being, while committing or attempting to commit the felony offense of Assault in the Second Degree while
usingand/orpossessingafirearm.

 STATEMENTOFPROBABLECAUSE

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

OnNovember6,2017atapproximately6:03p.m.Minneapolispoliceweredispatchedto4729Lyndale
Ave.N.,Minneapolis,HennepinCounty,inresponsetoacallofashooting.Uponarrival,officersfounda
whitemalelyingfacedownintheboulevardnotmoving.ThatmalewaslateridentifiedasVictimA.
MinneapolisFireFightersandparamedicsarrivedandbegantoattendtoVictimA.WhenVictimAwas
turnedoverontohisback,officersobservedagunshotwoundtothecenterofhisupperchestjustbelowhis
throat.VictimAwaspronounceddeadatthescene.

Officersspokewithseveralwitnesseswhowereatthescene.WitnessA,anidentifiedfemale,toldofficers
thatVictimAwasamechanicandwastheretoworkonafoodtruckforWitnessB.WitnessAstatedthata
femalesheknows,K.B.,calledtoaskifVictimAwasthere.Shortlyafter,K.B.showedupwithherdaughter
A.N.,andtheDefendant,HenryBenjaminCousins(DOB:4/7/1985).WitnessAstatedthatdefendantwas
agitatedanddemandedthatVictimAcomeworkonhiscar,asVictimAoweddefendant$600.WitnessA
statedthatdefendantdidcalmdownandshethoughteverythingwasfine,butthatdefendantgotamped
upallofasudden,pulledoutagunandshotVictimA.WitnessAstatedsheheardoneshotclosetoher
head,turnedandsawVictimAgrabbinghischest,andsawhimfall.WitnessAstatedthatdefendant,K.B.
andA.N.immediatelyranaway.

OfficersspokewithWitnessB,anidentifiedmale.WitnessBstatedthatheknowsVictimA,andthat
VictimAwasthereworkingonhisfoodtruck.WitnessBstatedthatK.B.calledhimtoaskifVictimAwas
there,andstatedshewantedtocometalktohim.WitnessBstatedthatshortlyafter,K.B.cametothefood
truckwithdefendantandA.N.Whentheycameintothefoodtruck,defendantbegantoyellthatVictimA
owedhim$600.WitnessBstatedthatdefendanttoldVictimAtogooutsidethefoodtruck.WitnessB
statedheheardacommotionsohewentoutsideandthedefendantwasactingcrazy.WitnessBstated
thatthedefendantsteppedinfrontofhimtowardVictimA.WitnessBthenheheardagungooff,looked
backandsawthatVictimAhadbeenshot.

OfficersspokewithK.B.whostatedthatdefendantisherhusbandscousin,andheaskedhertocall
WitnessBtofindoutwhereVictimAwasatthemoment.K.B.statedthatshedrovedefendanttowhere
VictimAwas,alongwithherdaughter,A.N.K.B.statedshedidnotknowthatdefendanthadagunwith
him.K.B.statedthatoncetheygotthere,defendantbegantostatethatVictimAowedhimmoneyandthen
allofasuddensheheardapoppingsound,andthenshesawVictimAfall.K.B.statedthatshe,A.N.and
defendantranbacktohercarandleft.K.B.statedoncetheywereallinthecar,defendantwascryingand
saidhedidntmeanforthattohappen.K.B.droveashortdistanceandthendefendantgotoutofhercar
andranoff.

OfficersspokewithA.N.whostatedshehadbeenstayingwithdefendantforawhileuntilshecouldfindher
ownplaceafterrecentlymovingtotheTwinCities.A.N.statedthatK.B.calledWitnessBbecause
defendantsaidthatVictimAowedhimmoneyandwantedtogotalktohimaboutfixingdefendantscar.
A.N.statedthatshortlyaftertheyarrived,defendantstartedtosnapatVictimAandtheywereyellingat
eachotherandthenallofasuddentherewasagunshot.A.N.statedsheturnedaroundandsawVictimA
bleedingandthenfall.A.N.statedshe,K.B.,anddefendantallrantothecarandthatdefendantstatedthis
wasntsupposedtohappenandIjustwantedhim(VictimA)tofixmyshit.A.N.statedthatdefendant
jumpedoutofthecar.

Inapost-Mirandainterview,DefendantadmittedthatheaskedK.B.tocallaroundtofindVictimA,andthat

whentheyfoundhim,K.B.drovehimto47thandLyndale.Defendantadmittedthathebroughtagunwith
himinhispocket.DefendantstatedthathewastiredofthewayVictimAwastreatinghimlikeabitchand
hewantedtobeinchargeforonce.DefendantstatedthatVictimAowedhimabout$700forworkVictimA
hadnotcompletedonthreecars.Defendantstatedthatoncetheygotto47thandLyndale,thingsgot
heatedbetweenhimselfandVictimA,andDefendantpulledouthisgun.Defendantstatedthatheis
shorterthanVictimA,butthathewantedtohitVictimAintheheadwiththegun.Defendantclaimedthat
whenheswungthegunuptohitVictimAinthehead,thegunwentoff.DefendantstatedhesawVictimA
falltotheground,andhethenrantoK.B.scarandhadherdrivehimseveralblocksawaywherehegot
out.Defendantstatedthegunwasanautomatichandgun,possiblya9mm.Defendantstatedhetooka
"hood"UbertoInverGroveHeightsandthrewthegunintotheMississippiRiver.Defendantclaimedthathe
didnotmeantoshootVictimA.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest
