shall be
conducted in order to decide on which of the qualified applicants shall be awarded the lease for the
said office space or stall.

SECTION 22. TERMINAL SPECIAL BIDS AND AWARDS COMMITTEE (TSBAC) - A Terminal
Special Bids and Awards Committee shall be constituted to supervise the conduct of a public bidding
for the lease and awarding of office spaces and stalls in the Terminal. The TSBAC shall be composed
of the following:

Vice-Chairman - Terminal Manager
Members - City Treasurer
Business and Licensing Officer
Market Administrator

SECTION 23. FUNCTIONS AND RESPONSIBILITIES OF THE TSBAC - The TSBAC shall
exercise the following functions and responsibilities:

a) Examine and evaluate all applications for lease of terminal stalls and other facilities submitted
by the applicants at the Terminal Management Office;

b) Supervise the conduct of the public bidding for the lease of office spaces and stalls in the
terminal in cases where two or more applicants are vying for the lease of the same office
space or stall.

SECTION 24. TIME FOR PAYMENT AND PENALTIES FOR DELINQUENCIES - the monthly
rentals for stalls, booths, and blocks in the terminal shall become due and payable on or before the
end of every month. Failure to pay the rental or fees within the period required herein shall subject
the lessee/occupant to a SURCHARGE of five per cent (5%) of the amount due. Stallholder who fails to
pay stall fees for two months will receive notice from the TMO, giving the stallholder a maximum
period of five (5) days to pay the due fees from receiving the notice. A stallholder who still fails make
payment for the given period shall be considered a delinquent stallholder.

SECTION 25. QUALIFICATION FOR OCCUPANCY- Occupancy of stall/space is open to all


interested applicants provided that the applicant has a track record of sound business management
and/or possess a sufficient financial capability and of good moral character. An applicant for a lease of
the terminal office space or stall must be:

a) A Filipino citizen;
b) A resident in Ormoc City for at least one year on the date of application as certified by
the Punong Barangay of the place of residence;
c) Must not be less than eighteen (18) years old; and
d) Financially capable of maintaining the operation and answering/shouldering any liability
that may arise in the course of operation of said stall or office space; provided that in the
case of stalls, a lessee shall be a micro-entrepreneur; and provided further that this
requirement shall not apply to stalls covered by the Pasalubong Center.

SECTION 26. REQUIREMENTS FOR APPLICATION - Every applicant shall be required to


submit one (1) copy each of the following requirements to the Terminal Management Office:

a) Application letter addressed to the Chairman of the Terminal Special Bids and Awards
Committee;
b) Duly accomplished application form;
c) Non-refundable application fee amounting to P500.00.

It shall be the duty of the Terminal Manager to keep a registry book showing the names and
address of all applicants for vacant stalls, and booths, the number and description of the same applied
for them and the date and hour of receipt of each application. It shall be his duty to acknowledge
receipt of the application setting forth therein the time and date of the receipt thereof. He shall then
furnish a copy to the TSBAC to examine and evaluate the said application.

SECTION 27. APPLICATION FOR LEASE - There shall be adopted a manner by which lease
applications shall be treated by the TSBAC and shall substantially be in the following form:

Should the above mentioned shall be leased to me in accordance with the terminal rules and regulations, I
promise to hold the same under the following conditions:

(1) That while I am occupying or leasing this stall I shall at all times have my picture and that of my helper (or those of my
helpers) conveniently framed and hung up conspicuously in the stall.
(2) I shall keep the stall at all times in good sanitary condition and shall comply strictly with all sanitary and transport
terminal rules and regulations now existing or which may hereafter be promulgated.
(3) I shall pay the corresponding rents for the booth or the fee for the stall in the manner prescribed by the existing
ordinance.
(4) The business to be conducted in the stall shall belong exclusively to me.
(5) In case I engage helpers, I shall nevertheless personally conduct my business and be present at the stall. I shall promptly
notify the terminal authorities of my absence, giving my reason or reasons therefor.
(6) I shall not sell or transfer my privilege to the stall or otherwise permit another person to conduct business therein.
(7) Any violation on my part or on the part of my helpers of the foregoing conditions shall be sufficient cause of the transport
terminal authorities to cancel this contract.

