INVESTIGATIVE REPORT
On December 13, 2016, the Miami Police Department (MPD), requested the assistance of the
Florida Department of Law Enforcement (FDLE), Miami Regional Operations Center (MROC) in
regards to eleven (11) City of Miami issued revolvers missing from the property unit.

Major Jose A. Rodriguez, Internal Affairs (IA) Section, advised that sometime in August 2016,
members/employees of the MPD were in the process of clearing out a cargo container
somewhere near the north parking lot of the police auto pound. Upon doing so, eleven (11)
weapons with live ammunition were discovered. IA was contacted reference the incident and
weapons were turned over to the property unit. A few months later, sometime during October
2016, it was discovered by IA that the weapons were missing from the property unit.

FDLE has agreed to take the investigation over. All reports/documents have been requested
from the MPD.

INVESTIGATIVE REPORT

On December 13, 2016, the Miami Police Department (MPD), requested the assistance of the
Florida Department of Law Enforcement (FDLE), Miami Regional Operations Center (MROC)
regarding eleven (11) City of Miami issued revolvers missing from the property unit.

On December 27, 2016, Special Agent (SA) Edward Waters met with MPD Detective (Det.)
Wanda Jean-Baptiste. Det. Jean-Baptiste turned over a copy of her case file. The case file
included:

MPD incident report # 234887, documenting the discovery of the guns on August 4, 2016
in the blue cargo container #3000442210, located in the north parking lot across the street
from the police auto pound, and the hand over to the property unit.
MPD incident report # 323773, documenting the information received on October 13, 2016
that 11 revolvers were missing from the property unit.

On December 13, 2016, the Miami Police Department (MPD), requested the assistance of the
Florida Department of Law Enforcement (FDLE), Miami Regional Operations Center (MROC)
regarding eleven (11) City of Miami issued revolvers missing from the property unit.

On January 19, 2017 Special Agent (SA) Wellinghoff obtained the case file from SA Waters.
On January 20, 2017, SA Wellinghoff and SA Mosquera met with SSA Dweck and were briefed
on the facts of the case. SA Wellinghoff began reviewing the case file and made contact with
the lead Internal Affairs investigator, Detective Wanda Jean Baptiste. Detective Jean Baptist
was advised that SA Wellinghoff would be investigating this case and she was provided with his
contact information.

On December 13, 2016, the Miami Police Department (MPD), requested the assistance of the
Florida Department of Law Enforcement (FDLE), Miami Regional Operations Center (MROC) in
regards to eleven (11) City of Miami issued revolvers missing from the property unit.

On February 2, 2017, Special Agent (SA) Dean Wellinghoff responded to the Miami PD's
Internal Affairs office and met with Lt. Oriel Tameron. Lt. Tameron provided SA Wellinghoff with
a laptop and computer mouse that was seized by Miami PD investigators from retired Major
Chavez's office. The computer and mouse were impounded by SA Wellinghoff and transported
to FDLE's Miami Regional Operations Center for further investigation.

On February 3, 2017, the property was released to FDLE Evidence Custodian Meaghan
Quigley for storage pending release to an FDLE investigator for forensic imaging.

Copies of the property receipts from Miami PD and FDLE as well as FDLE Custody
Receipts are included as related items with this investigative report and labeled as INV 2.

On Monday, February 20, 2017, Special Agent (SA) Dean Wellinghoff provided Special Agent
Supervisor (SAS) Robert LeFiles with a routine investigative update regarding the captioned
investigation of 11 guns reported missing or stolen from the Miami Police Department's property
storage facility.

During the course of the update, SA Wellinghoff described that the Miami Police Department
documents he received from the former FDLE case agent contained multiple sworn interviews
conducted by Miami Police Department Internal Affairs investigators prior to FDLE opening a
criminal investigation. The Miami Police Department documents were documented as received
in Investigative Report #2 and labeled as Related Item #INV-1. SA Wellinghoff acknowledged
reviewing several of the internal affairs statements.

On Thursday, February 23, 2017, SAS LeFiles met with Assistant Special Agent in Charge
(ASAC) Chris Woehr and Regional Legal Advisor (RLA) Jackie Boswell (by telephone) to
discuss questions regarding the information provided by the internal affairs investigation. It was
decided that the documents should be forwarded to the FDLE Office of General Counsel for a
taint review and that the FDLE investigation should be reassigned to a Special Agent with no
prior awareness or involvement. It was also decided that SAS LeFiles would remain as the
case supervisor since SAS LeFiles had been out of state at the time that the case file had been
transferred to SA Wellinghoff and SAS LeFiles had not yet been briefed on details of the case or
any potential witnesses or subjects.

