BE it enacted by the Legislative Assembly of the State of Tamil Nad u in the Fo'ty.
eighth Year of the Republic of India as follows :-
CHAPTER I.

Xt title, 1. (1)
- . This Act may be called the Periyar Unive~sity.Act, 199 7.

(3) I t applies to all colleges a d institutions situate within the Univcrsity
area and affiliated to, or approved by, the Univessity in accordance with the
provisions of this Act or the statutes, ordinances and regulations made thereunder
and also to all colleb,c -nd institutions deemed to be affiliated to, or approved by,
the 1Jnivei.:y under this Act.
(4) This section ancl sections 2 , 3 , 4 , 5 , 9 , 10, 11, 12, 13, 14, 15, 16, 18, 19,
46,55,56,57 and 65 shall come into force at once and the rest of this Act shall come
irto force on such date as the Government may, by notification, appoint.
:finitions. 2. I r. this Act, unless the context ot4erwise requires,-
( r t ) "affiliated college" m a n s any college situate within the Univcrsity area
and affiliated to the University and providin? courses of study for admission to the
examinations for degrees ot' thc University ancl includes a coilege deernett to be
affiliated to the University under this Act ;
(h) "approved college" means any collepe situate within the University
area and approved by the University and providinp courses of study for admission
to the examinationsfor titles and diplomas of the University and includes a college
deemed to be approved by the University und er this Act ;
(c) "autonomous coliege0 means any college designated as an autonomous
college by statutes ;
( d ) ' college" means any college or any institution maktained or approved
by, or affiliated to, the University and providing courses of study for ad mission
to the examinations of the University;
(a) "Government" means the State Government;

U) "hostel" means a anit of residence for the students of the I University


maintained or recognised by the University in accordance with the provisions of this
Act and includes a hostel ceemed to be recognised by the University under this
Act;
(g) "notified date" means the date specified in the notification issued under
sub-section (4) of section 1;
(h) ' 'post-graduate college" means sUniversity college or 'an ,affiliated college
situate within the University area and providing post-graduate courses of study
leading upto the post-graduate degrees of the University;

(9 "prescribed" means prescribed by this Act or the statutes, ordinances or


regulations;
( j ) "Principal"means the head of a college;

(k) " professional college" means a college established or maintained by the


University or m i a t e d to the University and providing courses of study leading
upto the professional degrees of the University;

(I) "~egistered graduate" means a graduate registered under this Act;

())I) "statutes", "ordini~nces" and "regulations" means, respechrcly, the
statutes, ordinances and regulations of the Unlvlersity made or conhnued In force
under t h ~ sAct;

(n) "teachers" mean such Lecturers, Readers, Assistant Professors,


Professors and other persons giving instruction in University colleges or .laboratories,
in affiliated or approved colle.~es,or in hostels, and Librarians as may be declared
by the statutes to be teacheis;
( 0 ) "teachers of the Univesity" means persons appointed by the University
to give ~nstructionon its behall;
(13) "University" means the Periyar University;
(q) "University area" means the area to which thrs Act extends under sub.
section (2) of section 1;
( r ) '(University centre" means any area within the University area recognisec~
by the Government on the recommendation of the University and containing one or
more colleges competent to engage in higher teaching and research work and to
promote University life in a m Inner calculated to prepare for the institution of a
new University;
(s) "Ulliversity college" means a college or a college combine? with a research
institute maintai,ze.l by the LTnl versity, whetner institute4 by it or not, and providing
courses of study leading upto the post-graduate and professional degrees of the
University;
( t ) "University Grants Conirnission" means the commission established I
under sectioi: 4 of tile Ui1iv:rsity Grants Commission Act, 1956.
(u) University laboratory" nleans a laboratory maintained by the University,
whether instituted by it or not, and intended for the carrying on and ad vancement
of reseasch ~ o r k ;
( V ) c"n;versity Lecturer", "University Reader" or 'University Professor''
meals a Lecturer, Read er or Professor, respect~vely,appointed or deemed to be
appointed as such by the University;
library" means a library maintamed by tho Universitya

whether instituted by it or not.3

3. (1) There shall be establishe! 9 U.3ivetsity by the name the Periyar Obr,
Uni verjit y. University. l
!?.)The University shall be a body corporate, shall have perpetual succession
and a co:nmon seal a.n? shall sue a d be sued by the said name.
(3) The headq~~arters of '.he Univeisity shall be locate1 within the limits of the
Salem City Municipal Corporation or in any place within .the radius of twenty-five
kilometres around those limits.

(b) shall have carried on research under conditions prescr~bed;
(5) to confer degrees, titles, diplomas and other academic distinc~ions on
persons who shall have pursued an approved course of study in an autonomous
collcge ;
(6) to hold examinations and to confer degrees, titles, diplomas and other
academic distinctions on persons who shall have pursued an approvcd course of
study by correspondence, whether residing within the Univ~rsityarea or not and to
provide such lectures and instrrrctions for persons not betng readents within the
University area under conditions presdbed ;
(7) to confer honorary degrees or other academic distinctions under conditions
prescribed;
(8) to institute, maintain and manage institutes of research. University
colleges and laboratories, libraries, museums and other ingtitutions nccersrrry to
carryout the objects of the University;
(9) to affiliate colleges to the University as affiliated, professional or post
graduate colleges under conditions prescribed and to withdraw aaliation, from
colleges;
(10) to approve colloger, providing courses of study for admission to the
examinations for titles and diplomas of the University under conditions prescribed
and to withdraw such approval;
(11) to designate any college as an autonomous college, with the concurrenc
of tho Government, in the manner and under conditions pre~cribed and. ?-to
ounce1 such designation;
(12) to institute lacturership, readerships, professorships and any other
teaching posts required by the University and to appoint persons to such lecturer
ships, readership, professorships and other teaching posts;
(13) to institute and award fellowships, travelling fellowships, scholarships,
studentships, bursaria,%xhibitions, medals and prizes in accordance with the
statutes;

(14) to establish, maintain and manage hostels, to recognise [hostels ,,t


maintained by the University and to withdraw recognition therefrom ;

(15) to exercise such control over the students of tile University! through the
colleges, as will secure their health and well-being and discipline;

(16) to hold and managa:endowmentsland other properties and!funds of the


University ;

(17) to borrow money, with the approval of the Government, on the security .
of the property of the University for the purposes of the Univ1:rsify :

(18) to fix fees and to demand and receive such fees as may be, prescribed;

(19) to make grants from the funds of the University for the maintenance cr
National Cadet Corps;

(20) to institlxte anc! maintain a Univ?rsity Extension Board;

(21) to institute and provide funds fbr the maintenance of--


(a) a publication bureau ;
(b) an employment bureau ;
(c) students' unions;
( d ) University athletic clubs; an?

