AFFIDAVIT

I, MARINA ACOSTA CASTILLO, of legal age, married, Filipino citizen

and a resident of Barangay Roxas, Solano, Nueva Vizcaya, after having been
sworn to an oath in accordance with law, hereby depose and state:

1. That I know personally the respondent PO3 ANGELITO RASPADO

ACOSTA in Administrative Case No. RIASE-MP-DOE-16-0002 RIAS2-
MP-ADM-16-0002 as a matter of fact he is the son of my late brother
Wilfredo P. Acosta;

2. That I have been taking care of him since his father died in the year 1988;

3. That my house is located adjacent to the house where PO3 Angelito

Raspado Acosta lives;

4. That I have a very good relationship with my nephew when since he was
already assigned in our province;

5. That I have learned that my nephew, PO3 Angelito Raspado Acosta was
charged of grave misconduct for an alleged event that has transpired on
September 27, 2015 in a charged sheet stating to wit: On September 27,
2015 at about 9:00 in the evening in the Municipality of Solano, Nueva Vizcaya
and within the jurisdiction of this service, respondent PO3 Angelito Raspado
Acosta PNP member of Dupax del Norte Police Station, without any justifiable
reason, did there and then willfully, unlawfully and feloniously fired his issued
short firearm Cal 9mm Pieto Beretta with serial number M25489Z which
caused damages on the washing machine, broken glass window and a bullet hole
particularly in the ceiling of the receiving room of Mrs. Marina Castillo, said
act is a gross violation of the existing rules of the PNP organization;

6. That I was at home on the night of September 27, 2015 but contrary to
what is stated in the charge sheet, although my nephew was at our
vicinity at that time I cannot recall that he has fired his service firearm
contrary to what is stated in the charge sheet;

7. That on September 28, 2015 at around 9 oclock in the morning I was

surprised when several persons in the name of Police Officers Doroteo
Umaguing, Elmer Labasa, and Christian Allen Lloyd Arcia came over to
our house and said police officers ask me about what has transpired on
the night of September 27, 2015;
 8. That I told the police officers that I did not observe any untoward
incident on the night of September 27, 2015 and that I have no
misunderstandings with my nephew;

9. That I informed the said Police Officers who went to my house that we
have arguments with my nephew in our house many years ago when
my nephew was not yet a police officer and still staying in my house
which caused the damages and was not due to bullets allegedly fired
from his service firearm;

10. That I have not authorized the said police officers to enter the premises
of PO3 Angelito Acostas house neither did they ask permission to enter
the said premises;

11. That Police Officer Doroteo Umaguing keeps on going back to our house
and convincing to file a complaint against my nephew despite the fact
that I have already told him that we are in good terms;

12. That I attest to the veracity of the foregoing statements.