On the next day, Friday, February 24, 2017, SAS LeFiles packaged the documents and
provided them to SA Dan Mosquera for delivery to the FDLE Office of General Counsel in
Tallahassee. SAS LeFiles subsequently sent an email to Assistant General Counsel Jeff
Dambly advising him that SA Mosquera would deliver the documents Monday morning. The
email was copied to ASAC Woehr, RLA Boswell, and SA Mosquera.

On the same date, SAS LeFiles met with SA Mike Stein and explained that he would need to
assume the criminal investigation. SAS LeFiles provided SA Stein with an overview of the
concerns regarding internal affairs material previously provided to FDLE. SAS LeFiles
explained that until the taint review was completed; SA Stein would have to start his
investigation with only two newspaper articles and a copy of the Miami Police Department
offense incident report for the 11 missing or stolen guns. SAS LeFiles also confirmed to SA
Stein that nothing documented in the FDLE report writing system related to, or was derivative

On February 24, 2017, Florida Department of Law Enforcement (FDLE) Special Agent (SA)
Michael Stein was informed by FDLE Special Agent Supervisor (SAS) Robert LeFiles that he
would be assigned a criminal investigation relating to the discovery by the City of Miami Police
Department (MPD) of eleven (11) missing firearms from the MPD property and evidence
section.

On February 27, 2017, SA Stein returned a telephone call from MPD Retired Major Orestes
"Tico" Chavez relating to this investigation. Chavez requested to meet with SA Stein and
provide a voluntary statement relating to this investigation.

On March 1, 2017, FDLE Special Agent (SA) Michael Stein and Special Agent Supervisor
(SAS) Robert LeFiles met with Chavez at the FDLE Miami Regional Operations Center (MROC)
located at 1030 NW 111 Avenue Miami, Florida as part of the criminal investigation relating to
the missing firearms from MPD.

Chavez, who was represented by Michael R. Band, Attorney At Law, provided a recorded,
voluntary, sworn statement relating to this investigation. Below is a summary of Orestes
Chavez's statement:

Chavez stated that prior to providing this statement, he provided a compelled statement relating
to his knowledge in this matter to Internal Affairs Investigators at the MPD.

Chavez stated that he was the Police Major over the property and evidence section of the police
department. Chavez stated that he separated (retired) from the MPD as a Police Major on
September 23, 2016, after serving for thirty (30) years.

Chavez stated that upon retirement he remained with the police department as a Reserve
Police Officer. As a reserve police officer, Chavez stated that he was allowed to keep his police
uniform and issued equipment however; he never served in a reserve police officer capacity.
Chavez stated that the reason he did not serve as a reserve police officer was because he was
suspended by the police department as a result of the missing firearms in this
investigation. Chavez stated that per the Chief of Police he was also allowed access to his
office because his girlfriend is an actress and his office was used as a set for filming.

Chavez stated that he initially learned of the missing guns in this investigation approximately

two (2) or three (3) weeks after separating from the police department when he received a
telephone call from MPD Lieutenant Vincent Joseph Laricci.

Chavez stated that after learning that the guns were discovered in a container outside of the
police department, he observed the firearms outside of an area known as "the cage" within the
property room in the police department. Chavez stated that he was with MPD Sergeant Forbes,
and civilian employees he only knew as "Hanes" and "Evans". Chavez further stated that he
took pictures of the guns which were in a box and on a table outside of the "cage".

Chavez then stated that he had conversations with the Chief of Police regarding these guns and
the Chief stated that he was interested in purchasing a Colt revolver which he used when he
was a police explorer in the 1980's. Chavez stated that he did not remember seeing a Colt
revolver and that attempts to bring the guns to the Chief of Police never occurred due to the
Chief's schedule.

Chavez denied taking or having the missing firearms, or knowing the status of the firearms at
the time of this interview. Chavez provided two (2) digital images taken on August 16, 2016 of
revolvers he stated that he observed outside of "the cage".

A copy of Orestes Chaves' recorded interview and the digital photographs provided relating to

Michael Stein was informed by FDLE Special Agent Supervisor (SAS) Robert LeFiles that he
would be assigned a criminal investigation relating to the discovery by the City of Miami Police
Department (MPD) of eleven (11) missing firearms from the MPD property and evidence
section.

On March 6, 2017, at approximately 1320 hours, FDLE SA Michael Stein made telephone
contact with Tim Martinez relating to this investigation. SA Stein was provided with Martinez's
name and telephone number by retired MPD Major Orestes Chavez during Chavez's voluntary
statement on March 1, 2017. During Chavez's statement, SA Stein was informed that Martinez
was with Chavez as he cleared out his office at the MPD.