(e) other similar associations.

(22) to encourage co-operation among the colleges, laboratories and insti-


tutes in the University area and co-operate with other Universities and other
a d o r i t i e s in such manner and for such purposes as the University may determiar;
(23) to recommend to the Government the recognition of any area within the
University area as a University Centre; and
$4) generally to do all such other acts and things as may be necessary or
desirable to further the objects of the University.
5. (1) No college within the University area shall be affiliated to any University Colleges not
other than the Periyar llniversity. to be affiliated
to any other
(2) No institution affiliated to, or associated with, or maintained by any other University and
university in the State of Tamil Nadu shall be recognised by the University for any racogniticm of
purpose except with the prior approval of the Governn.ent and the University Institutions bv

6. (1) No person shall be qualified forznomination or election as a member of Disqualification
any of the authorities of the IJniversity, if, on the date of such jnomination or for m e m m m .
election, he is-
(a) of unsocnd mint1 or a deaf mute; or
(b) an applicant to be adjudicated as an insolvent or@nmundischarged
insolvent ; or
( c ) seiitenced by a criminal court to i!nprisonment for any offence involv-
ing moral turpitude.
(2) In case of dispute or doubt as to whether a person is disqualified under
sub-section (1)' the Syndicat: shall determine and its decision shall be final.
7. (1) Notwithstanding mything conbiatd in section 20,23 or 24, no person Disqualificatien

Provided that for the purpose of computingthe total period of six years referred

in one authority elther by election or by nomination and the period of three years
during which he held office in another authority either by election or by nomination
shall be taken into account and accordingly, such person shall not be eligible
I for election or nomination to any one of the said three authorities:

Provided also that for the purpose of this sub-section, if a person was elected
or nominated to one authority and such person became a member of another
authority by virtue of the membership in the first mentioned authority, the period
for which he held office in the first mentioned authority alone shall be taken into
account .
(2) Nothing in sub-section (1) shall have applicatioil in respect of-
(i) ex-officio members referred to in section 20(3), Class I, but not ~nclurling
members of the Syndicate who are not otherwise members of the Senate referred to
in item (13) ; and
(ii) em-dj'icio members referred to in section 23(2) (a), Clasq I and section
24(b), Class I.
8. (1) The Chancellor ;hall have the right to cause an inspection or
inquiry to be made, by such person or persons as he may direct, of the University,
its buildings, laboratories, litlraries, museums, workshops and equipment and of
any institution maintained, rewgnised or approved by, or affiliated to the University
and also of the examinations, teaching and other work conducted or done by the
University, and to cause an inquiry to be made in respect of any matter connected
with the University. The Chancellor shall in every case give notice to the University
of his intention to cause such inspection or inquiry to be made and the University
shall be entitled to be represented thereat.
(2) The Chancellor shall comtnunicate to the S~ndicatehis views with
reference to the results of such inspection or inquiry and may, after ascertaining the
opinion of the Syndicate thereon, advise the University upon the action to be taken
and fix a time limit for taking such action.
(3) The Syndicate shall report to the Chancellor the action, if any, which is
I proposed to be taken or has been taken, upon the results of such inspection or
inquiry. Such report shall be submitted within such time as the Chancallor may
direct.
(4) Where the Syndicatedoes not take action to the satisfact~onof I hc Chancellor
within a reasonable time, the Chancellor may, after considering any explanation
furnished or representation made by the Syndicate, issue such directions as he may
think fit and the Syndicate shall comply with such directions. In the event of the
Syndicate not complying with such directions within such time *IS may be fixed i n
that behalf by the Chancellor, the Chancellor.shall have power to appoint any
person or body to comply with such directions and make such orders as may be
necessary for the expenses thereof.

b'oChallC8uor. 10, (1) The Governor of Tamil Nadu shall be the Chancellor of the University.

He shall, by virtue of his office, be the head oi the University and shall, when present,
preside at any co?vocation of the University and confer degrees, titIcs, diplomas or
other aoademic distinctions upon persons entitled to receive them.

(2) Where power is confe~rcdupon tha Chancellor to nomlnate persons to
the authorities, the Chancellor shall, in consultation with the Vice-Chancellor,
and to the extent necessary noainate persons to represent interests not otherwise
adequately represented.
(3) The Chancellor may of his own motion or on applicat~o call for and
examine the record of any officer or authority of the Univers~tyin respect of ally
proceedings to satisfy himself as to the regularity of such proceedings or the
correctness, legality or propriety of any decision taken or order passed therein
and, if, in any case, it appears to the Chancellor that any such decision or order
should be modified, ann.~lled,reversed or remitted for reconsideration, he may pass
orders accordingly :
Provided that every applicr~ti~nto the Chancellor for the exercise oi the powers I
under this section shall be preferred within three months from the date on which
the proceeding, decis~onor ordt:r to which the application relates was commun~cated
to the applicant :

Provided further that no order prejudicial to any person shall be passed unless
such persoil 11;ts bee11 given a,z opport~nityof maklng his represei~tation.

(4) The Chancellor shall exercise such other powers and perform such other
duties as may be conferred on him by or under this Act.

11. (1) The Minister-in-charge of the portfolio of Education in the State of R ~ -


Tamil Nadu shall be the Pro-ChanceIlor of the University. Chancellor

(2) TI-e Prn-Chancellor shall exercise such powers and perform such duties
as may be conferred on him by or under this Act.

12. (1) Every iippointment of the Vice-Chancellor shall be made by the ~h~ vice
Chdncellor from oui of a pai el of three names recommended by the Cornnuttee Chancellor
rbferred to in sub-section (2). Such panel shall not contain the name of any member
of the said Committee:

I Provided that ii the Chancellor does not approve any of the persons in the
panel so recommended by the Committee, he may take steps to constitute another
Committee, in accordance with sub-section (2), to give a fresh Pace1 of three different
names and shall appoint one oft he persons named in the fresh panel as Vice-Chancellor.
(2) For the purpose of sub-section (1). the Committee shall consist of three
persons of whom one shall be nominated by the Government, one shall be nominated
by the Senate and one shall be nominated by the Syndicate :

Provided that the person so nominatedishall not be a member of any of the


authorities of the University.
(3) The Vice-Chancellor shall hold office for a period of three years and shall
be eligible for reappointment for a further period of three years:
Provided that no person shall hold tne office of the Vice-Chancellor for mole
tna.1 six yearsin the aggregate:
Provided further that-
(a) the Ciiancellor may direct that a Vice-Chancellor, whose term of office
has expired, shall continue in office for such period, not exceeding a total period ot'
one year, as may be specified in the direction ;
(b) Tne Vice-Chancellor may, by writing under nls hand addresstd to the
Chancellor and after giving two month9 notice, resign his office :
Provided also that a personaappointed as Vice-Chancellor shall retire fron office
if, during the term of his offic: or any extension thereof, he completes the age of
sixty-five years.

