PROVIDINGFORTHEPUBLICATIONOFLAWSEITHERINTHEOFFICIALGAZETTEORINANEWSPAPER
OFGENERALCIRCULATIONINTHEPHILIPPINESASAREQUIREMENTFORTHEIREFFECTIVITY

WHEREAS, Article 2 of the Civil Code partly provides that "laws shall take effect after fifteen days following the
completionoftheirpublicationintheOfficialGazette,unlessitisotherwiseprovided..."

WHEREAS,therequirementthatforlawstobeeffectiveonlyapublicationthereofintheOfficialGazettewillsuffice
hasentailedsomeproblems,apointrecognizedbytheSupremeCourtinTaada.etal.vs.Tuvera,etal.(G.R.No.
63915,December29,1986)whenitobservedthat"[t]hereismuchtobesaidoftheviewthatthepublicationneed
notbemadeintheOfficialGazette,consideringitserraticreleaseandlimitedreadership"

WHEREAS,itwaslikewiseobservedthat"[u]ndoubtedly,newspapersofgeneralcirculationcouldbetterperformthe
function of communicating the laws to the people as such periodicals are more easily available, have a wider
readership,andcomeoutregularly"and

WHEREAS,inviewoftheforegoingpremisesArticle2oftheCivilCodeshouldaccordinglybeamendedsothelaws
to be effective must be published either in the Official Gazette or in a newspaper of general circulation in the
country

NOW,THEREFORE,I,CORAZONC.AQUINO,PresidentofthePhilippines,byvirtueofthepowersvestedinme
bytheConstitution,doherebyorder:

Sec. 1. Laws shall take effect after fifteen days following the completion of their publication either in the Official
GazetteorinanewspaperofgeneralcirculationinthePhilippines,unlessitisotherwiseprovided.

Sec.2.Article2ofRepublicActNo.386,otherwiseknownasthe"CivilCodeofthePhilippines,"andallotherlaws
inconsistentwiththisExecutiveOrderareherebyrepealedormodifiedaccordingly.

Sec.3.ThisExecutiveOrdershalltakeeffectimmediatelyafteritspublicationintheOfficialGazette.

DoneintheCityofManila,this18thdayofJune,intheyearofOurLord,nineteenhundredandeightyseven.
