Pursuant to Berkeley Municipal Code ("BMC") 6.46.050, the City is unable to issue a permit for your proposed event for the following reasons: © Your application is incomplete, missing critical information required by BMC 6.46.030. For example, it does not provide photo identification of the applicants; it does not provide information related to the location in the park that you wish to use; a description of arrangements for first aid or emergency medical services, ete. Pursuant to BMC 6.46.030, your application is late. Applications for major park events shall be made at least ten (10) business days prior to the major park event. Your application was received seven (7) business days prior to your proposed event. © Pursuant to BMC 6.46.050, your application lacks any explanation of security arrangements. . ‘= Pursuant to BMC 6.46.090, while you signed the required Hold Harmless Agreement you hand-wrote additional language indicating that you disagree with its provisions. Pursuant to BMC 13.40.100, applicants wishing to use sound outdoors for an event must obtain a permit no less than thirty (30) days from the date of the event. Failure to do so is grounds for an automatic denial. You attached an application for an amplified sound permit that not only is late, but also incomplete as it fails to identify required information such as operator information, site plans, etc. In addition to these concems, the City is aware of several demonstrations and rallies on August 27, 2017 in light of national events, as well as calls to action on social media dating back to June 2017. The City has been in the process of actively planning and directing appropriate resources in an effort to protect the health and safety of its residents, businesses, and visitors, and to protect public and private property. Given the totality of circumstances, we cannot issue a permit to you for the use of Civic Center Park on August 27, 2017. The City is committed to upholding First Amendment rights of free speech and assembly while taking measures to ensure that any rallies or demonstrations remain peaceful. If you are interested in pursuing an alternate date for your event, please contact Shallon Allen at 510-981-7071 to discuss. Alternative dates ‘may be considered if a complete application that addresses the deficiencies is timely received.
