Sub-: Notification of the defects in flat No.1601/Tower


No.10 and in the Common Area of the Supreme Towers,
Sector 99, NOIDA, U.P. for rectification and
compensation/ damages.

Sir,

With due respect, I have to state as under:

1. That I am the owner and original allottee of the above


mentioned flat. I have to point out the following defects in
above noted Flat and in the common area of the said
towers.
2. That after getting the possession of the said flat, it is
revealed that the M/S Poorvanchal Construction Works Pvt.
Ltd. and Architact M/S A Designer have raised very poor
and defective construction of the Supreme Towers, when
the said builder has not used the specified articles and
material mentioned in the Tender approved by the Society.
3. That the size of the said flat is not as per specification and
drawings sanctioned and approved by the Society and its
members. The builder and the architect have only done
their work without following the norms ,parameters,
measures as per the settled building bye laws , standard
and safety norms .
4. That the quality of the material used in the said flat is very
poor and the substitute which is used in place of
specification mentioned in the approved tender is also very
inferior and substandard quality despite it we paid very
high and excessive cost of construction of the said flat.
5. That the following defects are required to be cured and
certain fixtures and items needs to be replaced from the
said flat and from the common area immediately.
a. Lift lobby rain water pipes connection to drain out the water
during rainy days, as all sides are open in lift lobby the scope
of rain water exit is missing. This is executions main fault.
Due to this defect, water accumulates in the lobby as and
when rain is there as there is no outlet.

b. Exterior paints and lift lobby paint is of very poor quality, as


all the fillings at exterior wall is exposed and putty marks
shows patches and immediately requires two final coats of
standard paint with their specification.

c. On railing the enamel painting is done without buffing the


joints of welding and without applying primer and putty in
the railing as well as in the doors and windows. It needs to
be done again in proper manner.

d. All internal doors are hanging on hinges with only one or two
screws on each hinges, shows no proper supervision is done
on this count. Even the quality of tower bolt and door handle
is very poor and third class and their color has fade. Lock
of the main gate is of very inferior quality. It seems that it
can be opened by any key.

e. The quality of plaster inside and outside of the flat are


extremely poor and seems that either the cement ratio or the
lack of curing, very pathetic condition of the flat plaster lots
of undulation is also marked on the surface area. The number
of cracks are on the beams inside and outside of the flat
need to be repaired in proper manner.
f. In the plumbing shaft no water proofing plaster is applied on
the internal wall of shaft, any leakage in floor gives the sea-
page marks inside the bathroom; the sanitary fixing is also
junked.

g. There is no Toilet having Indian Seat for children.

h. Doors of all the bathrooms are so small in width that no


Washing machine can be put therein.

i. No space is left to sit and rectify defect in pipe line.

j. Door frame used in the flat are very inferior cheap quality of
wood, all screws are coming out.

k. Periphery bitumen road work is of very poor quality as no


proper slope is maintained which may result in water logging
and finally breakage of road in each rainy season.
Consequently water will go down in Car Parking and from
there no outlet is there. Consequently mosquitoes will spread
there.

l. The boundary walls and its plaster are coming out due to non
proper draining system as a result water is logging out and
creating mosquitoes. Zika, Dengu and maleria disease will
spread there.

m. Regulator and switches are of so poor quality that the same


are not working properly. Wiring is of cheap quality
resultantly there is fuse in MCV frequently. Fire insulated wire
ought to be installed in the flat. Power Electric points for
computer, telephone, intercom etc are not properly done.

n. I was liable to pay only Rs. 22 Lakh as per tender approved


but I have been made to pay more than that which I claim
to be refunded plus the damage and compensation for using
substitutes and loss caused due to delay in construction and
handing over of the possession of the Flat. Therefore I claim
total Rs.25 Lakhs at least from the builder and the architect
jointly and severally, beside rectification of said defects in
time bound period.

6. WE REGRET TO FURTHER STATE THAT DESPITE MY


REPEATED REQUESTS IN WRITING AND ORALLY NO
RECTIFICATIONS WERE MADE TILL MY LAST VISIT TO THE
SOCIETY IN THE MONTH OF SEPT,2016.I WAS SENT A
MESSAGE ON 17-10-2016 THAT OUR OBSERVATIONS HAVE
BEEN ATTENDED BUT TILL DATE NOTHING HAS BEEN
DONE.

Kindly serve a copy of this notification on the builder and


architect besides filing a copy before Honble Arbitrator and
oblige.
