SECTIONONE
SAMPLINGRULES


1. SCOPE
ForallcontractsincorporatingthetermsandconditionsofTheGrainandFeedTradeAssociation(Gafta)these
Rulesapplyforthepurposesofsamplingthegoods,preparationanddistributionofsamplesatthepointof
determination,analysismethods,testsandcertification.

2. DEFINITIONS
2.1 CargoSuperintendent
A superintendent is an organisation or company whose primary business activities are in the profession of
inspectionandwhoisappointedby(oronbehalfof)Buyersand/orSellers.Asuperintendentshalloperate
independently;freefromanycommercial,financialorotherpressuresinaccordancewiththeSamplingRules,
theCodeofPracticeforSuperintendentsandSurveyorsandtheCodeofConductofGafta.

2.2 IncrementSamples
Samplestakenbyhandscoop(orwhateverinstrumentappropriate)directfromtheconsignmentoflessthan1
kilograminweight,oriftakenmechanically,ofwhicheverweightisappropriatetotheequipment.

2.3 Bulk(Aggregate)Sample
Theaccumulation,combinedandwellmixedtotalofalltheincrementsamplesofthecontractualquantity

2.4 ContractualSamples
Samples reduced from the bulk sample sealed into not less than 3 kilogram containers each, in as many
containersasrequiredbytheRules.

2.5 AnalysisSamples
Sample(s)reducedfromthecontractualsamplesbythe laboratories listedontheGafta RegisterofApproved
Analysts,toquantitiesappropriateforanalysis.

2.6 Pointofdetermination
Theplaceand/orplaceswherethecontractualsamplesaredrawnandsealed.

2.7 ContainingBags(CB)
Containingbagsshallbenew,madeofnontoxic,odourless,unglazed,insewn,manmadeornaturalfibreora
mixturethereof,sufficientlytightlywoventoretainalldustand/orforeignmatterandpreventthemovingapart
ofthewarpandtheweftofthematerial.Theyshallbetightlyfilledandsecurelytiedbeforesealing.

2.8 MoistureProofContainers(MPC)
"MPC"meansthecontainersshallbebottles,jarsortinswithclosefittinglids,orstrongpolytheneofaminimum
250mgaugebagssecurelytied,andthatsuchcontainersarelabelledandshallbesealed,andifrequiredby
eithersuperintendent,enclosedinasealed"CB".


3. GENERAL

3.1 For the purpose of these Rules, the words "Buyers" and "Sellers" shall be deemed to be the parties to the
contractandtheirrespectivesuperintendents.

3.2 PursuanttothecontracttermsandforthepurposesoftheseRules,superintendentsshallbeappointedfrom
theGaftaRegisterofApprovedSuperintendents.

3.3 Thepartiesareresponsibleforprovidingtheirappointedsuperintendentswithpreciseinstructions.

3.4 Ifoneofthepartiesisnotrepresentedforsamplingorrefusestodrawand/orsealsamplesascalledforunder
thecontract,theotherpartyshallunderadvicetothatpartycalluponasuperintendentfromanothercompany

listedontheRegisterofApprovedSuperintendentstoactontheirbehalftodrawand/orsealsamplesaccording
totheseRules.Extraexpensesincurredinthisconnectionshallbebornebythedefaultingparty.

3.5 SubjecttothepriorapprovalbytheCouncilofGaftaalternativepackagingandsealingmethodsmaybeapplied.

3.6 Theword"sealed"shallmeanjointlysealedsamplesbytheBuyersandSellersortheirsuperintendentsandshall
besealedinsuchamannerastopreventanyaccesstothesamplewithoutbreakingorremovingtheseal.The
seal'smarkshouldbeclearlyvisibleandidentifiable.

4. METHODOFDRAWINGSAMPLES
4.1 SamplingPoints
Sampling points have to be carefully selected, and agreed by the superintendents, at a point where the
incrementsamplesdrawnarerepresentativeofthegoodsloadedand/ordischargedand/ortransshipped.Inthe
event that the facility is unsafe, or operations preclude access to the hold or a mutually agreed acceptable
samplingpoint,thesuperintendentsmaystoptheoperationinordertodrawincrementsamplesasrequiredby
theseRules.Thepartiesaredeemedtohaveagreedtothisprocedure.

