Chapter 8 Environmental and Social Management Plan

This Environmental and Social Management Plan (ESMP) for the planning and operation of the
proposed Myanmar-Korea Friendship Bridge (Dala) Construction in Yangon, Myanmar aims to
provide an environmental and social management framework by outlining the compliance
requirements, mitigation measures and monitoring programmes to be implemented.
The ESMP covers the implementation of Environmental Management, Social Management and
Stakeholder Engagement on the pre-/construction/operation and de-commissioning phase. It is the
means by which the findings of the environmental assessment are implemented during the execution
of the bridge construction activities. The scope of the ESMP covers all of the activities as described in
Chapter 6 of this ESIA Report, with the objective of demonstrating compliance with the relevant
national and international legislation such as EDCF Safeguard Policy, IFC, WHO and other
environmental and social management systems. The ESMP lists the obligations and responsibilities of
each party involved in the project; stipulates methods and procedures that will be followed; as well as
outlining the environmental and social management actions that will be implemented.
This ESMP has been prepared based on the findings of the ESIA Report (particularly Chapter 6) and
describes mitigation and management measures designed to mitigate potential environmental and
social impacts of the proposed project activities. Mitigation strategies have been developed to avoid,
prevent or reduce any potential adverse impacts on the identified sensitive receptors.
The overarching purpose of this ESMP is to:
Integrate management and mitigation measures into the project activities in order to reduce or
mitigate predicted significant environmental and social impacts on natural and socio-economic
environments;
Consider and address the concerns and interests of stakeholders who will potentially be engaged
or impacted during execution of the project activities; and
Establish systems and processes for delivery and implementation of environmental and social
requirements in order to meet statutory and compliance standards.

The objectives of the ESMP are to:


Demonstrate continuing compliance with the relevant Myanmar environmental legislation,
EDCF Safeguard Policy and good international bridge construction practices;
Describe the mechanism for implementing identified control, monitoring and management
measures to mitigate potentially adverse impacts;
Provide a framework for mitigating impacts that may be unforeseen or unidentified until bridge
construction activities are underway;
Provide assurance to regulators and stakeholders that their requirements with respect to
Environmental and Social performance will be met;
Undertake monitoring to provide assurance that the control and management measures are being
implemented; and
Combine all of the above in a systematic framework of monitoring, reporting and management
that will measure the successful implementation of the project.

8.1 Project Description by Project phase


The project activities and processes related to the construction activities will include the following by
Project Phase:

8.1.1 Pre-construction
Relocation of existing facilities and resettlements & compensation and livelihood assistance
(Kamar Kasit Quarter in Dala Township) as necessary.
Construction/setting up of temporary site offices, site facilities such as workshops, equipment
storage, and site accommodation. That set up will include sanity facilities with sewege treatment
facility of sufficient capacity.
Mobilization of equipment, labor and materials to site. This includes the sourcing of suitable base
materials such as gravels for the road base.
Surveying and setting out of the proposed alignments and facilities.
Construction of any temporary access or ramps, to ensure undisturbed service of the pontoon
during construction
Vegetation clearance
Public disclosure and stakeholder consultations

8.1.2 Construction
Earthworks and surfacing of the approach roads.
Transportation of construction materials (both raw and finished materials) and machinery to site.
Construction of the bridge foundation into the riverbed.
Construction of bridge support and bridge deck.
Construction of the water pipeline on the bridge.
Construction / building work of border facilities on both sides.
Road signage & safeguard fences and signposts.
Landscaping and rehabilitation of degraded sites including borrow pits and detours.
Re-vegetation.

8.2 Policies and Commitments, Legal requirements and Institutional Arrangements


In order to effectively implement of the ESMP, it will be necessary to define the responsibility of
various stakeholders. The environmental management activities should be in compliance with existing
environmental policy, laws, rules, procedures and emission standards of the Republic of the Union of
Myanmar. The policy and legislation framework is disscused in more details in Chapter 3 of this
ESIA report.
The methodology followed for preparing the ESMP is presented in Fogure 8.1 and consists of the
following steps:

Derive mitigation/protection measures for identified impacts for each of the Project activity and
environmental component,
Recommend mitigation, compensation and enhancement measures for each identified impacts
and risks,
Develop a mechanism for monitoring the proposed mitigation measures,
Estimating budget requirements for implementing mitigation and monitoring measures, and
Identify responsibilities of various agencies and stakeholders involved in the Project for
implementation and monitoring of mitigation measures.

