SYNOPSIS

HYPOTHESIS

At the crucial time of globalization where communication takes over pivotal roles in every
sector of the world, there are increase in the security concerns of the nation as well. And
therefore it is imperative to find a balance between the necessary role pf communication and
the security scenario of the country which directly or indirectly infringes certain fundamental
and statutory rights rights entrusted to the individuals by the constitution of the country.

RESEARCH QUESTIONS

1. Whether there is a requirement for comprehensive legal framework dealing with


various issues which are arising out of implementation of the central monitoring
system?

2. Whether CMS will violate fundamental rights of the individuals?

3. What is central monitoring system?

CHAPTERISATION

The Paper begins with an introduction to the issues of central monitoring system.

Section-1 introduces the idea of central monitoring system.

Section-2 looks at the impact that central monitoring system has on security situation of the
country as well as the impact on individuals.

Section-3 brings out the developments that are taking place in the rest of the world on similar
lines of CMS.

Section-4 deals with the kinds of problems that are being faced in India today as a result of
draconian laws in lines of CMS.

Section-5 brings out the issues for consultation which essentially are:-

Need for a comprehensive legal framework.


Rights related issues.
Issues on which suggestions have been made by ad hoc Committees.
SCOPE AND LIMITATION

The limitation of the project is that there was no scope for primary research work and so all
that is discussed in this project is from secondary sources and all the conclusions so reached
are also based upon the same. This project is analytical in its approach.

METHODOLOGY

The purpose of this study is to analyze the issues relating to central monitoring system and
issues relating to security concerns and rights related issues dealing with it.

A non-empirical research method was followed to gain in-depth knowledge on the subject.
Data was compiled from online database and textbooks.

OBJECTIVES

The main objective of the project is to look into the various aspects of issues in relating to
policies and legal frameworks in relations to similar laws in relation to CMS and the rights
related issues arising from the same.