Ifsamplesaretobedrawnoutsideofnaturaldaylighttheymustbedrawnunderfullandproperlyadequate
shipslightingand/orinstallationlighting.Irrespectiveofthetimeorplaceofsampling,thedivision,classification
and sealing of contractual samples shall always be carried out in daylight or, in artificial light if considered
adequateandmutuallyagreedbythesuperintendents.

4.2 IncrementSamples
4.2.1 According to the rate of loading or discharge, increment samples shall be taken throughout, uniformly and
systematically,inordertoachieverepresentativesamplesofthewholeconsignment.

4.2.2 Asmanyincrementsamplesaspracticallyandphysicallypossible(butnotlessthanassetoutinTable1below)
shallbetakenthroughoutdischarge/loading,andwherepossible,eachincrementsampleshouldnotexceed1
kilogram. The total of increments, (bulk aggregate sample), shall be placed in mutually agreed suitable
container(s),tobekeptclosedandsecure.

4.2.3 Inanyevent,beforethecontractualsetsofsamplesareprepared;incrementsshallbetakenfromthewholeof
thecontracttonnage,exceptwherethepartieshaveagreedthatthestandinginclauseapplies.Inwhichevent
incrementsshallbetakenfromeitherthewholebillofladingquantity,orholdtonnagepursuanttoRule7.1and
7.2.

4.2.4 Security
If, due to the large amount of tonnage being loaded or discharged the bulk increment samples cannot be
contained in one place, or at any cessation of work, and when full, the containers containing the increment
samples must be sealed by the superintendents, and for safe custody, placed in a mutually approved secure
place,untilrequiredtobedividedandreducedforthecontractualsetsofsamples.

4.2.5 DivisionofBulk(Aggregate)Samples
Thebulksampleshallthenbedivideduntilreducedtotherequiredquantityneededforthecontractualsetof
samplesbyamethodmutuallyagreedbythesuperintendents,andthesesamplesshallbesealedwithoutdelay.
Theincrementsamplesrepresentingthetotalcontractualquantityshallbethoroughlymixedintoabulksample.

Thebulksampleshallthenbedivideduntilreducedtotherequiredquantityneededforthecontractualset(s)of
samples,andthesesamplesshallbesealedwithoutdelay.

If,duetophysicaland/orpracticalrestrictions,itisimpossibletomixalltheincrementsamplesrepresentingthe
total contractual quantity into one bulk sample, then bulk lot samples may be prereduced equally and
proportionallytonotlessthan25%oftheoriginalquantity,formixing.

Contractual samples shall be placed in clean containers. The containers shall be suitable for the mass of the
contractualsamples.Themassshallbeappropriateforalltheanalysesthataretobecarriedout.Thecontainers
shall also preserve the initial characteristics of the contractual samples. Ideally these containers shall be
completelyfullandshallbesealedtoavoidanychangeintheircontents.Ifpresent,sealsshallbetamperproof
andidentifiable.

4.3 Bags
4.3.1 Forgoodsinbags
Increment samples shall be drawn from original bags selected at random from the parcel which are clearly
identifiablewiththeappropriatemarkings;(a)forupto100bags,notlessthan20ofthebagsshallbesampled;
(b)forupto1,000bags,notlessthan50ofthebagsshallbesampled,and(c)over1,000bags,notlessthan0.5%
(1in200bags)withaminimumof50ofthebagsshallbesampled.Incrementsamplesshallbedrawnuniformly,
byapiercingspearfromthetop,middleandbottomofeachbag.Ifitisnotpossibletodrawasamplebyspear
efficiently,thentheoriginalbagsmaybeopenedtosamplebyhandscoop.Sofarasispossiblesamplesshallbe
drawnfromtheendsandmiddleofthebagsinrotation.

4.3.2 Bagsforcuttingandstarting(bleeding)
Whengoodsareloadedfrombagstobecutandbledintothehold(s)ofthevessel,incrementsamplesshallbe
takenatthenearestpointtothehold,eitherinaccordancewithRule4.4.1forgoodsinbulk,orifnotpossible,
samplesshallbedrawnfromthebagsasprovidedinRule4.3.1forgoodsinbags.

4.4 Bulk
4.4.1 Forgoodsinbulkatloading
Increment samples shall be drawn uniformly and systematically, concurrently with loading at the nearest
practicablepointtothevessel.Ifincrementsamplesaredrawnfromconveyor,orexvehicle,orexsilooverside
tovessel,theyshallbedrawnfromamovingstream.Ifloadingisbygrab,increment samplesshallbedrawn
from the quay or barge/craft from the bulk, excluding the run. Increment samples shall be taken by ordinary
handscoop,spear,orbyothermutuallyagreedequipmentthroughoutloading.

