FACTS:
Accused was convicted for 3 counts of rape. The victim was 8 years old and her biological father

sleeping. Accused removed here shorts, licked her vagina and inserted his finger into it. The carnal
act was repeated several times. Until they’ve visit to the hospital for a check-up and the victim’s
mother discovered the rape.

RULING:
Yes. Since the victim was 8 years old when the rape was committed, the special aggravating
circumstance of minority will apply and will convert the crime to Statutory Rape for rapeing a
minor through Sexual Assault.