(4) When any temporary vacancy 0ccu;s in the ~tliceof the Vice-chancellor

is appointed as Vice-Chancallor, he shall be allowed to continue to col~tributeto ihe
Provident fund to which he is a subscriber, and the contribution of theChiversity shall
be limited to what he had been contributing immediately before his appointment as
Vice+Chancellor;
( 3 ) The Vice-Chancellor shall be entitlsd 'to travelling allowtmc6 at such
lvtes as may be fixed by the Syndicate ;
(iv) The Vice-Chancellor sball be entitled t c ~r,s::! lspV on fill1 pay at one-
eleventh of the periods spent by him on active service:
Providcd that when the e a m d leave applied for by the Vice-Chancellor, in
sufficient time before the date of expiry of the term of his office, is refused by the
(Bancellor in the interest of the Urliversity and if he does not avail of the leave before
the date of expiry of the term of his office,he sha1I be entitled to draw cash equivalent
to leave salary after relinquishment of' his ofice in respect of earned leave at his
credit subject to a maximi~mef t f i ~17aiidred and forty days ;
(v) The Vice-Chancellor shall be entitled, on medical grouilds or othervglsc,
to lewe without pay for a period not exceeding three months during the term of his
effice :

;eCbanctll~r. cellor, preside at any convocation of the University and confer degrees, titles, diplomas
er other academic distinctions upon persons entitled to receife them. He shall be a
member ex-officio and C5airman of the Senate, the Syndicate, the Standing Committee
*a Academic Affairs and the Finance Committee and shall be entitled to be present
at, and to address, any meeting of any authority of the University but shall not be
**titled to vote there at, unless he is a member of the authority concerned.
(2) It shall be the duty of thc Vice-Chancellor to ensure that the provisioas
mr tnrs nct, the statuks, ordinances and regulations are observed and carried o a t
n d he may exercise all powers neoeasary for this purpose.
(3) The Vice-chancellor shall have power to mnvene meetings of the Senate,
the Syndioate, the C:-~diagCemmittoo on Academic Affairs and the Fiaante Com-

(4) (a) The Vice-Chancellor shail have power to take action on m y matter
and shall by order take such action as he may deem necessary but shall, as soon as
may be, thereafter report the action taken to the officer or authority or body who er
which would have ordinarily dealt with the matter :
Provided that no such order shall be passed unleris the person likely to be
affected has been given a reasonable opportunity of being heard ;
(b) When the action taken by the Vice-Cham ellor under this sub-gectien
affects any person in the service of the University, such person shall be entitled to
prefer an appeal to the Syndicate within thirty days from the date on which he has
sotice of such action. The VicaChancellor shall give effect to the order pus+
by the Syndicate on ruch appeal.
(5) The Viw-Chancellor shall give effect to the orders cf the Sytdimte
regarding the appointment, suepension and dismissal of the teachers and sther
employees of the Ibivensity.
(6) The Vice-chancellor shall exercise control over the flairs of the Univop-
sity and shall be responsible for the due maintenance of discipline in tke Univet-
.
sity
(7) The Vice-Chancellor ohall be responsible for the coordination p.d int9-
lyation of teaching and research, extension education and curriculam developnunt.
(8) The VicbChancellor rhall exercise such other powers and perform such
other duties as may be prescribed by statutes.

14. (1) The Registrar sllall be a wholetime splaried officer of the University
appointed by the Syndicate 2nd the terms and conditions of service of the Registtar -RoQ(rrr.
shall be as follows :- 1
(i) The holder of the post of Registrar shall be an academician r c' Iwer
in rank than that of Professor of a college affiliated to any University ;
(ii) The Registrar shall hold office for a period of three years. 1

reason of illness, absence or any other cause, unable to perfcrm the duties of his

the Vice-Chancellor may appoint for the purpose.

(d) No appeai uncle1 clause (b) or clause (c) shall be prefesred ahel me
expiry of sixty days from the date on which the order appealed against was received
by the appellant.
(3) The Registrar shall be the esoificio Secretary to thc Senate, the Syndi-
cate, the Faculties and the Boards of Studies, but shall not be deemed to be a member
of any of these authorities.
(4) It shall be the duty of the Registrar,-

(a) to be the custodian of the records, 'the common seal and such o t h e ~
property of the University as the Syndicate shall commit to his charge ;
(b) to issue all notices convening meetings of the Senate, the Syndicate,
the Faculties, the Boards of Studies, the Boards of Examiners and of any Committee
appointed by the authorities of the University ;
(c) to keep the minutes of all the proceedings of the meetings d'the Senate,
the Syndicate, the Faculties, the Boards of Studies, the Boards of Examiners ~ n d
,of any Committee appointed by the authorities of the TTniversity ;
(d) to conduct the official correspondence of the Syndicates ;
(e) to supply to the Cha~lcellor,copies of the agenda of the meetings ot
the authorities of the University as soon as they are issued and the minutes of the
proceedings of such meetings ; and
(f) to exercise such other powers and ~erformsuch other duties as may be
specified in the statutes, the ordin,inces or the regulations or as may be required,
from time to tine, by the Syndicate or the VicsChancellor.
(5) I n all suits and other legal proceedings by or against the University,
the pleadings shall be signed and verified by the Registrar and all processes in such
suits and proceedings shall be issued to, and served on, the Registrar.

15. (1) The Finance OBcer shall be a whole-time salaried officer of the Univer-

sity appointed by the Syndicate for such period as may be specified by the Syndicate
m. in this behalf.

(2) Every appointment of the Finance Officer shall be made by the Syndicate
Prom out of a panel of three names recommended by the Government.
(3) The emoluments and other terms and conditions of service of the Finance
Officer shall be such as may be prescribed by the ordinances.
(4) The Finance Officer shall retire on attaining the age of fifty-eight years
or on the expiry of the period specified by the Syndicateunder sub-section (I), which-
ever is earlier:
Provided that the T:-*nce Officer shall, notwithstanding his attaining the age
d fifty-eig t ycqrs,continue in officeuntil his successor is appointed and enters

upon his o ce or until the expiry of 2 period oi one year, whichever IS earlier.
(5) When the office of the Finance Officeris vacant or when the Finance Officer
fs, by reason ot illness, absence or any other cause, unable to perform the duties ot
his ofice, the duties of the Finance Officershall be performed l>ysuch person as the
Vice-Chancellor may appoint for the pwpos-.
(6) The Finance Officer shall be the ex-oflicio Secretary to the Finance
Committee, but shall not be deemed to be a member of such Committee.
(7) The Finance Officer shall,-
(a) exercise general supervision over the funds of the University and shall
advise the University as regards its h a n c i a l policy; and