4.4.2 Forgoodsinbulkatdischarge
Incrementsamplesshallbedrawnuniformlyandsystematically,concurrentlywithdischarge,fromvariousparts
of the hold in a fair proportion, excluding the run. If for any reason they cannot be drawn from the hold,
increment samples shall be drawn uniformly and systematically, concurrently with discharge, at the nearest
practicable point to the hold, preferably from a moving stream when discharging overside, or to silo, to
barge/craftorothermeansoftransport.Incrementsamplesshallbetakenbyordinaryhandscooporbyother
mutuallyagreedequipmentthroughoutdischarge.

4.5 ShippingContainers
Wheregoodsareloaded,shippedordeliveredincontainers,inbulkorbags,incrementsamplesshallbedrawn
in accordance with Rule 4.3 and 4.4 at the stuffing and unstuffing of the container, as the case may be, in
accordancewiththecontract,bythemostpracticalmeanspossibleandagreedbythesuperintendents.

4.6 ContractsforRoadandRailTransport
Wheregrainsamplesarerequiredtobetakenfromwagonsorvehiclesatloading,theincrementsamplesshall
be taken by spear from not less than 3 sampling points from each wagon or vehicle. Where feedingstuffs
samplesarerequiredtobetakenfromwagonsorvehiclesatloading,theincrementsamplesshallbedrawnby
ordinaryhandscooporbyothermutuallyagreedequipment,fromthemovingstreamattheoutletofthefilling
hopper.Atdischargegrainandfeedingstuffsincrementsamplesshallbedrawnbyordinaryhandscoop,orby
anymutuallyagreedequipment,fromthemovingstreamattheoutlet(s)ofthewagonsorvehicles.

Everycontractualsampleshallbesealedandshallbearthenameoftheship,thequantityrepresentedbythe
sampleandthedatethesamplewassealed,andanyotherpertinentinformationwhichmayberequiredonthe
labelasfollows:

6. CONTRACTUALSAMPLESREQUIREDFORANALYSISTESTSANDARBITRATIONPURPOSES
6.1 QualityCertificationFinalatthePointofDetermination
Wherethecontractprovidesthatacertificate(s)ofasuperintendent,governmentorauthorityatthepointof
determination shall be final as to quality, then the superintendent, government or authority shall be solely
responsiblefordrawingsamplesandRules3.4,3.6and6.3donotapply.

6.2. ArbitrationSamples
Buyers and Sellers are entitled to attend at the point of determination and jointly seal a set of samples
consisting of 3 kilograms per 5,000 tonnes or part thereof for arbitration purposes only (in which case 3.6
applies)toberetainedbybuyers.IntheeventthatBuyersdonotattend,Sellersshalldrawandsealthissetof
samples and retain them. Arbitration samples drawn as above are not applicable for any contractual
specificationscoveredbythe certificatesthataredeemed finalastoqualityunlessotherwisedeterminedby
arbitratorsorboardofappeal.

6.3 SetsofSamples
Asmanycontractualsetsofsamplesasthecontractrequireswillbeprepared.Allcontractualsamplesforany
purposeshallbenotlessthan3kilogramsper5,000tonnesofcontractquantityorpartthereofexceptwhere
suchabalancedoesnotexceed250tonnes.

Unlessthecontractstipulatesotherwise,setsofsamplesarerequiredasfollows:

6.3.1ForGrain,(exceptMaltingBarley)Pulses,Seeds,andRice

Onesetofsamplesforeach5,000tonnesorpartthereofconsistsofthefollowing:

Inaccordancewiththetermsofthecontractsamplesshallbedispatchedtooneoftheanalystslistedonthe
RegisterofApprovedAnalystswithin14consecutivedaysofsealing.Intheeventthatthisoptionisnotdecided
atthetimeofthecontract,thechoiceofanalystshallbethatoftheinstructingparty.

6.3.2 ForFeedingstuffsandBiomassProducts.
Onesetofsamplesforeach5,000tonnesorpartthereofconsistsofthefollowing:

CB analysis
CB analysis
CB arbitration


If required by either party the sealed samples in a MPC and analysis instructions shall, within 14
consecutivedaysofsealingbedispatchedtooneoftheanalystslistedontheRegisterofApprovedAnalysts
asrequiredbythetermsofthecontract.Intheeventthatthisoptionisnotdecidedatthetimeofthe
contract,thechoiceofanalystshallbethatoftheinstructingparty.

Within14consecutivedaysofreceiptofthecertificateofanalysisofthissampletheinstructingpartyshall
sendatruecopythereoftotheothersstatingwhethertheyacceptthisanalysisorwhethertheyrequirea
secondanalysis.Whereupontheotherpartyshalldespatchthesamplesandtheinstructionsinaccordance
withpartb).

a) MoistureGuarantee
Where moisture is guaranteed, one set of samples in MPC's shall be drawn and the result of the first
analysistestshallbefinal.

b) SecondAnalysisTest
Eitherpartyhavetherightwithin14consecutivedaysofreceiptbythemofthetruecopyofthecertificate
ofanalysistogivenoticetotheotherthattheyrequireasecondanalysis,andtodispatchanotherofthe
sealed samples and analysis instructions, without delay to another analyst listed on the Register of
Approved Analysts. The mean of the two analyses shall be accepted as final if the variation does not
exceed0.50%.Shouldeitherpartyrequirefurtheranalysisbutfailtonotifytheother,andtosendsamples
withinthetimelimit,thenthemeanofthetwoanalysesthenexistingshallbedeemedtobefinal.

c) ThirdAnalysisTest
IfthevariationstatedinRule(b)abovedoesexceed0.50%thenattherequestofeitherparty,madewithin
14consecutivedaysofreceipt(bythem)ofthetruecopyofthecertificateofthesecondanalysis,andon
noticebeinggiventotheotherpartyathirdsealedsampleshallbedispatchedwithoutdelaytoanotherof
theAnalystslistedinSection2Rule6for analysis,andthemeanofthetwoanalysesofallthreetests
nearesttoeachothershallbeacceptedasfinalandbindingonbothparties.

d) Retentionofsamples
Unlessotherwiseagreedbythesuperintendents.

6.3.3 ForMaltingBarley
Twosetsofsamplesarerequired,tobemarked"Set1"and"Set2"respectively,andeachsetconsistsofthe
following:

MPC moisture/protein/calibrationorscreening
CB varietalpurity

Retentionofsamples:unlessotherwiseagreedbythesuperintendents
Set1samplestoberetainedbyBuyers.

WheretheanalysisforwarrantiesandguaranteesistobedeterminedbyGaftaortheirappointedanalystsor
otheracceptedauthority/analysts,bothsetsofsamplesandanalysisinstructionsshallbesenttothembythe
lastbuyerswithin21consecutivedaysofsealing.Unlessotherwiseagreedsamplesfor1stanalysisshallbesent
toVLBBerlin.

For the second test, either party shall have the right, within 7 consecutive days from receipt of the first
certificatetoclaimasecondanalysisinrespectofthewarrantiesorguarantees.Notificationofsuchclaimshall
begiventoGafta,orotheracceptedauthority/analysts,aswellastotheotherparty.

6.3.4 ForMarineandAnimalProducts
Onesetofsamplesisrequiredconsistingofthefollowing:

6.3.5 ForFertilisersoldonCIF,CIFFOContractNo.114
Onesetofsamplesconsistsofthefollowing:

MPC arbitration/analysis

NotwithstandinganythingcontraryintheseRulesforparcelssmallerthan1,500tonnes,samplesshallbesealed
per 250 tonnes. Buyers to arrange for analysis with an independent laboratory of their choice within 14
consecutive days after completion of discharge, and where no allowance is payable the costs will be for the
accountofBuyers.Sellersmayaccepttheresultsofthistest,oraskforasecondtestwithin14consecutivedays
after receiptofthecertificateofanalysisofthefirsttest.Inwhichcaseanyallowanceswillbebasedonthe
resultsofthe secondtest,butwherenoallowanceispayablethecosts ofthistest willbeforthe accountof
Sellers.

Retentionofsamples:
2xMPCsamplestoberetainedbyBuyers.
1xMPCtoberetainedbySellers.

6.3.6 ForMolassessoldonFOBTermsContractNo.115
Every hour throughout loading halflitre samples shall be drawn from the sample points in all the loading
pipelines. A composite sample of these halflitre samples shall be thoroughly mixed into 6samples of
approximately1litreeach,jointlysealedandnumbered;

Nos.1,2,5&6tobeheldbyBuyers.
Nos.3and4tobeheldbySellers.

