PETITION

Petitioner, Peter Sicat Culangot Jr., by counsel, respectfully


states that:

1. Petitioner is a Filipino citizen, of legal age, married and residing


at #555 Del Pilar St., Barangay Imus, Cabanatuan City where
he may be served with court processes, motions and
decisions;

2. Respondent herein are being sued in their official capacities


being the concerned agencies and official custodian of the
Certificate of Live Birth of the petitioner with office address at
the Office of the Civil Registrar ,City Hall Compound,
Cabanatuan City where they may be served with summons
and other court processes respectively.
3. Petitioner has been a bona fide resident of Del Pilar St.,
Barangay Imus, Cabanatuan City, Nueva Ecija since the year
1997, as evidenced by a Barangay Certification hereto
attached as “Annex A”.

4. Petitioner’s present name is PETER SICAT CULANGOT JR., as


evidenced by his Certificate of Live Birth hereto attached as
“Annex B”.

5. Petitioner is also know for the following aliases: (1) Pete, (2)
Pedro.

6. Petitioner is seeking to change his name because of the


following reasons:

a. The first name is utterly ridiculous.


b. The first name is causing him to be a laughing stock
of his peers.

7. Petitioner respectfully requests that his present name be


changed from PETER Sicat Culangot Jr. to CHANNING Sicat
Culangot.

8. This petition is not in any way filed with the purpose of


misleading the public or for any other fraudulent purposes
and has no intention in any way to prejudice public interest.

WHEREFORE, it is respectfully prayed that, after due notice


and publication in accordance with the Rules of Court, and
hearing, this Honarable Court adjudge the petitioner’s name of
Peter Sicat Culangot Jr. be changed to Channing Sicat
Culangot.

Other just and equitable reliefs are also prayed.

1. I am seeking for the change of my first name and caused this
complaint to be prepared;

2. I have read its contents and affirm that they are true and correct
to the best of my own personal knowledge;

3. I hereby certify that there is no other case commenced or


pending before any court involving the same parties and the
same issue and;

4. That should I learn of such case, I shall notify the court within five
(5) days from my notice.

RESOLUTION

This is a petition for change of name filed by the petitioner,


PETER SICAT CULANGOT, JR., to change his name to CHANNING
SICAT CULANGOT, JR. for being utterly ridiculous which cause him
to be a laughing stock among his peers.

STATEMENT OF FACTS:

The Petitioner was born on February 14, 1997, in


Cabanatuan City to the spouses Peter Sicat Culangot and
Thelma Sicat Culangot. Being the one and only child, and in his
father’s pursuit of immortality, petitioner was named after his
father, hence, the name Peter Sicat Culangot, Jr.

The petition is sufficient in form and substance. However,


such petition is filed in the wrong venue. It may be true that under
Rule 103, Section 1 of Rules of Court expressly stated that:

“A person desiring to change his name shall present


the petition to the Court of First Instance (now
Regional Trial Court) of the province in which he
resides, xxx”

However, the same has already been superseded by


Republic Act No. 9048 which provides that:

“SECTION 1. Authority to Correct Clerical or


Typographical Error and Change of First Name or
Nickname - No entry in a civil register shall be
changed or corrected without a judicial order,
except for clerical or typographical errors and
change of first name or nickname which can be
corrected or changed by the concerned city or
municipal civil registrar or consul general in
accordance with the provisions of this Act and its
implementing rules and regulations.

The change of name sought by the petitioner is not


substantial in nature. It does not alter status or citizenship of the
petitioner which can be effected without judicial order.
IN VIEW OF ALL THE FOREGOING, the Court finds the petition
devoid of merit for being filed in the wrong venue. The court ,
therefore, lacks jurisdiction. The court orders that the change of
name from Peter Sicat Culangot Jr. to Channing Sicat Culangot
Jr. be DENIED without prejudice to the filling of petition to proper
jurisdiction.

SO ORDERED.