(b) cxcrcise such other powers and perrorm such other flnancial functions
as may be assigned to him by the Syndicate or as may be prescribed by the statutes or

provided :hat the Finance Officer shall not incur. any expenditure or make anv
investment exceeding such amount as may be prescribed whhout the previous approvd
of the Syr,dicate.
(8) Subject to the control of the Syndicate, the Finance Officer shall,-
(a) hold and manage the property and investments 01 the University including
trust and endowed property;
(b) ensure that tLr. :il,i:: fr:d by thc Syndicate for recurring and non-recurring
expenditure for a year are not exceeded 2nd that all moneys are expended on the
purposes for which they are granted o r allotted;
(c) be responsible for the preparation of annual accounts, flnancial estimates .
and the budget of the University and for their presentation to the Syndicate;
(d) keep a constant watch on the cash and bank balances and of investments;

(e) watch the progress of the collection of revenue and advise on the methods
of collection employed;
(f)ensure fhat the registers of buildings, lands, furniture and equipments are
maintained up-to-date, and that stock checking is conducted, ot equipments and other
consumable materials in all offices, special centres, specialised laboratories and
colleges maintained by the Univers~ty;
(g) bring to the notice ot the Vice-Chancellor any unauthorised expenditure
or other financial irregularity and suggest appropriate action to be taken against '

persons at fault; and


(h) call from any oflice, centre, laboratory and college maintained by the
University, any intonnation or returns that he may consider necessary for the per-
formance of his duties.
(9) The receipt ot the Finance Officer or of the person or persons duly authorised
in this behalf by the Syndicate for any money payable to the University shall be
sufficient discharge for payment of such money.

16. (1) The Controller of Examinations shz.11 be a whole-time ofacer of the The

than the ex--0fficio members, shall hold office for a period of three years and such
members shall be eligible for election for not more than another period of three
years.
(ii) Where a member is elected or nominated to the Standing Committee

choose whether he will continue to be a member of the Standing Committee on
Academic Affairs by virtue 01' his election or whether he will vacate office as such
member and become a member ex-oflicio by virtue of his appointment and the choice
shall be conclusive. On failure to make such a choice, he shall be deemed to have
vacated his office as an elected member.
(d) The members of the Standing Committee on Academic Affairs shall not
be entitled to receive any remuneration from the University except such daily and
travelling allowances as may be prescribed :
Provided that nothing contained in this clanse shall preclude any member
from drawing his normal emoluments to which he is entitled by virtue of the office
he holds.
(e) A member of the Standing Committee on Academic Affairs, other than
ex-oficio member, may tender resignation of his membership at any time before
the term of his office expires. Such resignation shall be conveyed to the
Chancellor by a letter in writing by the member, and the resignation shall take
effect from the date of its acceptance by the Chancellor.
(3) The powers and duties of the Standing Committee on Academic Affairs
shall be such as may be prescribed by the statutes.

THE SYNDICATE.

the choice shall be conclusive. On failure to make such a choice, he shall be deemed
ta have vacated his office as an elected or a nominated member.

(f) When a person ceases to-be a member of the Syndicate, he shall


ccast to be a m7mber of any of the authorities of the University of which he may
kappeu to be a member by virtue of !/his membership of the Syndicate.

(g) The members of the Syndicate shall not be entitled to receive any
remuneration from the University except such daily and travelling allowances as
may be prescfibed 1
Provided that nothing contained in this clause shall preclude any member from
drawing his normal emolumenb to which he is entitled by virtue of the office he

(h) A member of the Syndicate other than e - o f i o member, may tender
resignation of his membersbip at any time before the term of his office expires.
'St~chresignation shall be conveyed to the Chancellor by a letter in writing by the
member, and the resignation shall take effect from the date of its acceptance by the
Chancellor.
25. (a) The Syndicate shall have the following powers, namely :-

sity and to withdraw such approval ;

(7) to institute lecturerfahips,readerships, professorships and any other teaching
posts required by the Univc:rsity ;

(8) to pescr~betbp coqditinns for affiliating coIleges to the University and


tc withdraw affiliation from colleges ;
(9) to prescribe the rnmner in which, and the conditions subject to which, a
college may be designated as an autonomous college and such designation may be
cancelled ;
(10) to provide such lsctures and instructions for students of University
colleges, affiIiated colleges and approved colleges as tbe Senate may determine and
a l s ~to provide for lectures a~ldinstructions to persons not being students of colleges
and to grant diplamas to them;

(1 I) to institute degrecs, titles, diplomas and other academic distinctions;

or laboratory or in an affiliated or approved college or have been exempted there-
from in the manner prescribed and shall have passed the prescribed examinations of

(4) (a) The Syndicate may, for the purpose of consultation, invite any person
havingspecial knowledge or practical experience in any subject under consideratio.
to attend to any meeting. Such person may speak in, and otherwise take part in,
the proceedings of such meeting but shall not be entitled to vote.

( b ) The person so invited shall be entitled to such daily and travelling


allowances as are admissible to a member of the Syndicate.
Awtul 27. The annual report of the University shall be prepared by the Syndicate and
orpon. shall be submitted to the Sena.teon or before such date as may be prescribed by the
statutes and shall be considered by the Senate at its next arnnllal meeting. The
Senate may pass resolutions thereon and communicate the same to the Syndicate
which shall take action in accordance therewith. The Syndicate shall inform the

Senate of the action taken by it. A copy of the report with a copy of the resolutions
thereon, if any, of the Senate shall be submitted to the Government for information.

A ~ n Ia 28. (1) The annual accounts of the University shall be submitted to such
accounts. examination and audit as the Government nay direct and a copy of. the annual
accounts and audit report shall be submitt& to the Government.
(2) The University shall settle objmons aid in s:ch audit and carry out
such instructions as may be issued by the Government on b e audit report.
(3) The accounts, when audited, shall be published py the Syndicate in such
manner as may be prescribed by the ordinances and copies thereof shall be submitted
to the Senate at its next meeting and to the Government within three months of such

THE FACULTIES, !THE BOARDS OF STUDIES, 'THE FINANCE COMMITTEE
AND OTHER AUTHORITIES.
oDd 29. (1) The Univetsity shall include Faculties of Arts, Science, Law, Engineering
of and Technology, Education, Commerce, Indian and other Languages, Fine Arts and
F8a1nhm. such other Faculties as may be prescribed by t k e statutes.

i (2) The constitution and functions of the Faculties shall, in all other respects,
! be such as may be prescribed by the regulations.
(3) Notwithsta ding anything contained in sub-section (2), the Standing