JointlysealedsamplesmayalsobetakenfromthetanksofBuyers'vesselforverificationpurposes.Buyersand
Sellersshalleachsendonesampletoanindependentlaboratoryoftheirchoicewithin14consecutivedaysof
sealing.

6.3.7 ForExstoreContractsNos:109and110
OnesetofsamplesinCB,arerequiredforanalysisforthepurposesofthecontractualwarranties.Theparty
landingthegoodsshallappointandinstructasuperintendentfromtheRegisterofApprovedSuperintendentsto

drawandsealfullyrepresentativesamples.Suchsampleswillbedrawnduringthedischargeoftheimporting
vesselattheportinthecountryofthedeliveryplacenamedinthecontract.Notwithstandingtheprovisionsof
Rule3.6,everysampleshallbesealedandshallbearthenameoftheship,quantityrepresentedbythesample,
togetherwiththetotalquantityofwhicheachsampleformspart,thedatethesamplewassealed,astatement
thatthesamplesweresealedandtakeninaccordancewiththeseRulesforanalysispursuanttoContractsNos.
109 or No.110 and any other pertinent information which may be required. The laboratory shall record this
informationontheanalysiscertificate.

If samples are drawn at discharge of the vessel, exstore Sellers have the option of using the same analysis
certificatesfortheexstorecontract(s).

6.3.8 ForGoodsDamagedand/orOutofCondition"talequale"and"ryeterms"
For contracts on "tale quale" terms or terms other than "rye terms", without prejudice to Sellers rights and
responsibilitiesunderthecontract,Sellers'superintendentsatBuyersrequestshalljointlysealsamplesofgoods
arrivingdamagedoroutofconditioninaccordancewiththeprovisionsofthisRule.

For"ryeterms"contractssamplesshallinanyeventbedrawnbythesuperintendentsinaccordancewiththe
provisionsoftheseRules.

a) Goods arriving damaged and/or out of condition, including "rye terms", shall be sampled on board the
vessel at time of discharge, but in cases where both parties agree that it is not practicable for the
classificationandsamplingtobecarriedoutonboard,thengoodsdamagedand/oroutofconditionshall
belandedonthequayordischargedtolighterforthepurposeofsuchclassification.

Samplingandsealingofclassifiedsetsofsamplesshalltakeplacewithintheportareaassoonaspossible
after the damaged goods are landed or discharged into lighter, always provided that all the damaged
and/or out of condition and sound goods are classified. In the event of agreement not being reached,
withoutprejudicetothepartiesrightsandresponsibilitiesunderthecontract,eitherpartyorbothparties
shall,aftergivingnoticetotheotherparty,appointasuperintendentfromanothercompanylistedonthe
Register of Approved Superintendents to act on behalf of the other party and samples shall be drawn
jointlyunderallreserves.

b) The sets of sealed samples in classified lots shall be a fair and true indication of the degree of damage
and/oroutofconditiongoods,andthesamplelabelsshallshowtheproportionofthetonnagesoaffected.
Lumpygoods,ifinbags,shallbesampledbycuttingfromtoptobottomandwithdrawingsamplesbyhand
ifnecessary.

Thesamplelabelsshallshowthegrossdischargedweightofeachclassificationitrepresentsinclusiveofany
extraneoussubstance.

SetsofsamplesdrawnandsealedpursuanttoRule4.3or4.4and6shallbetakenforeachclassificationas
follows:

happenslater.TheexpensesincurredinsealingandforwardingofsamplesshallbepaidhalfbyBuyersand
halfbySellers.

Intheeventofitbeingprovedtothesatisfactionofthearbitratorsthatonesetofsealedsamples,inpart
or whole, has been lost, damaged or destroyed prior to the expiration of the period for forwarding
permittedunderthisclause,orthatthesaidsethavingbeenforwardedinaccordancewiththisclausehas

beenlost,damagedordestroyedduringtransit,theneitherpartyshallbeentitledtoproceedtoarbitration
ontheothercompletesetofsealedsamples.


