TERMS AND CONDITION

PERIOD OF CONTACT- July 2017 to June 2018


SCOPE OF WORK-
I. All the consignment shall be transported by the transporter as per
instruction of Authorized person of the company.
II. The body of each truck provided by the transporter to the company must
be clean and dust free. The said truck would have sufficient tarpaulins for
covering the goods bottom and top properly.
III. Consignment should be delivered at the company said destination. Damage
or shortage of goods after given to the transporter, transporter needs to
pay the amount.
IV. The transporter shall invariably state in their challan the weight and
condition of the goods when handed over to them for onward delivery
positively.
V. The transporter shall also keep the company indemnified against all acts of
omission or negligence, dishonesty, theft or misconduct of his servants or
agents or any of these engaged by you for this prupose.
VI. Transport of goods without delay.
VII. In the event of failure on the part of the transporter, the company reserve
right to engage any other transporter and the extra expenditure incurred
by the company shall be recovered from the transporter without prejudice.
VIII. the company at its discretion can choose more than one transporter

Share of the business will be decided by HIL based on the transporter


performance on the following parameter.
1. Timely delivery
2. No. of customer complaints
3. Timely submission of proof of delivery.
EARNEST MONEY SECURITY DEPOSIT-
I. TECHNO COMMERCIAL bid must be submitted with DD of rs 50,000 in favour of
HIL, udyogamandal
II. Successful bidder has to deposit rs 200,000 for security deposit.(by DD)
III. Bidder earnest money shall be treated as SECURITY DEPOSIT.
IV. No interest should be paid on the security deposit.

V. The Earnest money of the unsuccessful bidder shall be refunded within a month
of finalization of tender.
VI. Security deposit of the bidder will be refunded in 3 month by the completion of
the contract.
VII. The transporter will have to inform the 10 number of trucks with copy of the
valid registration of the vehicle issued by RTO should be in the name of
transporter and affidavit from owners of other trucks stating that the trucks
owned by him will be made available to the said transporter as and when
required.

VIII. HIL may decide the capacity of the transporter for award of work.

TRANSIT PERIOD- 300 km/day


PENALTY- The transit period specified in clause 18 above shall be deemed to be the
essence of the contract. The said period shall be legibly written on the LR/GC both in
words and numbers. If the transporter fails to deliver the consignment within the time
limit, specified, HIL shall have the right to levy a penalty as follows for delayed delivery:-

1. For the delay upto 50% of the transit period or part thereof
o 2% of the freight per truck per day of delay.
2. For the delay of beyond 50% of the transit period of part thereof
i. 2% of the freight per truck per day of delay upto 50% of the transit period plus
10% of the freight per truck per day on the delay beyond 50% of the transit
period

Full Truck should be placed within 48 hours of clear notice/instruction either in


writing or on phone. Otherwise, total penalty of Rs.500/_ (Rupees Five Hundred)
only will be charged per load per each day of delay.
The transporter shall submit their bills at HIL,Udyogamandal, in duplicate along with
supporting documents,
Company will take 45 days time for verification and processing of the bills and pay the
eligible amount after deduction of any amount due to the company.

Octroi charges, if any shall be reimbursed by the company to the transporter against
production of receipt/evidence.

GENERAL CONDITION-

The company reserves the right to divide the work of transportation. The company
reserves the right to terminate the contract period without assigning any reasons. The
agreement may be terminated by either side by giving 60 days prior notice insisting .

All consignments shall be insured by the company but the transporter shall not be
absolved of the responsibility as a carrier and they shall be held responsible for any damage
or loss occurring in transit or while the goods are in their custody due to their negligence.

IN CASE OF ACCIDENT OR BREAKDOWN IN TRANSIT,THE TRANSPORTER SHOULD DO THE


FOLLOWING
a. Inform the designated person of the company

b. Would furnish the proof of occurrence of the accident or break down in every
case by way of a copy of police Panchnama, requisite photographs and other
documents.

c. In case of accident or breakdown the transporter should assure that the goods
reach the destination at their cost

d. Insurance of driver and other employees is the responsibility of the transporter

e. For the consignments booked during the tenure of the contract , the company
will not responsible for any penalty /detention /demurrage, warfare, if
demanded by the transporter , in any circumstance
f. The vehicle used by the transportation company should have necessary
permission of the various authority such as road transport etc/
g. In case the transporter lift the material beyond the restricted load limit as per
New Motor vehicle Act and if materials are confiscated by the government
authorities at enrooted , the entire responsibility will be on transporter and the
entire loss will be recovered from them.

h. Transporter shall have to make their own arrangements for requisite laborers for
handling of all consignments. All consignments will be delivered to the
companys destination at door delivery of the godown.
i. Validity offer will be 90 days from the days of opening.

ARBITRATION- All disputes and differences arising between the parties in respect of the
W.O. or breach thereof will be decided by arbitrator will be appointed and the case will
be settled as per prevailing guidelines of Indian council of Arbitration applicable for
PSUs. The decision of the arbitrator in all questions will be final and be binding to all
parties. The law applicable will be the Law of India and subject to the jurisdiction of the
Court of Law in particular State of Regional Office on account of this order.
FORCE MAJEUR- In case of any natural calamity, riots, it will not be the fault of the
company or the transporter. If the force majeure situation extends beyond 30 days the
contractor shall be entitled for time extension to complete the work but shall not be
entitled in any financial compensation such as idle wages or escalation cost. Decision by
the designated officer will be final in respect of any extension of time.
PLACEMEMENT OF TRUCKS- within 48 hours

I. Within the time limit if transporter fails to provide tuck, HIL can be arranged truck
from open market and extra amount debited to respective transporter
II. ODC (Open Delivery Certificate) should be issued by the transporter within 5 days.
III.. In case of any leakage / damage of material delivered, if its value is less than Rs. 500/-
(Rs. Five Hundred Only), ODC shall not be entertained the amount will be debited to
the transporter.