Committee on Acad c Affairs may, on the recommendatians of the Syndicate,
appoint any teacher of the University as a member of a Faculty.
(4) Each Faculty shall comprise such departments of teaching as may be pres-
cribed by the statutes,
30. There shall be Boards of Studies attached to each department of teaching.
The constitution and powers of the Boards of Studies shall be such as! may be
prescribed by the ordinances.

of whom one shall be Professor and one shall be a person nominated to the Syndicate

(2) If for any reason the officer referred to in clause (ii) or clause (iii) of sub-

section ( I ) is unable to attend any meeting of the Finance committee, he may depute
any officer of his department not lower in rank than that of Deputy Secretary to
Government to attend such meeting. The officer so deputed shall have the right to
take part in the discussions of the Committee and shall have the right to
vote.
(3) The Vice-Chancellor shall be the ex-ojficio Chairman of, and the
Finance Officer shall be thc cx-officio Secretary to, the Finance Committee.
(4) All the members of the Finance Committee, othei than the e 4 f i c ; o
members, shall hold office for a period of three years.
(5) The Finance C u n m ; L t YAa!! meet at least twice in every year to examine
the accounts and to scrutinisz proposals fcr expenditure.
(6) The annual accounts of the University prepared by the Fin- O5cer shell
be laid before the Finance Committee for consideration and comments and there-
after submitted to the Syndicate for approval.
(7) The Finance Committee shall recommend limits for the total recurring
wrptnditure and thf: total non-recurring expenditure for the year based on the income
lad resources of th~: University which, in the case of productive works, olay include
Lke proceeds of loans.
(8) The Finance Committee shall-
(a) review the financial position of the University from time to time ;

(b) make recommendation to the Syndicate on every proposal involving


~nvostmentor expenditure for which no provision has been made in the annual '
financial estimates or which involves expenditure in excess of the amount provided
fer in the annual financial estimates;
(c) prescribe the methods and procedure and forms for maintaining the
aooounts of the University and Colleges;
(d) make recommendations to the Syndicate on all matters relating to the
Crarces of the University ; and
(e) perform such other f u n c t i o n s ~ a s be
~ yprescribed.

(9) The flnancial estimates of the University prepared by the Finance Wasr
&dl be laid before the Finance Committee for consideration and comments. The
mid estimates, as modified by the Finance Committc:e, shall then be laid hefore the
Ilyndicate for consideration. The Syndicate may accept the modiflcation made by
the Finance Committee.

CHAPTER VI.
STATUTES, ORDINANCES AND REGULATIONS.
33. Subject to the pro~isions of this Act, the statutes may provide for St*-

colleges including the constitution or reconstitution, powers and duties of Standing
Committee on Academic AEiirs, StafF Council, ~ o a r d of s studies and Boards of

(xix).the delegation of powers vested in the authorities or officers of the


University ; and
(xx) any other matter which is required to be or may be ptescribed by the
statutes;

34. (1) The Syndicate may, fron time to time, make statutes and amend or

repeal the statutes in the manner hereafter provided in this section.
(2) The Standing Committee on ,lcademic Aff~.irs may provose to the Syndi-
cate the draft of any statute or of any amendment to or of repeal of, a statute to be
passed by the Syndicate and such draft shall be considered by the Syndicate at its
next meeting :

Provided that the Standing Committee on Academic Affairs shall not pro-
pose thedraft of any statute or of any amendment to, or of repeal of, a statute relating
to matters other than academic affairs.

(3) The Syndicate may consider thedraft proposed by the Standing Committee
on Academic Affairs under. sub-seotion (2) and may either pass tht draft m reject
or return it with or without amendments to the Standing Committee on Academic
Affairs for reconsideration.

Admission to 38. (1) No persons shall be ac~mittedto a course of study in the University

as a member of a University college or laboratory or of an affiiliated or approved
college. Any such exemption ma:. be made subject to such cor.diti01.s as the Syndi-

(3) Students exempted from the provisions of sub-section (2) and students
admitted, in acaordance with the conditions prescribed, to courses of study other
than courses cf study for a degree shall be non-collegiate students of the University .

(2) Where the Univer.sity has so instituted a Provident Fund u1.1cler


sub-section (I), the Government may declare that the provisions of the Provident
XIX Funds Act, 1925 shall apply to such funds as it the university where a local
authority and the fund a Government Provident Fund.
(3) The Ur~iveritymay, in consultation with the Finance Committee, invest
the provident fund amount in such manner as it may determine.

44. Subject to the provisions of this Act, the appointment. procedure for selection, Cooditbnsol
pay and allowances and other conditions of service of officers, teachers and other
persons employed in the University shall be such as may be prescribed.
IxpIQ~tion. -For the purposes of this section, the word "officers" shall not
include the Chancellor and the Pro-Chancellor.

45. (1) There shall be Selection Committees for making recommendations sel-
to the Syndicate for appointment to the posts of Professor, Assistant Professor, Committcca.
Reader, Lecturer and Librarian of Institutions nlaintained by the University.
(2) The Selection Conunittee for appointment to the posts specified in column
(1) of the Table below shall consist of the Vice-Chancellor, a nominee of the
Chancellor, a nominee of the Governmect and the persons specified in the cones-
ponding entry in column (2) of tbe said Table and in the case of appointment of a
Professor, Assistant Professor, Reader or Lecturer in a Department, where there is
no Head of the Department, shall also consist of a pers n nominated by thc Standing
Committee on Academic Affairs from among its memt ers:-

necessary to fill the vacancy, the appointment may be made on a temporary basis by

(3) A person appointed as Head of the Department shall hold office as such
for a period of three years and shall be eligible for reappointment.
(4) A Head of the Department may resign his office at any time during 11is
tewre of office.
(5) A Head of the Department shall perform such functions as may be pres-
cribed by the ordinances.
47. (1) Every Dean of Faculties shall be appointed by the Vice-Chancellor Deansof

any person from the membership of any authority of the University if he becomes .

53. Notwi.thstanding anything contained in this Act, or in any other law for

formation from the University or any matterrelating to the affairs of the University
and the University shall, if such information is available with it, rurnish the Govern-
ment with such information within a reasonable period :
Provided that in the case of information which t'le University considers confi-
d ential, the University may place the same before the Chancellor and Pro-
Chancellor.

(2) All applications for registration under sub-section (I) shall be sent
to the Reg~strartogether with the prescribed fee and such proof of qualifications as
mav be prescribed by the statutes.
(3) The Registrar shall, on receipt of an applicatio,n made under sub-section
(2')and after making such enquiry as he.deems fit, enter in the register of graduatm
the name of the applicant.