Upon speaking with Martinez on the telephone, Martinez confirmed that he assisted Chavez
clear out his office at the police department. SA Stein requested to meet with Martinez in an
effort to obtain a voluntary statement relating to his involvement in assisting Chavez clear out
his office at the police department however, Martinez declined to meet with SA Stein and stated
that he would not provide a voluntary statement relating to this criminal investigation.

On March 7, 2017, at approximately 1415 hours, FDLE SA Michael Stein made telephone
contact with MPD Police Lieutenant Vincent Joseph Laricci relating to this investigation. SA
Stein was provided with Laricci's name by retired MPD Major Orestes Chavez during Chavez's
voluntary statement on March 1, 2017.

During Chavez's statement, SA Stein was informed that Laricci informed Chavez approximately
two (2) or three (3) weeks after he retired from the police department that the guns in question
in this investigation were missing from the property and evidence unit at the MPD.

Upon speaking with Laricci on the telephone, Laricci declined to provide a voluntary statement
relating to his knowledge in this matter as it relates to the ongoing criminal investigation. Laricci
stated that he has provided investigators from the Internal Affairs Division of the MPD a
statement relating to this matter.

On February 24, 2017, Florida Department of Law Enforcement (FDLE) Special Agent (SA)
Michael Stein was informed by FDLE Special Agent Supervisor (SAS) Robert LeFiles that he
would be assigned a criminal investigation relating to the discovery by the City of Miami Police
Department (MPD) of eleven (11) missing firearms from the MPD property and evidence
section.

On March 9, 2017, at approximately 1414 hours, FDLE Special Agent (SA) Michael Stein
received a telephone call from Timothy Martinez regarding this investigation. Martinez advised
SA Stein that he wished to meet with him and provide a voluntary statement regarding his
involvement in assisting Orestes Chavez in clearing out his office at the MPD.

On March 13, 2017, at approximately 1134 hours, SA Stein met with Martinez who voluntarily
responded to the FDLE Miami Regional Operations center (MROC). Martinez provided SA Stein
with a sworn, recorded, statement relating to this investigation. Below is a summary of
Martinez's statement:

Martinez stated that Chavez is a close friend of his parents. Martinez stated that he works as a
film crew assistant and that Chavez is also involved in the entertainment / film industry. After
filming one evening, Martinez stated that Chavez requested that he assist him in clearing out his
office at the MPD.

Martinez stated that he followed Chavez to the police station and assisted in moving boxes from
Chavez's office which was located on the first floor of the police station. While moving boxes
from Chavez's office, to Chavez's vehicle, Martinez stated that he was stopped by two (2) police
officers. The officers then met with Chavez and the officers left.

Martinez stated that he did not see any firearms in any of the boxes that were moved and that
some of the boxes were closed. Martinez estimated that he was at the police department for
twenty (20) to forty five (45) minutes.

Martinez's recorded statement will be electronically maintained as a related item with this

On March 21, 2017, FDLE Special Agent (SA) Michael Stein responded to the MPD
Headquarters Building and met with MPD Major Dana Carr who oversees the property and
evidence section for the MPD.

Major Carr briefed SA Stein on how property and evidence is received and stored at the MPD.
Major Carr then provided SA Stein with a walk through of the property and evidence room at the
MPD Headquarters Building.

On March 22, 2017, at approximately 1300 hours, FDLE Special Agent (SA) Michael Stein
responded to the MPD Headquarters Building and met with MPD Property Manager David
Evans in an effort to obtain a sworn, voluntary statement relating to the facts surrounding the
missing firearms in this investigation .

Upon meeting with Evans and requesting to speak with him relating to this investigation, Evans
requested to meet with an attorney before providing a voluntary statement. SA Stein
provided Evans with a business card and requested that Evans contact SA Stein in the future if
he wished to provide a voluntary statement regarding this investigation.

responded to the MPD Headquarters Building and met with MPD Property Specialist Carlton
Haynes in an effort to obtain a sworn, voluntary statement relating to the facts surrounding the
missing firearms in this investigation .

Upon meeting with Haynes and requesting to speak with him relating to this
investigation, Haynes requested to meet with an attorney before providing a voluntary
statement. SA Stein provided Haynes with a business card and requested that Haynes contact
SA Stein in the future if he wished to provide a voluntary statement regarding this investigation.

On February 24, 2017, Florida Department of Law Enforcement (FDLE) Special Agent (SA)
Michael Stein was informed by FDLE Special Agent Supervisor (SAS) Robert LeFiles that he
would be assigned a criminal investigation relating to the discovery by the City of Miami Police
Department (MPD) of eleven (11) missing firearms from the MPD property and evidence
section.

