EXPLANATORY NOTE
‘This bill seeks to declare the certain portions of land in Barangay Combado,
Maasin City, Southern Leyte, into alienable and disposable lands.
‘There are certain arcas within the jurisdiction of Barangay Combado which are
still classified as timberland but which are being cultivated and made as residence by the
people therein. Task Force Combado, which was organized on September 1908 reported
that the final survey and inventory conducted on July 2001 disclosed that there are 170
houses established within an area of 16, 907.62 square meters. Thus, the Combado
Foreshore and Timberland Actual Occupants need their occupied lots converted into
alienable and disposable lands. It is in response thereto that this measure is being
Proposed.
It is well known fact that most of our lands, especially alicnable and disposable
lands, are already under private claims or ownership, thereby limiting available lands for
‘most of the poor who also deserve a land to call their own.
tis in this context that Barangay Combado has decided to explore the possibility
of reclassifying certain portions of its vast timberland into alienable and disposable for
the purpose of allocating it to its landless and homeless residents. Instead of allowing the
area to grow into a slum colony that may later provide problems in terms of sanitation,
Peace and order, Barangay Combado has decided to legitimize the occupancy of its
landless residents,
This timberland, once reclassified from alienable and disposable, shall be elizible
for titling to the actual occupants who have acquired, cultivated, and made considerable
investments to develop it into a productive land. Hence, the private sector shall become
active partners of the government in preserving the protected areas in Barangay
Combado,

AN ACT
DECLARING CERTAIN PORTIONS OF LAND IN BARANGAY
COMBADO, MAASIN CITY, SOUTHERN LEYTE, AS ALIENABLE
AND DISPOSABLE LANDS
Be u enacted by the Senate and House of Representatives of the Philippines in Congress
assembled:
SECTION 1. ‘The portions of timberland situated in Barangay Combado,
Maasin City, Southern Leyte, 1s hereby reclassified from timbetland to alicnable and
disposable land, more of less particularly described as follows

SECTION 2. The land Management Bureau shall cause the subdivision of the
lands so identified, and subject to the approval of the Secretary of Environment andNatural Resources, shall determine the areas of each lot, taking into consideration the
nature of land, the number or prospective applicants. and the purpose for which it shall be
utilized,
SECTION 3. The land so subdivided shall be distributed to the residents of
Barangay Combado who are members of the Combado Foreshore and Timberland Actual
Occupants Association, not otherwise disqualified by and law to own public lands and
who do not own any parcel of land in the Philippines nor a beneficiary of any of the
agrarian reform land distribution, Provided, further; That no person shall be entitled to
‘more than one lot: Provided, finally, that members of a family living under one household
shall be considered as one person.
SECTION 4. No property acquired by virtue of this Act shall, without the
consent of the Land Management Bureau, be sold, transferred, mortgaged, or otherwise
disposed or within a period of five (5) years from the date of the issuance of the
Centificate of Title, Any such sale of disposition made in violation hereof shall be null
and void.
SECTION 5, ‘The Department of Environment and Natural Resources shall issue
the necessary rules and regulations for the effective implementation of this Act.
SECTION 6. All laws, decrees, orders, rules and regulations or parts thereof,
Which are inconsistent within this Act are hereby repealed or amended accordingly.
SECTION 7. This Act shall take effect upon its approval,