Affairs and such othei a~thorities of the University within six months after the Vic&hancallor*
~lotifiecldate or such longer period, not exceeding one year as the Government may,
by notification, direct.
(2) The first Vice-Chancellor shall, in consultation with the Government,
make such rules as may be necessary for the functioning of the University.
(3) The authorities coristituted under sub-section (1) shall commence to
exercise their functions on suck date as the Government may, by notification, specify
in this behalf.
(4) It shall be the dutj of the first Vice-Chancellor t o c'raft such statutes,
ordinances ar,d legulations as may be necessary and submit them t o the respective
authorities comretent to deal with them for their disposal. Such statutes, ore inanma
- and regulations, when framed, shall be published in the Tarvltl Nadu Government
Guzette.
(5). Notwtthstand ing mything contained in this Act and the statutes 3nd

(4) Noti\ ithstanding anything contained in this Act. the statutes, ordinances
and regulations contimed in force under sub-section (3) or made under this Act,
every person who, immediately before the notifkd date. nas a student of a college
within the University area a l i a t e d to, or approved by the Chennai University and
sf the Departments ot that University or was eligible for any of the examinations
of the Chennai University shall be permitted to complete his course of study in the
Periyar University, and the Periyar University shall make arrangements
for the instruction, teaching and training for such students for such period
and in such manner as may be determined by the Periyar University jn

vision, not inconsistent with the provisions of this Act, as may appear to them to
be necessary or expedient for removing the difficulty :
Provided that no such notificatiqn shall be issued after the expiry of five years
from the date of establishsent of the University under section 3.
(2) Every notification issued under sub-section (1'1 or under any other provi-
sions of this Act shall, 2s soon as possible after it 1s issued, be placed on the table
of the Legislative Assembly, and if, before the expiry of the session m which it is so
placed or the next session, the Assembly makes any modification in any such notifi-

F The following Act of the Tamil Nadu Legislative Assembly received the assent of
the President on the 14th Septembu 2002 and is hereby published for general
information:-

An Act further to antend the Tamil Nadu Universities Laws. -

BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Fifty-third
Y e ~ roi'the Republic of India as follows:-

PART-I

1. (1) This Act may be called the Tamil Nadu Universities Laws (Amendment) Act, Short title and
comrnence-
2002. mt.

(2) It shall come into force on such date as the State Government may, by

45-A. Trcinsfer of certain colleges to Unitwrsity.-( 1) Notwithstanding anything


contained in this Act or the statutes, regulations, ordinances and orders made thereunder,
on and from the date of commencement sfthe Tamil Nadu Universities Laws (Amendment)
Act, 2002 (hereafter in this Chapter referred to as the not fied date), the colleges and
institutions specified in Schedule 111 shall be transferred to, and maintained by, the

Chennai University as the constituent colleges of that University.
(2) On and from the notified ddte, the control and management of the constituent
colleges specified in sub-seetion (1) and all properties, assets-snd liabilities of the
Government in relation thereto shall stand transferred to, and vest in,*the Chennai
University.

45-8. Transfer of certain employees.- (1) Every person, who immediately before
the notified date, is serving in the college or institution specified in Schedule 111 shall, as
from the said date, become an employee of the University and shall cease to be an
employee of the Gbvernnient.
(2) Every person referred to in sub-section (1) shall hold office under the Chennai
University for the same tenure at the same remuneration and up In the same rights and
pri ~ilegesas to pension or gratuity, if any, and other matters as Ite would have held the
same on the notified date as if the Tamil PIadu Universities Laws (Amendment) Act, 2002-
had not been passed.
(3) The liability to pay pension and gratuity to the persons referred to in sub-
section (1) shall be the liability of the Chennai University.
45-C. Transfer of accumulations in Provident Fund and other like Funcis.- (1) The
sums at the credit ofthe Provident Fund Accounts of the persons referred to in sub-section
(1) of section 45-Bas on the iotified date shall be transferred to the Chennai University
and the liability in respect of the said Provident Fund Accounts shall be the liability of the
Chennai University.
(2) There shall be paid to the Chennai University out of the accumulations in the
superannuation fund and other like funds, if any, of the Government, such amounts as

have been credited to the superannuation fund or other like funds, if any, on behalf of the
persons referred to in sub-section (1) of section 45-B.The amounts so paid shall form part
of the superannuation fund or other like funds, if any, that may be established by the
Chennai University for the benefit of its employees.".
Addition of new 4. After Schedule I1 of the 1923 Act, the following Schedule shall be added,

TO THE MADURAI-~AMARAJ ACT, 1965.

5. In section 1 of the Madurai-Kamaraj Univershy Act, 1963 (hereatter Em this Part Amndmentof

40-C. Transfer of accumulations in Provident Fund and other like Funds.-- (1) The
sums at the credit of the Proviient Fund Accounts of the persons referred to in sub-
section (1J of section 40.8 as on the notified date shall be transferred to the Madurai-
Kamaraj University and the liability in respect of the said Provident Fund Accounts shall
be the liability of the Madurai-Kamaraj University.
(2) There shall be pilid to the Madurai-,Kamaraj University out of the
accumulations in the superannuation fund and other like funds, if any, of t h Government,

such amounts as have been credited to the superannuation fund or other like funds, if any,
on behalf of the persons referred to in sub-section (1) of section 40-B. The amounts so

TO THE BHARATHIAR ACT, 198 1.

imendment of 8. Insection 1 ofthe Bharathiar University Act, 1981 (hereafter in this Part referred

colleges and institution", the expression "It applies to all constituent colleges, colleges
and institutions" shall be substituted.
Amendment of 9. In section 2 of Tamil Nadu Act 1 of 1982,-
section 2.
(1) in clause (d), the following expression shall be added at the end, namely:-
"and includes constituent colleges;";
(2) after clauab (d), the following clause shall be inserted, namely:-
"(dd) "constituent college" means any college specified in the Schedule;".
Insertion of new 10.After Chapter IX of Tamil Nadu Act 1 of 1982, the following Chapter shall be

Government in relation thereto shall stand

referred to as the 1985 Act), the following section shall be inserted, namely:- section I-A.

