Facts of the case

(Incidents of dowry death, as per National Crime Records Bureau 2012)

The case suggests the happening of a suicide of a young bride after prolonged harassment. The
maltreatment, repeated taunts and mental torture ensued out of dowry demands. It seems there
was importunate demands for dowry after the in-laws saw that the sister of the deceased brought
3 lacs of cash and a car. There was a similar demand of dowry
Brij lal prem chand and state of Punjab v Prem Chand, 1989. 447 : Conviction restored.

Issue: Whether there is sufficient ground to convict the accused as per section 304-B, IPC, or the
accused will be convicted under section 306, IPC for abetment of suicide along with section
4998-A of IPC?
Rule:
1: If the death of a woman occurs otherwise than under normal circumstances within seven years
of marriage and it is evident that she was subjected to cruelty for, or in connection with marriage,
then such death shall be called dowry death. The punishment for this offence will not be less
than 7 years.