8.4 Grievance Redress Mechanism
The Grievance Redress Mechanism is to be established to provide a platform to address any community
concerns that may arise even after all efforts to mitigate any potential impacts have been made. It aims to
address all complaints and grievances lodged by the local (incuding the community hosting the project)
stakeholders in a systematic transparent and accountable manner so that solutions are found and taken
into action in a timely and principled manner to meet the satisfication of the grievance lodgers and
complainants.
The framework for grievance redress mechanism for the projects has been established to address the
complaints and concerns that must be raised by PAPs about project activities or performance during the
construction, operation and decommissioning period. That shall act as a tool for execution within a set
timeframe, purpose and detail out a systematic process against several documents. The site specific
procedure shall be developed for receiving complaints, logging in the Grievance Redress System (GRS)
log book for recording and registering the entire process of purpose, investigation, analysis and
responding to the complainants and grievance lodgers.
Following are the key components of the GRM framework for this project:
Site Grievance Redress Team(SGRT): Site based grievance redress team shall be established and
headed by DOB Contruction Director (Community Liaison Officer- CLO) of contractor
representative and authorities concerns in local and township level. SGRT will review any complaint
and concerns and find a solution to ease the degree of complaints which will be agreed and accepted
by the PAP. SGRT shall address the issue within (7) days.
At this stage, many issues shall be resolved as locally as possible. If the case is not addressed to the
satisfaction of PAP within the given time frame, SGRT shall proceed to submit the issue to
Grievance Focal Person (GFP) for further review.
Grievance Focal Person (GFP): Grievance focal person(s) shall be appointed by project
Management Unit of Department of Bridge (DOB) of MOC to implement the GRS procedure
effectively. The nominated person(s) for the role should have sound and broad experiences in GRM
management previously. The roles shall function as the primary resources for interface on issues
relevant to PAPs. He/She will receive the complaints in verbal, with letter or email or phone call
from the PAPs and other local stakeholders through site construction team (including SGRT) or
community heads or directly from the complaints themselves. The complaint received shall be
recorded and registered accordingly and deliver the message to Site Grievance Redress Team within
14 days for issues of medium level of significance, and within 30 days for issues that draw
immediate attentions (such as safety incidents etc.).

The Grievance Redress Mechanism needs to be institutionalized as early as possible and be operative
during the entire cycle of the project implementation, from pre-construction, construction to
operation and de-commissioning stages. A draft of the GRM Procedure for the proposed project is
illustrated in Figure 8.4.1

Stage 1 of GRM When a concern is lodged to the Contractor during construction, if the issue raised
can be addressed directly by the Contractor through SGRT, the Contractor shall address the issue on the
spot and report to the complainant about the solution that was made.
Stage 2 of GRM If the addressed solution is not safisfactory to the Complainant or if the concern
raised is not suitable to be addressed by the Contractor themselves, the Contractor shall report the raised
grievance and concerns to the GFC within 7 working days. Once received the GFC check the eligibility
of the Complainant, identify the solution and clearly reply it back to the Contractor within 5 working
days. In turn, the Contractor during constraction and the Operator during operation will implement the
agreed upon redress solution and report the outcome to the GRC at least within 7 workig days.
Stage 3 of GRM If the addressed soluation is still not satisfactory to the Complainant of if the
concern raised is of such a nature that the higest level of GMC needs to be engaged, SGRT shall refer
the case to GMC within 7 working days since it received the case. Once received the SGRT check the
eligibility of the Complainant, identify the solution and clearly reply it back to the Contractor within 14
working days. In turn, MOC shall implement the agreed upon redress solution and the report the
outcome to the GMC within 30 working days. Again, the case needs to be documented in the GRS
logbook, as follow-up actions of the same case as lodged at Stage 1 and 2 (with the same case reference
No.)

The GRC shall accept complaints/grievances free of charge. Costs related to GRM operation shall be
borne by the Project implementing body (MOC). This shoud be clearly informed to the PAPs all through
the stages. GRM will be operational thorough the entire project cycle of prior to, during construction and
operation and until decommissioning.
In case the Compainant still does not accept the agreed upon solution, he/she can file a case against the
local and national justice system.

