AFFIDAVIT OF DESISTANCE
I, DOMINGA SANTINO, of legal age, married, Filipino, with postal address at
Barangay Sta. Asuncion, Concepcion, Tarlac, after having been duly sworn to according to law
hereby depose and state:

1. That I am the private complainant in a case for THEFT filed against GELO
MARCOS, pending before the REGIONAL TRIAL COURT, Branch 68,
Capas, Tarlac, Docketed as Criminal Case No. 1102;

2. That after a careful evaluation and reflection of the facts and circumstances
surrounding the incident, I decided not to pursue the case as controversy was
brought about by misapprehension of facts. Furthermore, my motorcycle was
returned to me on the same night of March 09, 2017, when I mistakenly
thought it was stolen;

3. That the accused had apologized and asked for forgiveness in using my
motorcycle without first securing my permission, and I have accepted and have
forgiven him. Moreover, the accused learned his lesson already as he is
incarcerated for more than a year already, and is still detained in prison up to the
present;

4. That I have caused the due execution of this affidavit to attest to the truth of the
foregoing statements, for the purpose of withdrawing my complaint against
Gelo Marcos, and for whatever legal purpose it may serve.