7. STANDINGINPROVISIONSFORSAMPLINGOFFEEDINGSTUFFS.
TheprovisionsofRule6.2,6.3.2and6.3.8applyexceptwheretheyaremodifiedbyorinconsistentwiththe
followingRules:

7.1 ForAllPorts(ExceptwhereRule7.1.1and7.1.2applies).

a) Ifthegoodsconcernedinthecontractaresoldunderastandinginclauseandformpartofalargerquantity
in a hold, Buyers are deemed to have agreed, for their proportion, to abide by the samples drawn and
sealed from that hold, for the purposes of analysis and/or arbitration. Goods from each hold shall be
sampled and samples analysed separately in accordance with these Rules. If the goods are discharged
simultaneouslyfrommorethanonehold,butnotmorethantwoholds,throughonedischargingunitonly,
the standingin quantity shall be the total tonnage of those holds for any receiver taking delivery from
them.

b) Samples shall be drawn and sealed conjointly by the first CIF seller(s) and the CIF receiver(s) or their
respectiveagents.

c) The last CIF receiver(s) or their agents shall be responsible for forwarding samples and analytical
instructions to both Salamon & Seaber and Arbitrageen VerzoeningskamervoorGranen en Zaden van
Antwerpenandobtainingfromeachoftheseanalystsacertificateofanalysis.Whensendinginstructions
totheanalyststheinstructingpartyshalladvisetheanalystsofthefollowing:thebillofladingnumber,
thedeliveryordernumber,thenameofthevesselandthedateofsealing,aswellasthenamesofall
receiverswhohaveagreedtostandin,togetherwiththeirindividualtonnages.

d) CopiesofthecertificatesofanalysisshowingtherelevantdetailsofhisproportionshallbesenttoanyCIF
receiverwhohascontractuallyrequestedananalysis.Themeanofthetwotestsshallapplyforthepurpose
ofallowancesorarbitrationandshallbeacceptedasfinalifthevariationdoesnotexceed0.50%.Copiesof
thecertificateofanalysesshallbesentnolaterthan14consecutivedaysfromreceiptofthelastcertificate
bytheBuyerstotheSellers.

e) Ifthevariationstatedexceeds0.50%then,attherequestofeitherpartyunderadvicetotheircontractual
partywithin14consecutivedaysofreceiptbythemofthelastcertificateofanalysis,thethirdtestshallbe
carriedoutbyoneoftheotheranalystslistedinSection2Rule6andthemeanofthetwoanalysistests
nearesttoeachothershallbeacceptedasfinalandbindingoftheparties.

f) Theaverageofthefirstandsecondmoisturetestresultsshallbeusedasthecalculatingfactorforthethird
test.

7.1.1 ForFrenchportsonly
Rule7.1aboveapplies,exceptBuyersaredeemedtohaveagreedtoabidebythesamplesdrawnandsealed
from the whole original parcel covered by the same bill of lading for the purposes of analysis and/or
arbitration and that samples and analytical instructions shall be sent to both Salamon & Seaber and
ArbitrageenVerzoeningskamervoorGranenenZadenvanAntwerpen.

7.1.2 ForBelgianportsonly
Rule7.1aboveapplies,exceptthatsamplesandanalyticalinstructionsshallbesenttobothSalamon&Seaber
andArbitrageenVerzoeningskamervoorGranenenZadenvanAntwerpen.

7.2 ForDutchPortsforgoodsofNorthandSouthAmericanOrigin
a) Ifthegoodsconcernedinthecontractaresoldunderastandinginclauseandformpartofalargerquantity
in a hold, Buyers are deemed to have agreed, for their proportion, to abide by the samples drawn and
sealed from that hold, for the purposes of analysis and/or arbitration. Goods from each hold shall be
sampled and samples analysed separately in accordance with these Rules. If the goods are discharged

c) ThefirstCIFsellerortheiragentsshallberesponsibleforforwardingsamplesandanalyticalinstructions
within 14 consecutive days from sealing to both Salamon & Seaber and Arbitrageen
VerzoeningskamervoorGranen en Zaden van Antwerpen, and obtaining from the two analysts a
certificate of analysis. In case the first CIF seller(s) or their agents should fail to do so within 14
consecutivedaysofsealing,thentheCIFreceiver(s)ortheiragentsmayforwardsamplesandanalytical
instructions within 28 consecutive days of sealing. When sending instructions to the analysts the
instructing party shall send copies to the respective CIF receivers or the agents and shall advise the
analysts of the following; the hold number, the bill of lading number, the delivery order number, the
name of the vessel and the date of sealing, as well as the names of all receivers who have agreed to
standin,togetherwiththeirindividualtonnages.

