JUDICIAL AFFIDAVIT

I, NOEL L. MONTAEZ, Filipino, 29 years old, single and a resident of

Paquibato District, Davao City, after having been sworn in accordance with
law hereby deposes and states the following:

I, NOEL L. MONTAEZ, am one of the accused/witness in the above-

captioned cases.

I am answering the questions asked of me by Atty. Joahna Paula Q.

Domingo, fully conscious and aware that the same is under oath and that I
may face criminal liability for false testimony and perjury.

OFFER OF TESTIMONY

The testimony of this witness, as the accused in this case, your Honor,
is being offered to prove what happened on the night of the stabbing,
before, during and after. He will tell this court that he was stabbed first by
the deceased which stabbing bore a hole on the left side of his rib cage. He
will relate the material circumstances to establish the motive of the
deceased attacker. He will show to this Honorable Court the relevant matters
relating to the unlawful aggression, on the part of the deceased. He will
further elucidate the circumstances showing no sufficient provocation on his
part and the necessity of the means he employed to prevent or repel what
he reasonably believed to be a fatal attack against his person.

A1 : Akusado ko ani nga kaso, Maam.
(I am the accused in this case, Maam.)

A2: Naa ko sa atubangan sa Arguillas Pharmacy.
(I was in front of Arguillas Pharmacy.)

Q3: Nganong naa man ka didto nga lugar sa atubangan sa Arguillas

Pharmacy?
(Why were you there in front of Arguillas Pharmacy?)
A3: Nag-torno ko sa akong pampasahero nga single nga motor maam kay
didto man naga torno ang mga pampasahero nga single kay daghag
pasahero didto.
(I was waiting for my turn to board passengers on my single motorcycle
because that is where there are many passengers.)

Q4: Unsang oras ka niabot didto sa Arguillas Pharmacy?

(What time did you arrive at Arguillas Pharmacy?)
A4: Niabot ko didto mga alas 10 sa gabii Maam.
(I arrived at around 10 oclock in the evening Maam.)

Q5: Asa man ka dapit sa Arguillas Pharmacy naghulat ug pasahero?

(Which part of Arguillas Pharmacy were you waiting for ?)
A: Sa tungod gyud mismo sa Arguillas Pharmacy sa may highway
(Right where Arguillas Pharmacy is located at the highway.)

Q6: Unsay ginabuhat nimo samtang nagahulat ka ug pasahero?

(What were you doing while waiting for pasengers?)
A6: Naglingkod lingkod sa akong motor tapos gitawag ko sa tabok.
(I was sitting on my motorcycle when I was called from across the street.)

Q7: Kinsa ang nagtawag sa imoha sa tabok?

(Who was the one who called you from across the street.)
A7: Akong kaila nga pareha nako tig-baligya pud ug prutas sa adlaw.
(A person I know of to also be like me, who is a seller of fruits during day
time)

Q8: Kinsa man ni imong kaila nga tig-baligya ug prutas kung adlaw, amigo
nimo ni?
(Who is this person who is your fellow seller of fruits during day time, is he
your friend?)
A8: Nailhan lang nako ni sya nga gitawag ug Badjao, dili mi amigo gyud,
kaila lang kay kauban mi gabaligya ug prutas.
(I only know him by the name Badjao, were not really friends, only an
acquiantance since we sell fruits together.)

Q9: Unsa imong gibuhat human ka niya gitawag?

(So what did you do after he called you?)
A9: Nangutana ko ngano.
(I asked him why?)

Q10: Unsa iyang tubag sa imong pangutana?

(What was his answer to your question?)
A10: Gitawag ko niya nga patabokon kay naa sya sa tabok sa dalan.
(He called me to go over to him across the street.)

Q11: Unsa imong gibuhat human ka niya gitawag patabokon sa pikas?

(What did you do after he called you to go over to him across the street?)
A11: Nitabok ko paadto sa iyaha.
(I crossed the street getting over to him.)

Q12: Nganong nitabok man ka?

(Why did you cross the street to get over to him?)
A12: Gi-isip nako naa syay ingnon sa akua tungod sa among mga prutas
nga baligya
(I thought he wanted to say something to me about the fruits that we were
selling.)

Q13: Unsay nahitabo pag tabok nimo?

(What happened after you crossed the street?)
A13: Nakita nako ang dati nga kapuyo sa akong asawa-asawa nga
nagabaligya ug durian didto sa tabok kauban ni Badjao, katong nitawag sa
akoa.
(I saw the ex-live in partner of my common law spouse selling durian across
the street together with Badjao, the one who called me to go over him
across the street.)

Q15: Unsa imong gibuhat pagkakita nimo sa dati nga kapuyo sa imong
asawa?
(What did you do when you saw the ex-live in partner of your common law
spouse?)
A15: Mutalikod na unta ko kay mubalik na lang unta ko sa akong motor.
(I almost turned around to go back to where my mortorcycle was.)