8.5 Environmental and Social Management Organization


MOC will be committed to provide resources essencial to the implementation and control of the EMP.
Resourses include the appropriate human resourses and specialized skills. The following entities are
responsible for implementation of the EMP:

Environmental Conservation Department (Yangon Region)
Third-party Environmental Consultant Firm
The proponent; MOC is responsible for ensuring that the performances of the project activities are in
accordance with the Environmental Management Plan developed and in an environmentally sound
manner. The following Health, Safety and Environmental team will be responsible for the implementation
of the Environmental Management Plan:
The team is consisted of the following personnel:
HSE Coordinator (Admin and HR personnel) will be acting as in-charge of HSE team.
There will be 2 HSE assistants under the supervision of HSE Coordinator according to the Environmental
Impact Assessment Procedure (2015), clause 103, it is stated that: The Project Proponent shall fully
implement the EMP, all Project commitments and conditions, and is liable to ensure that all contractors
and sub-contractors of the Project comply fully with all applicable Laws, the Rules, this procedure, the
EMP, Project commitments and conditions when providing services to the Project.
HSE Coordinator: HSE Coordinator is responsible and accountable for ensuring:
Observe HSE regulations, wears all required safety equipment, encourages safe working
practices, corrects obvious hazards immediately or reports them to the Project Manager.
Development of HSE culture among all workers, during construction, operation and decommissioning
phases.
Regular site visit and reporting during construction, operation and decommissioning works to
check whether the objectives of EMP are being followed.
Manage safety and health in all project activities.
Keep full records of environmental management activities and present to annual independent
third party environment audit.
Assess the risk in performing various steps of all production processes such as drilling, blasting,
crushing and trucking with appropriate safety measures;

Undertaking regular safety and health inspections and audits onsite. Undertaking regular safety

Ensure equipment to be regularly checked and properly maintained;and
Provide necessary information and instructions, as well as providing and arranging training to
the workers and supervising them to follow safety rules and safe working procedures strictly.
HSE Assistants: The HSE Assistants are responsible for assisting HSE Coordinator during the
implementation of the HSE plan;
Development and training according to the HSE plan.
Liaise with local authorities where required, to ensure safety and health issues are resolved in a
timely manner, to the benefit of the project.
Review relevant subcontractor workplace health and safety documents, including procedures,
work methods statements, etc.
Resolve disputes which may impact the health and safety of project personnel, plant and
equipment onsite.
Regional Environmental Conservation Department (Yangon)
ECD (Yangon Region) is responsible for the general supervision and coordinating over all
matters relating to the environment and also for providing guidance for existing regulatory
frameworks.
Third-Party Consultant Firm
The Third-Party Consultant Firm is to ensure that the EMP developed is up-to-date and is being
followed up properly by MOC. Periodic audits shall be performed in order to find out whether
the expected outcomes are achieved as envisaged in the plan by comparing with the operating
standards. If not, corrective actions have to be followed.

8.6 Monitoring, Reporting and Training


The Monitoring will be required in order to demonstrate compliance with both regulatory and project
requirements (Compliance monitoring), and also provide verification of the effectiveness of the
implemented control measures. Complience will be monitored to ensure that contructors and
subconstructors meet contractual obligations with respect to work paractise and design specifications (e.g
Project emission standard).

8.6.1 Contractor Management


DOB will work with and coordinate the contractors to ensure that all contractors are aware of and
competent with respect to:
Environmental and social impacts that could potentially arise from their activities.
Necessity of conforming to the requirements of the ESIA and EMP (i.e. implementing the
control and mitigation measures) in order to avoid or reduce those impacts.

Roles and responsibilities to achieve that conformity, including change management and emergency
response.
Documentation and reporting requirements and other EMP compliance requirements.

8.6.2 Inspection
DOB will ensure environmental monitoring and inspections/audits are undertaken as per the requirements
of this EMP.

8.6.3 Management of Change


A risk assessment will be undertaken for all proposed changes in scope (e.g. timing, location or
operational details) described in this EMP to assess the significance of any potential new environmental
impacts or risk not previously assessed. If the change to risk is determined to be a significant
modification, a revision of the EMP will be conducted and submitted to MONREC and other relevant
authorities.