d) ThefirstCIFseller(s)ortheiragentsshallsendphotocopiesoftheanalysiscertificatestoallCIFreceiversor
theiragentswhohaveagreedtostandinasshownonthelabelsofthesample,within14consecutivedays
fromreceiptofthelastcertificatebythefirstCIFseller.Copiesoftheanalysiscertificatesshallbesentno
laterthan14consecutivedaysfromreceiptofthelastcertificatebytheCIFreceiverorhisagenttothefirst
CIFsellerorhisagentasshownonthelabelandtoallCIFreceiversortheiragentsasshownonthelabel,
whohaveagreedtostandin.

e) Themeanofthetwotestsshallapplyforthepurposesofallowancesorarbitrationandshallbeaccepted
asfinalifthevariationdoesnotexceed0.50%.Ifthevariationexceeds0.50%,thefirstCIFsellerhasthe
option to ask for a third test. This test shall be carried out by AGER Laboratorio Chimico Merceologico
Microbiologico.ThefirstCIFsellershalladvisetheCIFreceiversnolaterthan14consecutivedaysfrom
receipt of thelast certificate of analysis, whether or notthey require a third test. In case the first CIF
seller does not use this option, the CIF receiver(s) have the option to ask for a third test by AGER
Laboratorio Chimico Merceologico Microbiologico, CIF receiver(s) in that case shall advise the first CIF
sellers whether or not a third test will be requested within 7 consecutive days of receipt of the notice
from the first CIF sellers that the first CIF sellers does not require a third test will thereupon give
instructionsforthethirdtesttobecarriedout.Certificatesofanalysisofthethirdtestshallbesentby
thefirstCIFsellerstotheCIFreceiver(s)within7consecutivedaysafterreceiptofthecertificatefromthe
analyst. In case a third test has been carried out, the mean of the two analysis tests nearest to each
othershallbeacceptedasfinal.

f) Theaverageofthefirstandsecondmoisturetestresultsshallbeusedasthecalculatingfactorforthethird
test.

8. DISPATCHOFSAMPLES,RETENTIONOFSAMPLES,ANALYSISINSTRUCTIONSANDCERTIFICATES
8.1 ThepartyrequiringanyoftherespectiveanalysespursuanttotheseRulesshallberesponsibleforthedispatch
oftherelativesample(s)andshallgivedirectly,orthroughanagentorrepresentativeactingontheirbehalf,to
theanalystconcerned,ortoGaftawhenrequiredbytheseRules,instructionsspecifyingwhatanalysesaretobe
carriedout,bothtobedonewithinthetimelimitstatedintheforegoingRules,andunlessotherwisestatedin
theseRules,theyshallsendtotheotherpartyacopyoftherelativecertificateofanalysiswithin14consecutive
daysofreceivingitfromtheanalyst.

ShouldthepartyrequiringanyoftherespectiveanalysespursuanttotheseRules:oranyrepresentativesacting
ontheirbehalffailtobothdispatchsamplesandtoinstructtheanalyst,orGaftawhenrequiredbytheseRules,
orfailtoforwardthecertificatewithinthetimelimitswithintheseRules,thenanyclaimforrejectionorforan
allowanceinrespectofanymattersdealtwithunderthecontractshallbedeemedtobewaivedandabsolutely
barred,unlessthearbitratorsorboardofappealasthecasemaybe,shallintheirabsolutediscretiondetermine
otherwise.

8.2 Reductionofcontractualsamplesfordispatchtoanalysts
ThesamplesforcontractualanalysismaybesubmittedtoananalystlistedontheRegisterofApprovedAnalysts
forthepurposeofdividingandreductionofthecontractualsample(s)toasealedlaboratorysizesampleofno
less than 3 kilograms representing the total contractual quantity. The resulting sample will be forwarded to

another analyst on the Register of Approved Analysts for analysis in accordance with the provisions in these
Rules.

9. RETENTIONOFSAMPLES
9.1 Theparties'superintendentsshalldisposeofsamplesdrawnbythemattheexpiryof3monthsfromthedateof
sealing. They may however retain samples for a longer period upon written request by either party to the
contract.

9.2 All contractual samples drawn and sealed under these rules by Buyers and Sellers or their respective
representativesshall,saveforRule9.3,remainthepropertyofbothpartiestothecontract.

