A. Summarize the cause/s of violence

The domestic violence event of January 18, 2016 is one of many abusive episodes

resulting from his rage and controlling behavior throughout the marriage. Among others

are cases of Domestic violence assault and domestic terrorizing.

B. Would you recommend legal separation for the couple? Why or why not?

Personally, yes I would highly recommend legal separation because this case is

a\obviously not a healthy relationship anymore, for both of them and especially their

children. While other people may think that legal separation is immoral, I believe that this

is a right and choice that we all deserve if the terms and reasons are valid.

Amber Heard, 30, was granted a temporary restraining order against her

estranged husband Johnny Depp. The actress submitted a photo, reportedly from

Saturday, of a large bruise around her eye as evidence he hit her. Heard claims Depp

offered to buy her silence but she instead made the decision to file for divorce two days

later. Heard has claimed cocaine and booze turned Depp into a violent monster, and in

court documents she states she was the victim of multiple domestic incidents during

their 15-month marriage

B. Would you recommend legal separation for the couple? Why or why not?

Yes, I would highly recommend legal separation because I personally believe that no one

deserves to be in a relationship fearing the other. As someone who comes from a family who

also experiences domestic violence, I can say that this type of relationship greatly affects the

whole family, especially the children. And the longer this type of issue is ignored, the more it

worsens.

II. Interview a lawyer who has handled an annulment case.

a. Is annulment easy to get? Why? Why not?(Include cost, time, etc.)

This is a difficult question, primarily because there are so many variations. If you have absolutely limited

resources, you could file the petition as a pauper litigant (for filing fees) and seek free legal aid (discussed

below). If you engage the services of a private lawyer, the entire process may cost you at least Fifty Thousand

Pesos (PhP50,000).

Are Filipinos ready or acceptable of the concept of annulment? Why or why not?

This is a personal decision that should not be taken lightly. While divorce is not allowed in the Philippines, the

fact that the law provides for annulment means that there are meritorious instances that would justify the

annulment of marriage.

b. Why is divorce still unacceptable in the Philippines?

Some Filipinos want and do get married outside the Philippines. Theres nothing really strange with this,

except when they say that the reason is for convenience in getting a divorce abroad. This is strange for two

main reasons:

1. Divorce is not recognized under Philippine laws. If youre a Filipino, it doesnt matter where you get a

divorce: such divorce is invalid/void in the Philippines. This is because under the nationality principle (Art. 15,

Civil Code), all Filipinos where they may be in the world are bound by Philippine laws on family rights and

duties, status, condition, and legal capacity.

2. Marriage is supposed to be forever. From an idealistic non-legal standpoint, the sole reason for marriage

should be love; the kind of love that transcends time and withstands any impediments that life throws our way.

From a legal perspective, on the other hand, no less than the Philippine Constitution (Art. XV, Sec. 2) and

the Family Code(Art. 1) expressly characterize marriage as the foundation of the family and an inviolable social

institution.
