Greg,
Chuck Johnson did send me a document as he promised at yesterday's Public Works/
Zoning
Committee. There are some curious things about the document, though. First, it
is unsigned.
The signature block indicates that this document was created by Glen Couvillion,
however, Mr.
Couvillion's signature is not on the document. I am still waiting for Mr. Johns
on to locate the
signed original and provide me with a copy of that document. The other curiousi
ty is that the
final sentence of the letter actually offers legal advice to Mr. Gravel. Why wo
uld the author of
this letter, ostensibly a city employee, seek to give legal advice to Mr. Gravel
? It seems that the
city could get into trouble if it were to offer incomplete or incorrect legal ad
vice. Instead of
offering legal advice to Mr. Gravel, I suggest that the author of the letter wou
ld have done better
to include a reference to section 28-6.9.C of the city code (linked from the cit
y's website) which
states the following:
C. Violation and penalty: Violation of the provisions of this chapter or fail
ure to comply with
any of its requirements, including violations of conditions and safeguards estab
lished in
connection with grants of variances or special exceptions, shall constitute a mi
sdemeanor. Each
day such violation continues shall be considered a separate offense.
Finally, I'm including a timeline of the events on 1795 Albert:
December 16, 2009 - The Kay Michiels Letter.
July 26, 2010 - E-mailed Kay Michiels about 1795 Albert and Glen Couvillion abou
t White
Street.
July 28, 2010 - E-mailed Chuck Johnson after informed by Glen Couvillion that Mr
. Gravel's
issue was remanded to the city attorney.
August 6, 2010 - (still no word from the administration) Contacted Roosevelt Joh
nson and Harry
Silver asking for assisstance.
August 10, 2010 - On advice of Messrs. Johnson and Silver, make second attempt t
o get help
from Administration (Michiels and Johnson).
August 18, 2010 - Received letter from Mr. Silver that Mr. Gravel's property is
"in litigation"
and he can offer no further assistance to me. Mr. Silver makes no mention of wh
ich of the two of
Mr. Gravel's properties is actually in litigation.
August 24, 2010 - Made public comments at Mr. Lawson's Public Works/Zoning Commi
ttee.
August 25, 2010 - Chuck Johnson produces an unsigned letter, dated August 13, 20
10 and
attributed to Glen Couvillion.
Please note that Mayor Roy's administration could have provided answers to me we
ll before the
August 24th council meeting. Also, note that Chuck Johnson tried to make me go
away by
telling Mr. Silver to tell me that the matter was in litigation. Chuck Johnson
admitted yesterday
that it was not in litigation. Also note that neither Chuck Johnson nor Kay Mic
hiels has made
any attempt to address my questions about the White Street property and I am sti
ll waiting. Had
Mr. Lawson not recognized me to speak at yesterday's meeting, Chuck Johnson woul
d have been
successful at perpetuating the "cloak of silence" that protects Mr. Gravel's non
-compliant
activities. Hopefully, we'll get an honest account of what has happened and fin
ally bring Mr.
Gravel's properties into compliance with city code.