9.3 WhilstGaftawillmakeeveryefforttoprotectallsamplesentrustedtoitscare,neithertheAssociationnoranyof
its servants or agents shall be under any liability whatsoever to any party having any interest in any samples
received by it in pursuance of these Rules for any loss or damage to any such sample. The samples when
deliveredtoGaftashallbecomeitsabsoluteproperty,andtheAssociationshallnotberesponsibleforthesafe
custodyofanysampleslodged.Gaftashallbeatlibertytodisposeofsamplesattheexpiryof6monthsfromthe
dateofreceipt.Gafta,however,mayretainsamplesforalongerperioduponwrittenrequest.

SECTIONTWO
ANALYSISRULES



1. SCOPE
TheseRulesapplyforthepurposesofanalysistests,methodsandcertificationforallcontractsincorporating
thetermsandconditionsofTheGrainandFeedTradeAssociation(Gafta).

2. ANALYSISSAMPLES
2.1 Samplesare reducedfromthecontractual samples,bythelaboratories,toquantitiesappropriate foranalysis
tests.

2.2 Mixing
When the contractual quantity is represented by more than one sample, the analyst shall mix the samples
togetherinproportiontotheweightrepresentedbyeachsample.WhenarbitrationsamplesaresenttoGafta,
thearbitrator(s)willbeentitledtomixthesamplestogether.

2.3 Wherethedifferencebetween3analysistestsisthesame,theaverageofthethreeresultsshallapplyforthe
purposesofallowances.

3. ANALYSTS
UnlessspecifiedintheSamplingRules,RulesNos.6and7,referringtheAnalystslistedattheendtheseRules
as Referee Analysts, Analysts shall be appointed from the GAFTA Register of Approved Analysts. If the
appointed Analyst cannot carry out the test(s) they shall send the samples to another Analyst on the
ApprovedListofAnalyststoperformthetestontheirbehalf,butthefirstappointedAnalystshallreportthe
results.

4. GENERAL
4.1 Certificates;irrespectiveofwhichpartytothecontractsubmitssamplesandgivesinstructionstotheanalysts,
theanalysts areentitled tosupplytotheotherpartyacopyofthecertificateupon application.Eachanalysis
certificateshallstateonittherelevantinformationfromthesamplelabel.

4.2 Incaseswherenoallowancesarepayablefollowinganalysis,thepartyrequestingthatanalysisshallbeobliged
topayfortheanalysis.However,whereallowancesarepayablefollowinganalysis,thecostofanalysiswillbe
bornebythepartypayingtheallowance.

4.3 Notices
Thenoticesclauseinthecontractshallapply,exceptthatthecertificatesofanalysisshallbepassedbymailby
thenextbusinessdayfollowingreceipt.

4.4. NonCompliancewiththeRules
In the event of noncompliance with the preceding provisions of these Rules being raised at arbitration as a
defence, any quality and/or condition and/or rye terms arbitration claim shall be deemed to be waived and
barred,unlessthearbitratorsorboardofappealasthecasemaybe,shallintheirabsolutediscretiondetermine
otherwise.

5. METHODSOFANALYSIS(FORMNo.130)
5.1MethodsofAnalysisareprescribedbyGafta,beingtheGaftaRegisterofAnalysisMethodsRulesNo.130,listed
below, for the time being in force. Where Gafta does not prescribe a method, this has to be agreed by the
partieswhoshallundertaketoinstructtheAnalysts.Otherwisethetestmethodshallbedecidedbytheanalysts.

Analystsshallstateonthecertificateofanalysiswhatmethodstheyhaveused.

finalandbindingontheparties.Thewholeofthesamplestobeweighed.
c)Anyallowanceduefordeficiencyintheguaranteednaturalweightshallbepaidonlyinrespecttothesound
portion of the cargo or parcel, but if the ascertained natural weight allowance is greater than the allowance
givenfor"RyeTerms"onanyportion,thedifferenceshallbeallowedtoBuyers.

d)Ineverycaseinwhichanallowanceforinferiorityinqualityisclaimed,thearbitratorsshall,indeterminingthe
same,takeintoconsiderationtheallowance(ifany)alreadymadefordeficiencyinguaranteednaturalweight,

e)ThecostofsaidcertificatestobepaidhalfbyBuyerandhalfbySeller.
f)Wherethenaturalweightisguaranteedattimeofshipmentoratdischargewithinamargin(asforexample