Q15: Nganong unta mutalikod ka para mubalik sa imong motor nga gitawag
man ka sa imong kaila?
(Why did you almost turn around to go back to where your motorcycle was
when you were called by your acquaintance?)
A15: Unta lang kay wala man nadayon kay mutalikod na unta ko aron
muiwas unta ko kay nasuko man ning tawhana sa akoa sukad gibilin sya sa
akong asawa para mag-uban na mi.
(Almost only because I was not able to turn around when I was supposed to
to avoid this man who is angry at me since my common-law wife left him for
me.)

Q16: Unsay nahitabo sa dihang mutalikod na unta ka?

(What happened when you almost turned around?)
A16: Niduol sya padulong sa akoa dala ang hinagiban nga pang-abri niya ug
durian.
(This man went to me carrying the bolo he was using to open the durian
fruits he was selling.)

Q17: Unya unsay nahitabo pagduol niya sa imoha?

(What happened after he came to you?)
A17: Gi-dunggab ko unya nilikay ko pero nadunggaban gihapon ko niya sa
akong wala nga kilid.
(He stabbed me and I tried to avoid it but he was still able to stab me at my
left side.)

Q18: Asa dapit sa imong wala ka niya nadunggaban?

(Where particularly in your left side did he stab you?)

A18: Diri sa akong kilid sa wala, sa taas banda sa akong hawak sa may ribs.
(Here at my left side, above my waist, at my ribcage.)

Q19: Gi-unsa nimo pagkabalo nga nadunggaban na ka niya diri sa imong

wala nga kilid?
(How did you know that he already stabbed you at your left side?)
A19: Nisakit akong wala nga kilid unya nakita nako ang daghang dugo
nilapos sa akong t-shirt sa wala dapit.
(I felt the pain in my side and I saw that I was already bleeding through my
shirt on my left side.)

Q20: Unsa imong gibuhat paghuman niya ug dunggab sa imoha?

(What did you do after he stabbed you?)
A21: Gisagang nako iyang isa pa unta ka dunggab gamit akong kamot nag-
iloganay mi sa hinagiban, nabaliktad nako ang hinagiban padulong sa iyaha
ug akong gitulak sa iyaha palayo sa akoa.
(I tried to block off his attempt to stab me again using my hands, we
struggled for the bolo, I was able to invert it and I pushed it toward him as I
tried to push him away from me.)

Q20: Unsay nahitabo paghuman nimo gitulak sa iyaha ang hinagiban palayo
sa imoha?
(What happened after you pushed the bolo toward him, away from you?)
A20: Nakita nako nga duguan na pud sya, natumba sya paatras pagtulak
nako ug gibuhi-an nako sya kay niduol na ang iyang mga kauban nga
tigbaligya ug durian padulong sa akoa ug nidagan ko sa akong motor.
(I saw that he was also bleeding, he fell when I pushed him away and I let
go because I saw the others who were also selling durian go towards me and
I ran to where my motorcycle was.)

Q21: Unsa imong gibuhat pag abot nimo sa imong motor?

(What did you do when you reached your motorcycle?)
A21: gi-drive nako paadto sa akong asawa kay mangayo kog tabang sa
akong samad sa kiliran kay basa na kaayo ko ug dugo.
(I drove it to where my wife was to ask for help with the wound on my left
since I was already wet with blood.)

Q22: Asa nimo gi-adto imong asawa?

(Where was your wife?)
A22: Sa among balay sa unahan lang gikan asa ko nadunggaban.
(At our house nearby the place where I was stabbed.)

Q23: Unsa kalayo sa inyong balay, sa metro, gikan sa lugar kung asa ka
nadunggaban?
(How far was your house from the place, in meters, from where you were
stabbed?)
A23: Mga singkewnta ka metro lang gikan sa kung asa ko nadunggaban
hantod sa balay.
(About 50 meters from where I was stabbed to the house.)

Q24: Unsay nahitabo pag-abot nimo sa inyong balay?

(What happened when you reached your house?)
A24: Gitabang ko sa akong asawa ug gidala sa Regional Hospital.
(My wife rushed me to the Regional Hospital)

Q25: Unsay nahitabo sa Regional Hospital?
(What happened at the Regional Hospital?)
A25: Gisakay mi sa ambulansya ug gipadala sa Davao Regional Hospital.
(We were taken by an ambulance to Davao Regional Hospital.)

Q26: Naa kay Medical Report gikan sa maong hospital aning nahitabo sa
imoha?
(Were you able to secure a medical report from the said hospital on the
incident that happened to you.)
A26: Naa maam.
(Yes, I have maam.)
