07.31 Nature: Special Project
Details: Went to the Supreme Court, coming from San Pedro, Laguna to retrieve a
Final Entry of Judgment for GR # 155936, People v Ronald Mercado y
Gonzales for the crime of rape. The purpose of which was so the accused
may apply for Parole since he has been detained since 2003.
(I was not able to retrieve a copy because I was required to have an 8

authorization letter and I initially thought that I didnt need one because
such was a public record anyway. I also went to the Court of Appeals to get
the Entry of Judgement on the same case hoping that I could retrieve the
file sans an authorization letter. I also passed by Arellano to retrieve my
endorsement letter for the apprenticeship program which, unfortunately,
wasnt ready yet).
08.01 Nature: Paper Output/ Special Project

Details: Wrote a simple authorization letter addressed to Sablayan Prison and Penal
Farm in Occidental Mindoro where Ronald Mercado y Gonzales is detained. 4
I went to LBC and engaged their services to expedite the sending of the
authorization letter that Mr. Mercado needs to sign.

- Initial Presentation of Defense Witness
HIGHLIGHT: The most significant process that I witnessed was the Direct
Examination of a psychiatrist to prove moral damages because apparently,
the non-support of the husband caused anguish and despair to the wife.
The Defense was not able to Cross because he needed to research further
on the medical terms that the psychiatrist mentioned. In my opinion, the
Defense did not need further research to know what bipolar or
schizophrenia means. I would have presented the fact that the wifes
anguish and depression was not caused by the husbands non-support, but
because of the fact that she was bipolar, as what the psychiatrist attested
to; it was the wifes default demeanor. The moral damages wouldve
been removed.

HIGHLIGHT: Here, I witnessed the Cross-Examination of a witness who made

very inconsistent statements. She claimed, malayo po ang bahay nila sa
amin, but eventually, she declared that it was merely a 2 minute walk from
her house.

HIGHLIGHT: I witnessed a Promulgation of Judgment where the accused

was held guilty for Reckless Imprudence resulting in Serious Physical
Injuries and Damage to Property. The accused was in his early 20s, and saw
the accuseds parents weep because of the unfavorable decision. Damages
were set as P145,000 actual damages, P47,000 loss of income, and P50,000
moral damages.

HIGHLIGHT: I was able to observe how the reading of a Probation Order

was conducted. The accused was informed that if he does not comply with
the conditions of the order, he will be issued a warrant of arrest. I found it
amusing that aside from the expected conditions like regularly reporting to
his probation officer, not committing any crimes, some conditions included
making sure to take care of his family, and planting a tree.

HIGHLIGHT: The morning hearings were predominantly about Pre-Trial

Conferences where the counsels merely marked their exhibits and made
stipulations. I was able to confirm what I already learned that the evidence
of the Prosecution is marked with letters (like Exhibit A, A-1), and the
evidence of the Defense is marked with numbers (like Exhibit 1, 1-A).

HIGHLIGHT: The Honorable Sonia T. Yu-Casano, in the exercise of her

duties, attempted to make the opposing parties to reach a compromise
instead of proceeding with the case. She explained, with a genuine effort
to reconcile them, that pursuing the case would only cause more anguish
and their relations might even turn more sour. The case in dispute was a
meagre 102 sqm. Lot shared by FOUR (4) families. The Honorable Judge
asked the counsels to propose a compromise.