I, ______________________, do hereby state that I am the person who signed the foregoing applications, that I have read 5
the same; and that the contents hereof are true to the best of my own knowledge.
The successful applicant shall furnish the Terminal Manager three (3) copies of his/her picture
immediately after the award of the lease. It shall be the duty of the Terminal Manager to affix one (1)
copy of the picture to the application and the other two copies of the record card kept for the
purpose.

Fifteen (15) days after the award, applicants must present a business permit and execute a
contract of lease for the commercial space awarded to him/her. Only then shall a Certificate of Award
duly approved by the City Mayor can be issued to an applicant.

SECTION 28. LEASE CONTRACT AND PERIOD OF LEASE. The contract of lease shall be
awarded to the winning bidder for a stall/space, which shall be for a period of one (1) year renewable
upon its expiration, unless revoked in accordance with the provisions of this article.

The Lease Contract shall be in the following form:

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease, made and executed on this ____ day of __________________, 20___ in this City of Ormoc ,
Province Leyte , Philippines by and between:

THE CITY OF ORMOC, a public corporation existing under and by virtue of the Laws of the Republic of the
Philippines, represented by its City Mayor _______________________ , hereinafter called the LESSOR;

- AND

____________________________, of legal age, single/married to ______________________, widow/widower, Filipino, a


citizen and resident of _________________________ hereinafter called the LESSEE;

WITNESSETH:

WHEREAS, in consideration of the rent and the term and condition herein contained, the LESSOR hereby
lease to the LESSEE a stall which is a portion of Bus Terminal No. __ located at __________ absolutely
belonging to and owned by herein LESSOR;

WHEREAS, the LESSOR agrees to lease Stall/Space No. __ situated at the above to herein LESSEE;

WHEREAS, the LESSEE agrees to lease said Stall/Space No. __ of LESSOR situated at the address stated
above.

NOW THEREFORE, for and in consideration of the above premises, the parties herein have agreed to the
following terms and conditions, to wit:

a) The terms of the lease contract shall be for a period of one (1) year starting from the execution of
this contract, renewable for a like period at the option of the LESSOR and subject to the terms and
conditions herein contained and those that may be agreed upon by the parties in writing;

b) The agreed monthly rental for the use and occupancy of Stall No. ___ will be
______________________________, (P_____________) Philippine Currency, payable within the First Twenty
(20) days of each month and every current month thereafter without the necessity of an express
demand therefore, said rental to be paid to the City Treasurer or his duly authorized representative.
Said monthly rental is exclusive of LIGHT, WATER AND SUCH OTHER SERVICES which shall be borne
exclusively by the LESSEE;

c) Upon the execution of this contract, the LESSEE, will pay the total sum of ____________________________,
(P________) Philippine Currency, which amount is equivalent to the two (2) months deposit, plus
three (3) months advance rental for the lease premises. The deposit is to guarantee and secure the
faithful compliance on the part of the LESSEE with the terms and conditions set forth herein. In the
event that the LESSEE occupies the leased premises for less than one (1) year, said deposit shall be
forfeited and applied by the LESSOR as liquidated damages;

d) The LESSEE is strictly prohibited and is not authorized to make any improvement and/or alterations
in the leased premises. Any violation of this provisions shall be cause for termination of this contract
even before the expiration of the one (1) year period or a ground for ejectment of the LESSEE;

e) The LESSEE, shall not sublease, or assign the leased premises, neither can the LESSEE sell or transfer
his/her rights under the contract of lease to any other person whomsoever. A violation of this
condition will be ground for termination of this lease contract even before the expiration of the one
(1) year period;

f) The LESSEE, in case of his temporary absence must appoint any responsible person in the person
who will take charge of the safety of the leased premises and the faithful compliance of the terms
and conditions herein set forth. In no case shall the temporary absence of the LESSEE exceed thirty

