January 30 - April 30, 1990. Request appropriate stipend
and to remain at Queen of Heaven for two more years.

Regarding Rev. J. Sabine Griego
Although ~e accusations against Rev. J. Sabine Griego occurred prior to April 30, 2001, and prescription
is present in all of the allegations, Rev. Griego merits serious consideration for a process to dismiss him from the
clerical state.
First, there is the sheer volume and heinous nature of the accusations. Seventeen victims, all bu tone boys,
are listed. The detailed information is enclosed. These victims, even though they received counseling and fmancial
recompense form the Archdiocese of Santa Fe, will have to live with the trauma of their experiences for a lifetime,
let alone the suffering incurred by their families and loved ones. As the Archdiocesan Review Board agreed there
was substance to the allegations, they certainly had occurred.
Particularly abhorrent is the case of the female victim, , who was nine in 1990 at the time
of the alleged abuse. She indicated that she endured vaginal, oral and anal sex from the accused. The current rules
for prescription would in fact allow for a criminal action still to be brought by this victim, the spirit of the present
rule ought to encompass the rights of this then child.
Also, the faithful of the Archdiocese of Santa Fe suffered irreparable damage due to the actions of the
accused. The total payments in reparation to the victims has approached $3,000,000. The faithful willingly
sacrificed to provide monies so that the~e costs might be met without having to plunge the Archdiocese into
bankruptcy. It mustbe noted that the Archdiocese is basically poor as the people of New Mexico do not make large
salaries. Yet, throhgh their pastors, they were willing to give from their need to provide for the good of the local
Church.
Further, the damage to the people of God of the Archdiocese caused by the accused is.pr.ofound. Even
though the faithful have continued and have even groYtTI in their faith, the.scandal and hurt is deep 'and never will be
totally overcome . .;..

The accused scarcely is living a life of ':prayer and penance" as outlined in Norm 8B of the Essential
Norms of the United States Conference of Bishops. As indicated, he receives monthly retirement benefits from the
Archdiocesan Priesl.Relief Fund and total medical coverage. There is not even any indication that the accused
acknowledged his crimes or that he has in any way even attempted to "have withdrawn from contumacy (contempt)"
as illustrated in Canon 1347.
Penalties can be expiatory. Such penalties can remedy the societal damage done by the delict and deter
others from similar behavior. The injury done to the victims and their families, the fmancial burden placed on the
faithful of the Archdiocese, the spiritual damage inflicted on the same faithful, all of these postulate the most
serious penalty so that justice can be restored and, to some extent at least. scandal be repaired (see Canon 1341).
Simple suspension, or use of Canon 223, 2, does not begin to do justice to the crimes involved., Fur"JJer, if this
expiatory penalty is Qot imposed, the impression will remain that others, or even the accused h~self, can continue
in this misconduct while the people of God and the victims will pay the price.
There is another urgent issue. He is presently only 66 years old. The Archdiocesan attorneys strongly
suggest that the possibility of dismissal from the clerical state be sought in this case. Restrictions~short of this may
hold the Archdiocese open to further civil action. There is a strong possibility that the accused will, in fact,
continue his behavior. Certainly the presence of Canon 223 2 however strong it may be worded, may not be
adequate to protect the.assets of the Archdiocese. Only dismissal from the clerical state can provide tfJe complete
severance necessiuyJor such protection.
For all thes.e. re~ons: the numerous and serious delicts, the spiritual and emotional trau~a of.the victims
and their families and friends l the financial and spiritual damage to the faithful, the .seeming indifference on the part

of the accused, the need to provide justice to the victims and the faithful, the need to deter further misconduct, and
the protection of the Archdiocesan assets, I am requesting that this case be accepted by the Congregation for the
Doctrine ofFaith . ...
Further, I am asking for exofficio dismissal of the accused from the clerical state. If this is not possible, 1
request that the case.be permitted to be treated under the sununary process of Canon 1720. (Sacramentorum
Sanctitatis Tutela, Decisions Subsequent to Promulgation, Article 17).
In the same document ofFebruary 7,2003, the "faculty [is] granted to the CDF to dispense from the
req uirement of priesthood and the requirement ofa doctrine in canon law mentioned in art, 8 (judges), 9 (promoter
of justice), 10 (notaries and chancellors), 11 (advocates and procurators), 12 Uudges, promoters of justice, notaries,
patrons in other tribunals)." This dispensation is only to be granted to persons who hold a licentiate in canon law
and have worked for a reasonable time in ecclesiastical tnbunals.
Currently, our Archdiocese has three priests with licentiates in Canon Law: Rev. Kevin Niehoff, OP;
Rev. Jerome A. Martinez, also the diocesan Promoter of Justice; Rev. Jerome A. Piatkowski, Judicial Vi car.
Reverends Niehoff and Piatkowski have not only worked in the Archdi ocesan Tribunal for many years, they also
have been Judges in Second Instance in a complex Penal Case involving dismissal from the clerical state.
Rev. Martinez has w.orked in the Tribunal as well, and as Promoter of Justice, bas been involved-in penal matters.
ask for the requiredilispensation for these three priests, should there be a need for them to act in any capacity in this
cause.

