For Prequalification of Local and International Companies to Subscribe in


the Future Tenders Which will be Awarded by the Ministry for Main
Transforming Substations in Electricity Transmission Networks Sector,
Voltage 132, 300 and 400 K.V.

A- Financial and Legal Documents

First: Required legal and financial documents for prequalifying local


companies and establishments:

1- Kuwait Chamber of Commerce and Industry certificates (present year).


2- Commercial registry.
3- Central Agency for Public Tenders registration certificate.
4- National manpower certificate (ratio should be matched after signing the
contract).
5- Complete financial statements for the last 5 fiscal years of the company
(income statement, financial position statement, financial flow statement,
change statement in equity) approved by a local certified auditing office
along with the financial reports.
6- Banks certificates.
7- License from Ministry of Commerce and Industry.
8- Copy of the articles of association.
9- Copy of approved signature (approved letter of authorized signatory).
10- Total equity should not be less than 2 (two) millions KD.
11- Submit 07 (seven) CD copies of the above listed requirements.

Second: Required legal and financial documents for prequalifying the
foreign companies in addition to the local agent:

1- Copy of legal entity of the foreign company and it should be approved by


official authorities (Chamber of Commerce and Industry, Ministry of
Commerce and Industry, Ministry of Justice and Ministry of Foreign
Affairs) in the country of origin and attested by the Embassy of Kuwait in
country of origin.
2- Translation of the legal entity of the foreign company into Arabic
language by approved and certified office in Kuwait.
3- Complete financial statements for the last 05 (five) fiscal years of the
foreign company (income statement, financial position statement,
financial flow statement, change statement in equity) approved by a local
auditing office and approved by the official authorities in the country of
origin and also all necessary bank certificates approved by the official
authorities in the country of origin and the Embassy of Kuwait in the
country of origin and translated in a certified office in the State of
Kuwait.
4- Copy of the agency agreement between the foreign company and the local
agent (if any) attested by the official authorities in the country of origin
(foreign country) and by the Embassy of Kuwait in the country of origin.
Also agency approval by official authorities in the State of Kuwait
according to the legal procedures.
5- Translation of the agency agreement (if any) into Arabic language by a
certified translation office in the State of Kuwait.
6- License of the company or the establishment from the Ministry of
Commerce and Industry.
7- A valid agency certificate issued by the Ministry of Commerce and
Industry (in the case of the local agent existence). The company should
provide a document which proves that it has a Kuwaiti partner or agent in
the State of Kuwait (official agency) registered at the Ministry of
Commerce and Industry and Kuwait Chamber of Commerce and Industry
(officially attested).
8- Copy of approved signature (approved signature letter for authorized
signatory).
9- Total equity should not be less than 2 (two) millions KD.
10- Submit 07 (seven) CD copies of the above listed requirements.

* All above-mentioned documents shall be studied and financially analyzed


to evaluate the financial ability of the company and its potential. The
ministry is entitled and empowered to refuse any applicant if it doesnt meet
the prequalification conditions.

B- Technical Data

First: Previous Experience:

1- The assigned work load to the company, should match the assigned
prequalification. The company should provide list of its previous projects
in design, supply, operating, erection, testing, inspection and maintenance
works of prequalification subject and these works are to design, provide,
supply, and install equipment, operate, test, inspect and maintain the main
transforming substations (Turn Key Job).

2- Regarding high voltage projects (132-33 K.V.), the company must


provide list of substation projects voltage (132 K.V.) insulated by SF6
(indoor) for a total of 10 (ten) substations and it should be in service for at
least 04 (four) years with satisfactory reports. Some of the projects should
be in countries with similar climate and weather conditions as the State of
Kuwait (or one of the GCC countries at least).

Regarding local companies, the company should have the capability to


install at least one substation with satisfactory reports according to the
ministry requirements. The ministry will evaluate whether or not
companies are able to continue after 03(three) years (guarantee period)
from the date of operation and also the company should provide additional
guarantee not less than 07 (seven) years for this substations.

3- Regarding extra high voltage projects (300-400 K.V.); the company must
provide list of substations projects with voltage (300-400 K.V.) Insulated
with SF6, for a total of 05 (five) substations and it should be in service for
4 (four) years with satisfactory reports. Some of the projects should be in
countries with similar climate and weather conditions as the State of
Kuwait (or one of the GCC countries). In addition, the company must
provide a list of 10 substation projects voltage (132 K.V.) done inside the
State of Kuwait and it should be in service for at least 04 (four) years with
satisfactory report.

Regarding local companies, the company should provide a list of 10 (ten)


substation projects voltage (132 K.V.) done inside the State of Kuwait and
it should be in series satisfactorily for at least 04 (four) years.
4- The company must submit International ISO certification to prove the
quality of projects of the company.

Second: Experience certificate from clients:
The company must submit certified experience certificates from clients (in
English or Arabic Language) showing projects quality and companys
competency and ability in equipment installation during supply, performance,
test, operation, guarantee, inspection and maintenance periods showing the
contract no., project name, substation capacity and voltage, date of starting
contract and expiry date with the contract data of project owner which should be
clear, readable, signed and attested by the project owner and Embassy of the
State of Kuwait in the country of origin. Any mentioned project in the performed
projects lists shall not be considered without client certificates.

