In Re: AUTHORIZATION TO ENGAGE IN THE PRIVATE PRACTICE OF


PROFESSION

WHEREAS, Section 7, Paragraph b(2), of the Code of Conduct and Ethical Standards
for Public Officials and Employees (R.A. 6713) allows public officials and employees to
engage in the private practice of profession provided they are authorized by the Constitution
or by law;

WHEREAS, the Civil Service Commission (CSC) has issued a policy as regards the
practice of profession as embodied in Resolution No. 011096 dated June 29, 2011;

WHEREAS, Memorandum Circular No. 17 dated September 4, 1986 of the Office of


the President states that the authority to grant permission to any official or employee shall be
granted by the head of the ministry or agency in accordance with Section 12, Rule VIII of the
Revised Civil Service Rules and Regulation;

WHEREAS, under Section 18, Rule XIII on Prohibitions of the Revised Rules on
Appointment and other Personnel Actions states, inter alia that no officer or employee shall
engage directly or indirectly in any private business or profession without the written
permission from the head of the agency;

WHEREAS, the City Government recognizes the huge disparity in the income of
government lawyers as compared to those employed in the private sector, hence, it is one of
the factors why there is dearth of lawyers who are willing to work and stay for the
government;

WHEREAS, allowing the lawyers of the City Government of Catbalogan to engage in


the private practice of profession is one way by which their income may be augmented,
thereby encouraging them to stay in the government;

NOW THEREFORE, foregoing premises considered, and by virtue of the powers


vested in me by law, I, ____________________City Mayor of ___________do hereby
authorize ATTY. to engage in the private practice of the legal profession, subject however, to
the following limitations:
1. It shall not be in representation of a client whose cause of action is against the City
Government of Catbalogan;

2. It shall not entail any conflict of interest insofar as the functions of his office in
concerned;

3. It shall not involve the use of government funds or property; and

4. It shall not impair the lawyers efficiency in the discharge of his regular functions in
the office, and absences incurred, if any, shall be covered by the duly approved
vacation leaves or pass slips.

This Order shall be effective until revoke.