(30) days; otherwise, he or she shall be deemed to have abandoned the leased premises. In the
event that the LESSEE decide to vacate the leased premises as aforesaid herein. LESSOR shall be
released and/or freed from and all claims and responsibilities arising therefrom;

g) The LESSEE shall use the premises exclusively for business purposes and shall not use the same as
a residence or for any other purpose not authorized under this Contract and applicable Ordinances;

h) This Contract shall automatically be deemed rescinded in the event of the buildings destruction by
reason of conflagration, flood, earthquake, or other fortuitous events. The LESSOR shall not be
liable for damages caused by fortuitous events to the property/ies of the LESSEE;

i) The LESSEE shall permit the LESSOR or any of his duly authorized representative to enter and
inspect the condition of the leased premises during business hours, provided, that such inspection
does not unduly disrupt the business operations of the LESSEE;

j) It is further agreed that the LESSEE shall be responsible for any and all acts omissions or his/her
servants/employees;

k) Should the LESSEE fails to pay the rent herein stipulated in accordance with the terms above
mentioned or violate the terms of this contract, the LESSOR shall have the right to eject the LESSEE
from the premises, and to collect and recover from him/her all accrued rentals and to pay a penalty
of twenty-five PERCENT (25%);

l) In case of court litigation by virtue of non-payments of the agreed rentals or any other breach of
this contract on the part of the LESSEE, said LESSEE further bind and obligate himself/herself to pay
the LESSOR the additional amount of _____________________________________ (P_________) Philippine
Currency as attorneys fees exclusive for cost legally taxable;

m) LESSOR and LESSEE hereby agrees that in the event of court litigations, the venue shall be in City of
Ormoc;

n) LESSOR reserve its rights to increase the rents provided, that such increase shall not exceed ten
percent (10%) of the current rent;

o) LESSEE shall surrender and yield up quietly and peacefully to the LESSOR the premises with all the
fixtures other than those owned by the LESSEE at the termination of this lease or earlier termination
thereof, in the same condition in which he/she shall have found them; Ordinary wear and tear and
reasonable use and other unavoidable loses, excepted;

p) LESSOR hereby warrants the peaceful possession and enjoyment of the leased premises by the
LESSEE;

q) PROVIDED, always, that in case of breach by the LESSEE of any of the terms and conditions herein
contained, the LESSOR may, while said breach may continues and notwithstanding any waiver of
any prior breach, and upon due notice and hearing, terminate the lease, and may thereupon expel
and remove the LESSEE and his effects;

ARTICLE VI
GUIDELINES FOR STALL OCCUPANTS AND PASSENGERS

SECTION 29. VENDORS RESPONSIBILITIES- The following are responsibilities of the
vendor occupying a stall in terminal:
a. Shall maintain cleanliness and orderliness of the stalls and the premises
b. Shall not change the nature of business
c. Shall not maintain illegal activities such as gambling, selling of prohibited items and the
like
d. Shall not sublease the stall
e. Shall not renovate and /or introduce improvements on the stalls neither cause damage
nor destruction of the stalls
f. Shall not extend the stall beyond the boundary or marker nor shall any vendor be allowed
to put tables or chairs outside the premises of the stall

The Board may issue supplemental guidelines for the proper use of the stalls and spaces in
the terminal.

SECTION 30. STALLS FOR OCCUPANCYPROHIBITIONS- The following are prohibitions for
stall occupancy:
a. Only one stall shall be allowed to be occupied per vendor
b. No stall shall be used as sleeping area/sleeping quarters
c. No stall shall be used as a restaurant
d. Stalls shall be manned by not more than 2 persons (must be manned by the
owner/lessee)
e. No part of the stall shall be used as cooking area
f. No chairs and tables shall be displayed / allowed to be placed in the stalls except for the
chairs to be used by the vendors manning the stalls which shall be limited to only two.
g. Stallholders shall not join any mass actions against the government.