Third: Technical system:


The company must provide detailed list of the assigned technical staff showing
their academic degrees, designations and work experience supported with ID
certificates. Also certificates from the manufacturing companies (equipment
supplier) proving that they trained the technical staff members in installation,
testing and maintenance works stating the kind of equipment they were trained
with. Technical staffs and labor workers must be proportional to the work load
assigned, satisfactory to the ministry requirements and subject to evaluation for
each project.

Fourth: Required equipment and machinery for erection and maintenance


works:
The company must provide a list of available and required machineries and
equipment for erection works such as cranes with mentioning the capacity in
tons, lorries, trucks, excavation machines, trails, its volume and size,
transformers installation equipment, switchgears, switchgears test machines,
transformers, cables, current and voltage transformers tests devices, prevention
and control devices, diesel generators etc. and these equipment must be
proportional to the work nature of substations and satisfactory to the ministrys
requirements and subject to evaluation for each project.

Rules and Regulations

1- The contractor must commit to the Ministry of Electricity and Water


specifications and any changes occurred in order to reach the desired level
of safety and quality of the work.
2- The ministry is entitled to refuse the prequalification application in case of
weak performance, unsuitable climate condition of State of Kuwait (as
temperature reaches 550C under shade), electric network safety damage,
or quality reduction.
3- The ministry is entitled to withdraw the approval of prequalification in
case the company or establishment isnt complied with the specifications
and requirements of the ministry or with any term of prequalification
requirements.
4- The prequalified companies must commit to the assigned work load of
prequalification subject in terms of winning of any tender of the
ministry and in case the company neglects the work and delays the
project, therefore the ministry is entitled to withdraw the prequalification
license and suspend the company unless the company complies with the
required works.
5- All submitted documents must be attested and authenticated by competent
authorities and the Embassy of the State of Kuwait in the country of origin
to prove its accuracy and validity.
6- All submitted documents and data from companies and establishments
must be clear and serial.
7- The ministry is entitled to ask for original copy of the attached documents.
8- The companies and establishments must submit undertaking and
declaration of accuracy for all submitted documents in the prequalification
application.
9- Regarding erection companies (not Manufacturer) applying for substations
of extra high voltage (300-400 kV), the company must submit documents
proving that it performed and installed substations voltage (132 KV) with
satisfactory reports as mentioned in the technical data for qualifying
erection companies. The ministry will decide numbers of substations
needed later. The company will be evaluated after performing all required
works completely and after the guarantee period is expired.
10- The erection company should provide guarantee period for 03 (three)
years since the beginning of operation the company completely as
mentioned in the specifications.

11- All erection companies, which are prequalified previously in the
electricity transmission networks sector, should apply for requalification
request through central tenders committee.
12- Ministry of Electricity and Water shall not receive any direct of
application submission by any company after the date of official
announcement in the daily newspaper Kuwait Today which will last for
a period of 05 (five) years from the date of announcement.
13- The company must submit all required documents otherwise the ministry
will not consider any request that does not meet the prequalification
conditions.
14- After prequalification (as an erection company), MEW will add the name
of the concerned company to the approved list to participate in MEWs
contracts for supply and erection for main transforming substations in
Electricity Transmission Networks Sector.
15-In case of any discrepancy arising out of the Arabic and English versions,
the Arabic text shall prevail.

The Required Documents

In addition to the above-mentioned required documents, the company must


submit the application in closed envelope as mentioned below:

Submit 07 (seven) envelopes writing on them prequalification of local and


international companies erection, operating and maintaining (turn-key job) of
main transforming substations projects with high voltage (132 KV, 33 KV) or
extra high voltage( 400 KV or 300 KV) in the State of Kuwait, stating the
company name and address on the same envelope. Each envelope must contain
09 (nine) CDs containing the following documents:
CD No. 1: A brief summary of the company activities.
CD No. 2: A copy of the memorandum of association and agency registration
certificate (for foreign companies) (as mentioned in the required terms and
conditions list of prequalification).
CD No. 3: A copy of ISO Certificate (as mentioned in the required terms and
conditions list of prequalification).
CD No. 4: A lists of the technical staff (as mentioned in the required terms and
conditions list of prequalification).
CD No. 5: A list of required tools, machines and equipments for erection and
maintenance works (as mentioned in the required terms and conditions list of
prequalification).
CD No. 6: A list of performed projects by the company including (location of
project, its voltage, financial value, supply, erection and delivery period, date of
beginning and completion of the contract) and it must comply with the
mentioned projects in the attached experience certificates from clients.
CD No. 7: Experience certificates from clients (as mentioned in the required
terms and conditions list of prequalification).
CD No. 8: Suppliers list for substation main parts which the company
established, the competency of the suppliers, and their address. The company
must also (in case of being qualified in the ministry tenders) use these materials
from the approved suppliers list of the ministry and this must be indicated in the
envelope.
CD No. 9: All related documents of the financial potential of the company (as
mentioned in the required terms and conditions list of prequalification).

Companies should submit the above mentioned envelopes ( 7 envelopes


each one contains 9 CDs to the Central Agency for Public Tenders.
