Charge Description: On or about October 16, 2017, in the County of Ramsey, Minnesota, James John
Lopez did directly or indirectly threaten to commit a crime of violence, with purpose to cause, or in
recklessdisregardoftheriskofcausing,terrorinanother.

 STATEMENTOFPROBABLECAUSE

OnOctober16,2017,at2021hours,St.PaulPolicetookareportofanincidentthatoccurredonSidney
StreetWestinSt.Paul,RamseyCounty,Minnesota.Policespoketothecomplainingwitness,who
identifiedherselfasKMK,DOB11/24/1961.Shesaidsheisintownvisitinghersister,KL,DOB
01/01/1964.ShesaidthatKLliveswithherhusbandandchildrenatthehomeonSidneyStreet.She
identifiedKLshusbandasthedefendant,JamesJohnLopez,DOB07/30/1962.

KMKreportedthatthedefendanthadbeendrinkingandwasarguingwithhiswife.KLwaspackingher
thingstoleavewiththechildrenfortheevening.ThedefendantlookedatKMKwhileshewassittinginthe
livingroomwaitingtoleavewithhersister.Hesaid,Idontcarewhereyougo,St.PaulorSeattle,Illbe
hidinginthebushesandIllshootyou.Shesaidthedefendantpointedhisfingeratherwhenhesaidthis.
Shestatedthatshewasfrightenedandwantedtodocumenttheincident.Shesaidthatthedefendantisa
lawenforcementofficerandthatheownsguns.

OnOctober19,2017,aninvestigatorcontactedKL.Sheconfirmedthatsheismarriedtothedefendant.
ShesaidthatonthenightofOctober16,thedefendantwasdrinkingheavilyandstartedcallingherthe
devil.Hecalledhersister,KMK,awitch.Hewasactingoutofcontrolandcrazy.Heyelledathertogetout
ofthehouse.KLsaidsherandownstairstothelaundryroomtopackherthingsandleavebecauseshe
wasafraidofwhatthedefendantmightdotoher.Shereportedthataboutayearagoheputaguntoher
head.Shedidnotreporttheincidentbecausehethreatenedtokillherifsheevercalledthepolice.She
confirmedthatsheheardthedefendantthreatentokillhersister.Shesaidthatherfatherwaspresentand
witnessedtheincident.

TheinvestigatorspokewithKLsfather,DFK,DOB11/15/1936.Hesaidthatthedefendantwasdrinking.
Heheardthedefendantthreatentokillhisdaughter,KMK.Healsosawthedefendantpointhisfingerather
asifhewasholdingagun.Hesaidthatthedefendantwentdownstairsandheheardsoundslikeagun
beingrackedandloaded.Theyallleftandwenttohisotherdaughtershousebecausetheywereafraidof
whatthedefendantmightdobasedonhisbehaviorandduetopastincidents.

KLobtainedanEmergency(ExParte)OrderforProtectionagainstthedefendantonOctober19,2017.In
heraffidavitandpetition,sheallegedthatthedefendantthreatenedtokillherinthepastandthatheputa
guntoherhead.Shereportedthatshebelievedthatthedefendantwouldshoother.

InvestigationrevealedthatthedefendantisemployedasaMinneapolisPoliceOfficer.

ThedefendanthasaconvictionforDWIoutofScottCountyonoraboutMay4,2016.
