A pleasant evening everyone. As stated by our 1st speaker concurred by and


further supported by our 2nd speaker that CHR should be abolish because of
the redundancy of it purpose. Let me further expound this motion by
enlightening you with the practical reasons of its abolishment. Shall we start

1. The Commission on human rights has been accumulating a huge share


on our national budget where its function is already being exercise by
other government offices such as the public attorney office and
Philippine national police.

stating that Commission of human rights’ power is that it
may investigate, i.e., receive evidence and make findings of fact as regards
claimed human rights violations involving civil and political rights. But fact
finding is not adjudication, and cannot be likened to the judicial function of a
court of justice, or even a quasi-judicial agency or official. the power to
investigate and received evidence is mainly lodged to the judiciary and the
Philippine national police.

This redundancy of function of a government office cost the national


government roughly 600 million pesos every year. Which could be used in
other sectors

Accordingly, the Department of budget and management released the 2018


budget proposal of the CHR where it entailed that the department spends
187,007,00 for fee legal assistance which the Public Attorney’s office is
providing furthermore the investigation of human rights violation cost the
national government 318,719,000 which according to our 2st speaker
Commission for Human Rights in 2001, the Commission has received 457
reports of torture or ill-treatment cases yet Not one of those cases have
resulted in a conviction.

That is roughly 500 million pesos being wasted by our national government
excluding the operational expense of the commission.

2nd Status quo has proved that CHR is ineffective by cases concerning
violation on human right such as the Magindanao masaccare, war in marawi
, the kidapawan incident where many farmers died and many other cases
that were put to oblivion because of the neglect of duty of the commission.

In an Interview in head start a representative of The Commission Said that


they are not a primary a investigation in crimes involving human rights
violations the because the primary duty is lodge to the Philippine national
police and their purpose is to monitor if there are violations of human
rights..

Art 13 of the 1987 constitution sec 18 provides

Section 18. The Commission on Human Rights shall have the following
powers and functions:

(1) Investigate, on its own or on complaint by any party, all forms of


human rights violations involving civil and political rights;

Meaning the Commission on human rights has the power and discretion to
conduct investigation which may be useless or fictitious because as a
secondary investigating body their investigations may be without ground or
useless that is 318, 719,000 pesos put into trash by the government
pointless purpose of the commission.

Your honors the purpose of our constitution is to build a just and humane
society building a such should be tantamount to allocating our resources
wisely and one way of doing such is eliminating redundant offices.

several government agencies such as the PNP, PAO, NEDA and
judiciary.