The accused scarcely is living a life of !;prayer and penance" as outlined in Norm 8B of the Essential
Norms of the United States Conference of Bishops. As indicated, he receives monthly retirement benefits from the
Archdiocesan Pries'lRelief Fund and total medical coverage. There is not even any indication that the accused
acknowledged his crimes or that he has in any way even attempted to "have withdrawn from contumacy (contempt)"
as illustrated in Canon 1347.
Penalties can be expiatory. Such penalties can remedy the societal damage done by the delict and deter
others from similar behavior. The injUI)' done to the victims and their families, the fmancial burden placed on the
faithful of the Archdiocese, the spiritual damage inflicted on the same faithful, all of these postulate the most
serious penalty so that justice can be restored and, to some extent at least, scandal be repaired (see Canon 1341).
Simple suspension, or use of Canon 223. 2, does not begin to do justice to the crimes involved. Further, if this

expiatory penaJty is Q,ot imposed, the impression will remain that others, or even the accused h~self, can continue
in this misconduct while the people of God and the victims will pay the price.
There is another urgent issue. He is presently only 66 years old. The Archdiocesan attorneys strongly
suggest that the possibility of dismissal from the clerical state be sought in this case. Restrictions:short of this may
hold the Archdiocese open to further civil action. There is a strong possibility that the accused will, in fact,
continue his behavior. Certainly the presence of Canon 223 2 however strong it may be worded, may not be
adequate to protect the.assets of the Archdiocese, Only dismissal from the clerical state can provide the complete
severance necessaryJor such protection. .:,
For all thes.e. reas'ons: the numerous and serious delicts, the spiritual and emotional traum'a of.the victims
and their families and friends, the financial and spiritual damage to the faithful, the .seeming indifference on the part

of the accused, the need to provide justice to the victims and the faithful, the need to deter further misconduct, and
the protection afthe' Archdiocesan assets, I am requesting th1J.t this case be accepted by the Congregation for the
Doctrine of Faith . . '

Further, I am asking fo r ex-officio dismissal of the accused from the clerical state. If this is not possible, I
request that the case.be permitted to be treated under the summary process of Canon 1720. (Sacramentorurn
Sanctitatis Tutela, Decisions Subsequent to Promulgation, Article 17).
In the same document of February 7, 2003 , the "faculty [is] granted to the CDF to dispense from the
requirement of priesthood and the requirement ofa doctrine in canon law mentioned in art, 8 Uudges), 9 (promoter
of justice), 10 (notaries and chancellors), 11 (advocates and procurators), 12 Uudges, promoters of justice, notaries,
patrons in other tribuna ls)." This dispensation is only to be granted to persons who hold a licentiate in canon law
and have worked for a reasonable time in ecclesiastical tribunals.
Currently, our Archdiocese has three priests with licentiates in Canon Law: Rev. Kevin Niehoff, OP;
Rev. Jerome A. Martinez, also the diocesan Promoter of Justice; Rev. Jerome A. Piatkowski, Judicial V icar.
Revere nds Niehoff and Piatkowski have not only worked in the Archdiocesan Tribunal for many years) they also
have been Judges in Second Instance in a complex Penal Case involving dismissal from the clerical state.
Rev. Martinez has w.orked in th e Tribunal as well, and as Promoter of Justice, has been involvedin penal matters.

cause.

Dear Sabine,
This is a follow-up to our phone conversation the other day regarding the decision of the
Congregation for the Doctrine of the Faith in Rome, I am enclosing the decree signed by the
Prefect of the Congregation informing us that Pope Benedict XVI has given you laicization. The
enclosed unofficial translation of the Latin document is made available to you. I would ask that
you please sign the Latin document on the bottom left hand side of the back page, make a copy
for yourself and send the original back to me.
The decree gives stipulations regarding your official status urging you to take part in the life of
the Church as a lay person and the Dallas Charter that was adopted by the Bishops and approved
by Rome urges you to live a life of prayer and penance for the reasons that moved the Church to
laicize you.
You will continue to receive your pension and have health insurance, but not the long-term
health insurance. Let us pray for one another and for priestly and religious vocations_

On December 1,2005 I sent a letter (copy enclosed) via registered mail to J. Sabine Griego
informing him that the Holy Father made the decision that he laicized. In the same letter I noted
that he would continue to receive his pension and have health insurance provided by the
Archdiocese of Santa Fe but not the long-term health insurance . .

Griego refused the letter and it was returhed to my office. I have enclosed a copy of the ,,(-'to
envelope. I did inform him by phone as well. I have also had to write to two priests o(the
Archdiocese infonning them that Griego has been laicized (copy enclosed). I did this because I
had received- inforITi~tion that Griego continuedtd 6ffer Masses publicly after he had been
notified of hi s laiclzation. .
At this point I want"to completely close my records regarding this matter and thought it would be
prudent to communicate with you this last tline about its st;;ltuS. There was no mention of a taxa
in your correspondence regarding this m;;ltter. Please advise as to what the taxa is and I fo llow
through.

you provide to the Church.
