CHARGES OF VIOLATION OF LA.R.S. 14:103(A)(2): DISTURBING THE PEACE BY
OFFENSIVE LANGUAGE.

NOW INTO COURT, comes CAROL JAMES (CJ) VINCENT, DEFENDANT, as

depicted in the above caption, who does state as follows:

Carol James (CJ) Vincent was charged, by the Calcasieu Parish District Attorney,

with violating La.R.S. 14:103(A)(2) Disturbing the Peace By Offensive Language (bill

of information dated October 24, 2017).

La.R.S. 14:103(A)(2) Disturbing the Peace By Offensive Language is defined by


the Louisiana Code of Criminal Procedure as;
(A) Disturbing the peace is the doing of any of the following in such
manner as would foreseeably disturb or alarm the public:
(2) Addressing any offensive, derisive, or annoying words to any other
person who is lawfully in any street, or other public place; or call him
by any offensive or derisive name, or make any noise or exclamation in
his presence and hearing with the intent to deride, offend, or annoy
him, or to prevent him from pursuing his lawful business, occupation,
or duty.

(B)(1) Whoever commits the crime of disturbing the peace shall be fined
not more than one hundred dollars or imprisoned for not more than
ninety days, or both.

Defendant alleges that La.R.S. 14:103(A)(2) violates his United States of
America, and Louisiana Constitution of 1974, RIGHT to FREEDOM OF
EXPRESSION and FREEDOM OF SPEECH.
