-: LEASE - AGREEMENT:-

THIS LEASE AGREEMENT is made and executed at Gurgaon on this 1st day of
September. 2016,
- BETWEEN-
Mr. Pradeep Kumar Shrivastava S/O Late Sh. Janardan Prasad R/O H. No. 26,
Starwood Malibu Town, Gurgaon, Haryana. [Herein after called as the "LESSOR" the
party at the first part] which expression shall, unless it be repugnant the meaning and context,
thereof mean and include its successors in title
- AND –

Mr. Deepak Kumar S/O Mr. Kulveep Singh R/O – XXXXX (YOUR ADDRESS). (Herein
after called “Lessee” the party at the second part) which expression shall unless it be repugnant
the meaning and context thereof mean and include its successors in title and assigns.

WHEREAS the party at first part i.e. the Lessor is the owner of H. No. A – 123 (G.F), South
City 2, Sector 49, Gurgaon, Haryana, - and is desirous to give the said property on lease at a
monthly lease of Rs 25000/- (Rupees – Twenty Five Thousand Only/-) excluding maintenance
charges.

Whereas the lessee has agreed to take from the lessor on lease the aforesaid property for HIS
FAMILY (herein referred to as “leased premises” on the terms and conditions mentioned here
below:

AND WHEREAS the parties hereto are desirous of reducing the terms and conditions of the
Lease Agreement into writing.

NOW THEREFORE THIS AGREEMENT WITNESSETH AND IT IS AGREED BY AND


BETWEEN THE PARTIES AS UNDER:-

 That the area of the above referred H. No. A – 123 (G.F), South City 2, Sector 49,
Gurgaon, Haryana is 179.4 Sq. Yd.

 That the Lease Agreement in respect of aforesaid premises commenced with effect from
1st day of September 2016, and shall be valid for period of 11 Months i.e. from 1st
September 2016 to 31st July 2017. After 11 months the lease will continue at the sole
discretion of the lessor, at mutually agreed increment of 10% for the next 11 month and a
fresh lease deed will be entered in to for this purpose.
 That it has been agreed between the parties that the Lessee shall pay to the Lessor a rent
of Rs 25000/- (Rupees Twenty Five Thousand Only/-] excluding maintenance charges
per month in respect of the aforesaid premises, every month in advance, on or before
the 07th day of each English calendar month, towards the utilization of the premises.

 That in addition to the aforesaid rent referred herein, the Lessee shall pay a sum of Rs
50000/- (Rupees - Fifty Thousand Only/-). (equal to two months’ rent) to the Lessor,
and the aforesaid security deposit will be refunded by the lessor to the lessee without
interest on the expiry of or earlier termination of this agreement on or before the
possession of the said premises is handed over to the Lessor by the Lessee. The refund
will be done after deducting arrears, if any towards government electricity bill, generator
electricity bill, water charges and damages of the premised charges, if any.

 The “LESSOR”, hereby accepts the receipt of an interest free refundable security deposit
of Rs 50,000/- (Rupees - Fifty Thousand Only/-) by Cheque or Bank Transfer dated 1st
September 2016, from the LESSEE.

 In the event of the delay in refund of the said security deposit by the Lessee to the Lessor
after the expiry or termination of the Lease, the Lessee shall continue to be in possession
of the aforesaid premises without paying any compensation or rent in respect thereof,
until the security deposit is refunded by the Lessor to the Lessee.

 That the lessee shall be liable to pay enhanced charges of Rs 25,000/- per month apart
from the lease amount of Rs 25,000/-, if he fails to vacate the premises on expiry of the
agreement or expiry of the notice period as the case may be. The lessee will also be liable
for prosecution under the rent and lease agreement enforce at the cost and consequence of
the lessee only. The lessor will have the right to evict the lessee without recourse to the
court of law and lessee will be treated as a trespasser. In case any things belonging to
lessee are found lying in the said premises, the liability in the manner of any damage or
loss that may be caused to remove the same from the said premises will be borne by the
lessee.

 The lessee shall follow and adhere to all rules and regulations of the society, which are
prevalent and are common to all residents.

 That the Lessee shall use the premises for residential purposes only and for no other
purpose whatsoever by his bonafide family members only.

 That during the pendency of this Lease Agreement, if the Lessor needs to terminate this
Lease Agreement, then in that case Lessor shall give one month notice in advance to the
Lessee.

 That if during pendency of Lease Agreement Lessee wants to terminate this Agreement
then Lessee shall give one month notice or rent in lieu thereof to the Lessor
 That Lessee shall pay government electricity bill, generator electricity bill and water bills
and any other charges regularly from commencement of this agreement.

 Local taxes, charges such as, house tax, etc. shall be paid by Lessor only.

 That if at all due to any natural calamities such as earth quake, flood and also calamities
such as riots etc. the rented premises suffers any damage then the Lessor shall forthwith
repair the same at his (Lessor's) costs make the damaged portion good and shall not claim
anything from Lessee.

 That the Lessor shall be responsible for all major structural damages caused by natural
calamity. For electrical and plumbing repairs, the lessor shall be responsible for area
beyond the floor area of the lessee i.e. beyond the main fuse box of the floor and the
plumbing / sewage lines beyond the floor area.Inside the floor area, the maintenance
would be responsibility of the lessee and would be done at his cost and expenses.

 That during pendency of this agreement if at all any third person claims his right in rented
premises then in that case Lessor shall protect the interest of Lessee at his own costs.

 That Lessee shall not sublet the leased premises or its any part to any other third party.

 The lessee shall not make any alterations to the said premises or remove any door,
window, fixtures and fittings from the premises.

 That the Lessor shall give no objection and co-operation to the Lessee to have amenities
such as Telephone, DSL Internet, Cable TV, etc. in leased premises and in that case
Lessee shall do it at his own expenses. That after termination or end of Lease agreement
the Lessee shall at his own expenses remove such amenities and at that time Lessor shall
not object the same. Any damage to the premises will be made good by the lessee for
fixing/removing these amenities.

 That the Lessee shall permit the Lessor or his authorized agent to enter the said premises
for inspection and carrying out necessary repairs at reasonable hours of the day, with
prior appointment and consent of the Lessee.

 That the Lessor shall give possession of the aforesaid premises with all sanitary, electrical
and other fittings and fixtures in good perfect condition and in case of any defect in the
aforesaid fittings and fixtures (list attached as Annexure 1) at the time of taking
possession by the lessee that same shall be repaired/ replaced by the Lessor. The fixtures
shall be returned to the lessor by the Lessee in perfect working condition while handing
over vacant peaceful possession of the premises, subject to natural wear and tear. It is
agreed that at all times the judicial possession will be of the lessor.

 On the expiry of this Lease, the lessee shall surrender and deliver vacant and peaceful
possession of the said premises in a good and serviceable condition as they were at the
time of taking over, subject to natural wear and tear. The lessor shall be permitted to enter
into the said premises without hindrance and obstruction from the lessee and without
prejudice to the lessors right to recover the damages from lessee.

 That the money to be transferred to the account mentioned herein electronically every
month before 07th by the lessee.