On March 30, 2017, FDLE Special Agent (SA) Michael Stein and Special Agent Supervisor
(SAS) Robert LeFiles responded to the MPD located at 400 NW 2 Avenue Miami, Florida and
met with MPD Chief of Police Roldolfo Llanes regarding this investigation. Chief Llanes
provided a sworn, recorded statement regarding his knowledge of the missing firearms relating
to this investigation. Below is a summary of Chief Llanes's statement:

Chief Llanes stated that in August or September 2016, he received a telephone call from Major
Orestes Chavez who was in charge of the property and evidence unit and was informed that
several guns had been located in the police department that were used by the MPD Police
Explorer Pistol Team when the Explorers had a pistol team. Chief Llanes explained that in the
early 1980's he competed as a Police Explorer on the MPD Pistol Team.

Chief Llanes stated that he was informed by Major Chavez that he may be interested in the
guns as they may have been used by the pistol team in the 1980's. Chief Llanes informed Major
Chavez that the revolver that he competed with, was a blue, Colt Python. Chief Llanes also was
interested in a leather box however, Chief Llanes was informed that the box had deteriorated
and was disposed of.

Chief Llanes further stated that someone from the police department responded to his office
and showed him three (3) guns in an effort to determine if one of the guns was the one he used
on the pistol team in the 1980's. Chief Llanes stated that none of the guns he observed was the
one he used. Chief Llanes could not remember who the person was that brought the guns to his
office for him to see.

Chief Llanes stated that at some point in time he was informed by Assistant Chief Papier that
guns were missing from the property room. Chief Llanes instructed Chief Papier to search for
the guns and if they could not be found to notify the Internal Affairs Unit in an effort to determine
what happened to the firearms.

After explaining that FDLE was conducting an investigation relating to the missing guns from the
MPD, Sgt. Forbes informed SA Stein that he has provided a statement to investigators from the
MPD and he declined to meet with SA Stein relating to this investigation.

SA Stein requested that Sgt. Forbes contact him in the future if he had any information relating
to the missing firearms in this investigation.

On April 26, 2017, FDLE Special Agent (SA) Michael Stein met with MPD Internal Affairs
Detective Wanda Jean-Baptiste regarding this investigation. SA Stein returned the Dell Desktop
computer (serial number MPD9020prop1) impounded in this investigation by FDLE SA Dean
Wellinghoff to Detective Jean-Baptiste. Detective Jean-Baptiste signed a FDLE transfer receipt
along with an FDLE property receipt upon taking custody of the computer.

It should be noted that the desktop computer's hard drive was imaged and has been retained by
the FDLE Miami Regional Operations Center (MROC) Forensic Computer Unit. As of the writing
of this investigative report, SA Stein has not obtained nor has he reviewed any data that was
obtained from this computer.

A copy of the FDLE property receipts and the signed FDLE Evidence Disposal Authorization
Form (EDAF) will be electronically maintained as a related item with this investigative report.

would be assigned a criminal investigation relating to the discovery by the City of Miami Police
Department (MPD) of eleven (11) missing firearms from the MPD property and evidence
section.

Beginning on May 8, 2017, FDLE SA Michael Stein obtained and began to review the MPD
investigative case file which was returned from the FDLE "taint review". After reviewing the
case file and listening to the witness statements which were obtained from internal affairs
investigators from the MPD this investigation concluded:

On August 2, 2016, eleven (11) old MPD revolvers were discovered in a property container
located outside of the MPD Headquarters Building.
The discovery of the revolvers was documented by MPD personnel.
The revolvers were later placed into a secured "cage" located within the MPD property
room awaiting a scheduled evidence/property destruction date.
On September 27, 2016, a scheduled gun burn was conducted by the MPD however
incomplete documentation left the disposition/location of the eleven (11) old revolvers in
question.

A review of the MPD case file, along with interviews conducted by SA Stein, provided
inconclusive documentation to determine the status of the revolvers which are reported to be
missing from the MPD property room. Due to the lack of documentation by the MPD property
room, it cannot be determined if a crime (theft) was committed or if the missing firearms were
destroyed as planned or misplaced within the MPD property room.

The documents returned from the FDLE "taint review" will be maintained at the FDLE Miami
Regional Operations Center (MROC) as a related item with this investigative report. (INV 10)

On May 30, 2017, at approximately 0927 hours, FDLE Special Agent (SA) Michael Stein met
with MPD Internal Affairs Detective Wanda Jean-Baptiste relating to this investigation. SA Stein
returned a computer mouse which had been impounded as part of this investigation. Detective
Jean-Baptiste signed an FDLE Custody Receipt and took possession of the MPD computer
mouse.

A copy of the FDLE Custody Receipt and signed Evidence Disposal Authorization Form (EDAF)
will be electronically maintained with this investigative report. (INV 11)

The original Custody Receipt and EDAF will be placed in the evidence case file which will be
maintained as a related item at the FDLE Miami Regional Operations Center (MROC). (INV 12)