SECTION 31. PROHIBITION TO HAWK, SELL OR PEDDLE ALONG SIDEWALKS No person


shall hawk or peddle his/her wares along the sidewalks, alleys, aisles or corridors inside the terminal;
No person shall hawk or peddle his/her wares inside the buses or any public utility vehicle within the
terminal.

SECTION 32. PROHIBITION ON ILLEGAL STRUCTURES No person shall put up any


structure, shanty, barong-barong, shed, table or push cart within the premises of the Public Terminal
for the purpose of selling or keeping his wares or articles for sale to the public.

SECTION 33. REVOCATION OF LEASE - Failure to pay the rent of stalls as herein provided or
any violation of any provisions of this ordinance by a Stallholder shall be sufficient cause for the
revocation of the lease and for the ejectment of the stallholder from his stall or stalls, without court
order.

SECTION 34. EJECTED STALLHOLDERS DISQUALIFIED Stallholders who have been


ejected from his/her stall for cause as in this ordinance provided, shall be disqualified from applying
again for any vacant stalls/office spaces.

SECTION 35. GUIDELINES FOR THE USE OF TERMINAL FACILITIES- Passengers using the
terminal shall abide by the following:

a) Only passengers with Terminal Fee tickets are allowed to enter or use the terminal
facilities;
b) Passengers are not allowed to board on any passenger vehicle before scheduled
departure;
c) Passenger vehicles shall approach the designated loading area of passengers before
departure; and
d) Terminal fee tickets shall be attached to the bus tickets issued by the bus company.

ARTICLE VII
PRIVATE TERMINALS

SECTION 36. OTHER TERMINALS Any private terminals established shall be allowed only
beyond the Central Business District or Downtown of Ormoc. The management and operations of
private terminals are subject to other laws or ordinances governing the same.

ARTICLE VIII
FINAL PROVISIONS

SECTION 37. APPROPRIATION The amount necessary for the management and operation
of the Ormoc City Public Transport Terminal and to carry out the provisions of this ordinance is

hereby authorized and appropriated in the city annual budget and subject to COA accounting and
auditing rules and regulations.

SECTION 38. PENALTIES Any person/s who are found guilty violating any provision of this
Ordinance shall be punished:

A. First Offense Administrative Fine of Five Hundred Pesos (P500.00) payable to the City
Treasurers Office;
B. Second Offense
i. The violator may pay an Administrative Fine of One Thousand Pesos
(P1,000.00) at the City Tresurers Office within ten (10) days from the issuance
of the City Violation Ticket, otherwise, an appropriate case for violation of a
city Ordinance shall be filed in court;
ii. Should he be found liable for violation of this Ordinance, the violator shall
pay an Administrative Fine of not less than Two Thousand Five Hundred
Pesos (P2,500.00) and/or Imprisonment of Not More than thirty (30) days, at
the discretion of the court;
C. Third Offense
i. The violator may pay an Administrative Fine of Two Thousand Pesos
(P2,000.00) at the City Treasurers Office within ten (10) days from the
issuance of the City Violation Ticket, otherwise, an appropriate case for
violation of a city Ordinance shall be filed in court;
ii. Should he be found liable for violation of this Ordinance, the violator shall
pay an Administrative Fine of not less than Four Thousand Pesos (P4,000.00)
and/or Imprisonment of Not More than thirty (30) days, at the discretion of
the court;

SECTION 39. REPEALING CLAUSE All ordinances, rules and regulations on collection of
taxes, fees, charges or part thereof in conflict or inconsistent with the provisions of this Code are
hereby repealed, amended, or modified accordingly.

SECTION 40. SEPARABILITY CLAUSE If any section or portion of this Ordinance shall not
be declared unconstitutional or ultra vires, such declaration shall not invalidate the whole of this
Ordinance.

SECTION 41. MANDATORY REVIEW This Ordinance shall be reviewed again after five (5)
years of its effectivity.

SECTION 42. EFFECTIVITY This Ordinance shall take effect fifteen (15) days upon its
approval and shall be posted in at least 5 conspicuous areas within the territorial jurisdiction of the
Ormoc City.