"1-A. Application of this Act.-This Act applies to-


(a) all constituent colleges;
(b) all colleges deemed to be affiliated to, or approved by, the University
under this Act;
(c) all colleges situate within the University area and affiliated to, or
approved by, the University in accordance with the provisions of this Act or the statutes
made thereunder. ".
l7.In section 2 of the 1985 Act,- A m e ~ d w nof

(1) for clauses (a) and (b), the following clauses shall be substituted, namely:-
" ( a ) "affiliated college" means any college or institution situate within the
University area and affiliated to the University and providing courses of study for
admission to the examination for degrees of the University and includes a college deemed
to be amliated to the University under this Act;
(nb) "approved college" means any college situate within the University area
and approved by the University and providing courses of study for admission to the
examinations for titles and diplomas of the University and includes a college deemed to
be approved to the University under this Act;
((Ic)"autonomous college" means any college designated as an autonomous
college by statutes;
(crcl) "college" means any college or institution, maintained or approved by,
or affiliated to, the University and providing courses of study for admission to the
examination of the University and includes a constituent college;
(1)) "constituent college" means any college or institution specified in the
Schedule I and 11;".
( 2 ) after clause (li), the following clause shall bc inserted. namely:-

Amcndmcnt or 18. In section 3 of the 1985 Act, for sub-sections ( 3 ) and (4), the following sub-
section 3.
sections shall be substituted, namely:-
"(3) The University shall be of the affiliating type.
(4) The jurisdiction of the University shall extend to the whole area comprising
the districts of Sivaganga and Ramanathapuram jn the State of Tamil Nadu.
(5) The headquartersof the University shall be located in the Alagappa Nagar in '
Sankarapuram Panchayat in Karaikudi Taluk.".
Omission of 19.Section 4 of the 1985 Act shall be omitted.

Amendment of 20. In section 5-A of the 1985 Act,-
b
section 5-A .
(1) In clause (?), in sub-clause (a), after the expression " laboratory", the
expression "or in an affiliated college or approved college" shall be inserted;".
(2) After clause (2), the following clause shall be inserted, namely:-
"(2-a) to hold examinations and to confer degrees, titles, diplomas and other
academic distinctions on persons who shall have pursued an approved course of study by
correspondence, whether residing within the University area or not and to provide such
lectures and instructions for persons not being residents within the University area under
conditions prescribed;
(2-b) to affiliate colleges to the University under conditions prescribed and
to withdraw such affiliation:
Provided that no college shall be affiliated to the University unless the permission
of the Government to establish such college has been obtained and terms and conditions,
if any, of such permission have been complied with;
(2-c) to approve colleges providing courses of study for admission to the
examinations for titles and diplomas o f the University under conditions prescribed and
to withdraw such approval:
Provided that no college shall be approved by the University unless the permission
of the Government to establish such college has been obtained and the terms and
conditions, if any, of such permission have been complied with;
(2-d) to designate any college as an autonomous college with the prior
concurrence of the Government under conditions prescribed and to cancel such
designation;".
Substitution of 2 1. For section 6 of the 1985 Act, the following section shall be substituted, namely:-

(1) No college within the University area shall be affiliated to any University
other than the Alsgappa University.
(2) No i~~stitution
affiliated to, or associated with, or maintained by any other
University in the State of Tamil Nadu shall be recognized by the University for any

Amendment of 22. In section 9 of the 1985 Act, in sub-section ( I), for the expression beginning with
section 9. .the words "The Chancellor shall have the right", and ending with the words "connected
wit11 the University", the following expression shall be substituted, namely:-
"The Chancellor shall have the right to cause an inspection or inquiry to be made.

23. In section 2 1 of the 198.'; Act, in c1;ruse (a),- Amendment of
section 21.
(1) under the heading "Class I - Ex-Oflcio Members", for item (9),the following
items shall besubstituted, namely:-

I "(9) Heads of University Departments of Study and Research;

(9-B) The Librarian of the University Libraiy;
(9-C) The Director of Physical Education of the University;

(2) under the heading "Class 11- Other Members", after item (1). the following items
shall be inserted, namely:-
"( 1-A) One member elected by teachers of each college from among themsel~.: ;

(1-B)One member elected From among themselves by the Secretaries of the


college committees of the private colleges, as defined in the Tamil Nadu Private Colleges
(Regulation) Act. 1976 (President's Act 19 of 1976) within the University area;

revenue district within the University area;
( I -D) One member elected by registered graduates in each revenue district within

24. In section 24 of the 1985 Act, in sub-section (2), in clause (a), under the heading
"Class I1 - Other Members", for the expression "Two members nominated by the Vice-

college may be .designated as an adtonomous college and such designation may be
cancelled;

(5-D) to affiliate or approve colleges within the University area and to recognize
colleges as approved colleges;
(5-E) to designate any college as an autonornols college and to cancel such
designation with the concurrence of the Government;".
(2) in sub-clause (7),after the expression "University colleges", the expression

(3) in sub-clause (9), after the expression "laboratory", the expression "or an
afiliated college or approved college" shall be inserted;
(4) in sub-clauses (28) and (29), for thc expression "University colleges", the

substituted;
' (5) in sub-clause (37), for the expression "University colleges", the expression
"University colleges, affiliated colleges and approved colleges" shall be inserted.
Amendment of 27. In section 34 of the 1985 Act, after clause (xv), the following clauses shall be

section 36. 28. In section 36 of the 1985 Act,-
. (1.) in clause (i), after'the expression "the University", the expression "and its
affil~atedculleges or approved colleges" ahall be substituted;

(3) after clause (xi), the following clause shall be inserted. namely:-
(xi-a) the conditions subjezt to which persons who may hereafter, be
permanently employed may be recognized as qualified to give instruction in affiliated
colleges and apprcved colleges and hostels; and". ,
29. In section 39 of the 1985 Act, in sub-section (2), after the expression "univer$ity Amendment of
college", the expression "or an affiliated college or approved college" shall be inserted. section 39.

30. In section 40 of the 1985 Act, after the eisiession "Universit;? ~ o l l & ~ ethe

3 1. After Chapter X of the 1985 Act, the following Chapter shall be added, namely:- Insertion of new
Chapter X-A.

"CHAPTER X-A.

5 2 4 . Tamil Nadu Act 33 of 1965 not to a p p l y . 4 1 ) Subject to the provisions of


sub-sections (2) to (6), the Madurai-Kamaraj University Act, 1965 (Tamil Nadu'Act *33
of 1965) (hereafter in this section referred to as the University Act) shall, witheffect cin
and from the dafe of the commencement ofthe TamilNadu Universities Laws (Amendment)
Act, 2002 (hereafter in this Chapter referred to as the notified date), cease to apply in
respect of every college to which this Act applies.