8.6.4 Reporting Requirements


DOB will submit Environmental and Social Monitoring Reports on the implementation of the EMP to
MONREC as shown in Table 8.3.1. DOB shall submit an Incident Report to MOC and MONREC within
24 hours of any incident with serious impact), or within seven days for any other incident of lesser
impact).
Per EDCF Safeguard Policy, the Project Proponent will submit Environmental and Social Monitoring
Report of the Project to the Export-Import Bank of Korea on an annual basis (at least). In case unexpected
negative impacts of significance ocurrs, the Project Proponent shall submit related monitoring report on
an ad hoc basis upon the request of the Bank.

8.7 Risk Management

8.7.1 Emergency Plan


DOB, through the construction contractors HSE Plan, will develop plans and procedures to identify the
potential for and response to environmental accidents and health and safety emergency situations and for
preventing and mitigating any potentially adverse environmental and social impacts that may arise.
The Emergency Response Plans (ERP) will be in place, which detail the actions and resources available
in the event of various emergency scenarios. The ERPs contain information on reportable incidents,
incident notification, contact information and activation of the Contractors emergency centre.
In the event of an emergency of any type, the DOB Person in Charge (PIC) will assume overall onsite command
and act as the Emergency Response Coordinator (ERC). Emergency response support can be provided by the
Contractors emergency centre. The working camp has equipments for responding to emergencies including but
not limited to medical equipment, fire-fighting equipment and oil spill control equipment.

Emergency preparedness and response will be continually reviewed by the construction contractor and
DOB representative during the construction and after the occurrence of any accidents or emergency
situations to ensure that lessons learnt are informed for continuous improvement. Emergency exercises
will be undertaken on a regular basis to confirm adequacy of response strategies and investigations of
accidents or incidents will follow formal documented procedures.

8.7.2 Oil Pollution Emergency Plan (OPEP)


In the event of unplanned oil spill to the Yangon River the activity Oil Pollution Emergency Plan (OPEP)
will be implemented to initiate a response. An OPEP is an activity or facility specific document which
details the operational tasks required to mobilise a first strike response. An OPEP for each of the project
activities will be developed prior to the commencement of the activity. The OPEP applies to the first 24
hours of a response until a full Incident Action Plan (IAP) specific to the event is developed. OPEPs are
intended to be the first document used in a spill to provide guidance to the Incident Controller (IC) and
the rest of the Incident Management Team (IMT).
The OPEP contains details and forms for use in immediate response, including oil spill trajectory
modelling activation forms, and immediate notifications required in the event of a spill.

8.7.3 Medical Emergency Response Plan (MERP)


In the event of a medical emergency on site the Medical Emergency Response Plan (MERP) will be used
to respond to the situation. The MERP covers all likely medical conditions and injuries that may present
during the campaign and has been developed to outline the responsibilities and actions to be taken to
medically evacuate a person to definitive care. End to end care of all casualties will be provided. It will
primarily be conducted using a medically equipped clinic on site with Specialist medical personnel

8.7.4 Natural and Non-natural Disasters Emergency Response Plan


Both DOB and the construction contractor will have comprehensive natural disasters; heavy
weather/cyclone/flood/earthquake and non-natural disasters: power failaure, Hazardous Materials
Incidents, Propane Spill or Leak, Heat Related Injuries, burn and poison preparedness processes in place
for the site area such as a comprehensive site specific disaster plan. Protecting businesses from natural
disasters can involve a variety of actions from proper inspection and maintenance to minimum Code
requirements to installing extra protective devices such as Building Survival Kit, First Aid Kit, Personal
Workplace Disaster Kit, Equipment for External Air Exclusion, Emergency Water Storage & Purification,
Wind Safe Room, Shelter Room, Shelter Room Selection and Emergency Contact List.

8.8 Capacity Development and Training


The Project will require that contractors have implemented training programmes for their personnel and
each contractor is responsible for HSE awareness training for personnel working on the Project. The
contractors are also responsible for identification of any additional training requirements to maintain

required competency levels. Employee training, provided by the contractor, will include awareness and
competency with respect to:
Environmental and social impacts that could potentially arise from their activities.
Necessity of conforming to the requirements of the EIA and EMP, in order to avoid or reduce those
impacts.
Roles and responsibilities to achieve that conformity, including with regard to change
management and emergency response.
The Project Director is responsible for coordinating training, maintaining employee-training records, and
ensuring that these are monitored and reviewed on a regular basis. DOB will be responsible for the
management of contractors to ensure that training needs are met for personnel whose work may have any
potential environmental and social impacts.