I (2) Such cessor shall not affect-


(a) the previous operation of the University Act in respect of the colleges
referred to in sub-section (1);
(b) any penalty, forfeiture or punishment incurred in respect of any offence
committed against the University Act; or
(c) any investigation, legal proceedings or remedy in respect of such penalti,
forfeiture or punishment and any such investigation, legal proceedings or remedy may be
instituted, continued or enforced and any such penalty, forfeiture or pun~shrnentmay be
imposed as if the Tamil Nadu Universities Laws (Amendment)Act, 2002 had not been
passed.
(3) Notwithstanding anything contained in sub-section (1 ).all statutes, ordiriances
and regulations made under the University Act and in force on the notified daie shall, in
so far as they are not inconsistent with the provisions of this Act, continue to be in force
in respect of the colleges and linstitutions referred to in the said sub-section ( I ) , until they
are replaced by statutes, ordinances and regulations made under this Act.
(4) Notwithstanding mything contained in this Act, the statutes, ordinances and
regulations continued in force under sub-section (3)or made under this Act, every person
who immediately before the notified date was a student of a college within the University
areas affiliated to, or approved by, the Madurai-Kamaraj University was eligible to
appear for any of the examinations of the Madurai~KamarajUniversity shall be permitted
to complete hi. course of study in the Alagappa University and the Alagappa University
shall make arrangements for the instruction, teaching and training for such students fbr
such period and in such manner as may be determined by the Alagappa University; in
accordance with the course of study in the Madurai-Kamaraj University and such:&dent
shall during such period be admitted to the examinations held or conducted by the
Madurai-Kamaraj University and the correspopdi.n~fegree, diploma or other academic
distinctions of the ~ a d b r a i - ~ a r h a rUniversity

(5) All colleges within the University area which immediately before the notified
date,-
(a) continue to bc affiliated to, or approved by or recognized by, the Madurai-
-- Kamaraj University; and
(b) provide courses of study for admission to the examination for degrees and
diplomas of the Madurai-Kamaraj University,
shall be deemed to be colleges affiliated to, or approved by the Alagappa University
under this Act and the provisions of this Act shall, as far as may be, apply accordingly.
(6) Subject to the provisions of sub-section (2) but without prejudice to the
provisions of sub-sections (3) to (S), anything done or any action taken before the notified
date under any provisions of the University Act in respect of any area to which the
provisions of this Act apply shall be deemed to h a v ~been done or taken under the

and until superseded by anything done or any action taken under the corresponding a

52-B.Transfer of certain colleges to Universir)..- ( 1) Notwithstanding a~ything
contained k the Madurai-ICamaraj University Act, 1965 (Tamil Nadu Act 33 of 1965) of
the statutes, regulations, ordinances and orders made thereunder, on and from the notified
date, the colleges specified in the Schedule I1 shall be transferred to and maintained by
the Ahgappa University as the constituent colleges of that University.
- (2) On and fiom the notified date, the control and management of the constituent
colleges specified in sub-section (1) and all properties, assets and liabilities of the
Government in relation thereto shall stand transferred to, and vest in, the Alagappa
I University.
52-C. Transfer of certain employees.-( 1) Every person. who immediatelybefore
the notified date, is serving in the colleges specified in the Schedule 11 shall, as from the
said date, become an employee of the University and shall cease to be an employee of the
Government.
(2) (a) As soon as may be, after the notified date, the Government may, after
consulting the Vice-Chancellors of the Alagappa University and the Madurai-Kamaraj
University direct, by general or special order, that such of the employees of the Madurai-
Kamaraj University as are specified in such order shall stand allotted to serve in
c o ~ e c t i o nwith the affairs of the Alagappa University with effect on and from such date
as may be specified in such order:

Provided that no such order shall be issued in respect of any such en~ployee
consent for such allohlent.
(b) With effect on and from the date spccified in the ordcr under clause (a;,
the persons specified in such order shall become employees of'the Alagappa Uni\lersity
and shall cease to be employees of the Madurai-Kamaraj University.
(3) Every person rcferred to in sub-sections ( I ) and (2) shall nold offace under the
Alagappa University for the sarne tenure at the same remuneration and upon the same
rights and privileges 2s to pension or gratuity, if any, and other matters as he would have
heldthe same on the notified date or the date specified in the order under clause (a) of sub-
section (2). as the case m y be, as ifthe Tamil Nadu Universities Laws (Amendment)Act.
2002 had not been passed.
(4) The liability to pay pension and gratuity to the persons referred to in sub-
sections ( I ) and (2) shall be the liability of the Alagappa University.

subsection (2) of that section as on the date specifid in the order under clause (a) of the
said sub-section (2) shall be transferred to lhe Ahgappa University and the liability in
respect of the said Provident Fund Amamts shall be the liability of the Alagappa
University-
(2) There shall be paid To the Alagappa University out of the accumulations in the
s u p c r a ~ u a t i o nb d and other like b d s ?if any, of the Madurai-Kamaraj University or,
of the Govenunenf such amounts as baw been Mtdited to the superannuation fund or
other like h d s , if any. on behalf of the persom irferred to in sub-sections (1) and (2) of
section 52-C. The amounts so paid shall form part of the superannuation fund or other
like hnds, if any, that may be established by the Alagappa University for the benefit of
its employees.

52-E. Poynrent of certain moneys to the AIcrgoppn University.- (1) The Madurai- a
Kiunaraj University shall out of its funds as on the notified date, pay to the Alagappa
University such amount as the G o v e m n t may, in consultation with the Madurai-

of the Tamil Nadu Universities Laws (Amtadmcnt) Act, 2002, every person ordinarily
resident within h e University area, who-
( i )bas been for ar least three ye= a @ate of any University in the territory
of India; or
(ii) is a registered graduate of any University in the territory of India, shall
be entitled to have his name entered in the register ofgraduates maintained under this Act
for a pericd of five years on payment of such fct md subject to such conditions as may
be prescribed by the statutes.
(2) All applications for registration uader sub-section (1) shall be sent to the
Registrar together with the prescribed fce a d sarh proof of qualifications as may be
prescribed by the statutes.
(3) The Registrar shall, on receipt of an application made under sub-section (2)
and after making such enquiry as he deems fit, enter in the register of graduates the name
of the applicant.
(4) Every persou whose name has been entered in the register of graduates under
sub-section (3) shall be entitled to have such entry renewed every five years on
application made in that behalf to the Regis- w i t h such time, in such manner and on
- paynxnt of such fee as may be prescribed by the shtutes.
58-9. Report on colleges--The Syml@Uc shall. at the end of every three years
from the date of commencement of the Tamil Nadu Un~versitiesLaws (Amendment) Act,
2002. submit a report to the Government on the condition of constituent, affiliated and
approved colleges within the Universiw area. The Government shall take such action on
it as they deem fit.-.

5. In section 31 of the 2002 Act, in Chapter X-A proposed to be inspted in the
Alagappa University Act, 1985,-
( 1 ) in section 52-B, for sub-section (2). the following sub-section shall be .

the persons referred to in sub-section (2) of section 52-C" shall be substituted;
(b) in sub-section (2),--
( i ) for the expression "Madurai-Kamaraj University or, of the
Government", the expression "Madurai-Kamaraj University" shall be substituted;
(ii) for the expression "sub-sections (1) and (2) of section 52-C",
