ACCIDENT DESCRIPTION
(NARRATIVE)

Synopsis

On 01-05-2011 at approximately 0626 hours I was called to assist at the scene of a fatal commercial vehicle collision
that occurred on Interstate ten at mile post 309.5 west bound outside of Benson Arizona. Upon arrival, I assisted
Benson Highway patrol units by conducting a level one CVSA driver/vehicle inspection to determine compliance with
federal motor carrier safety regulations. All non compliance items and damage resulting from this collision are
documented on the driver/vehicle examination report (DVER) #AZ0221000049 . Additional information is included

Initial Observation

Upon arrival at the scene I observed a several patrol cars blocking the number two west bound lane. About a hundred
yards west from the scene I observed a white colored commercial vehicle with a box trailer sitting in the west bound
shoulder area facing west. I observed a covered body in the west bound number two lane with fatal injuries.
I approached the commercial vehicle and observed collision damage to the front right grill, front right bumper, hood,
radiator, and right side front fender. The driver of the commercial vehicle was not injured.

CMV Driver Information / Interview

The driver of the commercial vehicle was identified by a valid Texas class A Commercial driver’s license #16501330,
as Candelario Delgadillo Pina DOB: 08-29-1964. A license check was conducted on Mr. Pina and reveled it to be
current and valid out of his home state of Texas. Mr. Pina also provided a valid medical card which displayed no
restrictions. (See Copy)

Mr. Pina stated he was traveling westbound within the number two lane approximately seventy miles per hour when he
observed a person walking across the roadway towards the median from the west bound shoulder. Mr. Pina stated he
attempted to (swerve) avoid the pedestrian but could not and struck him in the number two lane. Mr. Pina then stated he
pulled to the west bound shoulder area and parked his commercial vehicle and exited and observed several other
vehicles hit the pedestrian. Mr. Pina stated he was wearing his seat belt at the time of the collision. Mr. Pina stated he
started driving this morning at midnite where he departed El Paso Texas heading to Phoenix Arizona. Mr. Pina stated he
had been off for the last seven days and this is his first trip back from vacation.
I observed Mr. Pina’s electronic log and obtained copies via fax to the Benson area office. I also obtained copies of his
registrations, bill of laden, and insurance cards. Mr. Pina advised he was loaded with electronic equipment.

Pedestrian Information

The pedestrian was identified by his social security card as Ronald Anthony Sughrue DOB: 04-04-1965 of Wichita
Falls, Texas. Mr. Sughrue sustained fatal injuries from the collision. Body placement and vehicle damage were the only
visible evidence of the point of impact.

Supplemental Inspection Data

The commercial vehicle was towed from the scene by Tim’s Wrecker Service of Benson. A detailed level one
inspection was conducted on the truck and semi trailer at Tim’s Wrecker service yard. Officer D. Morales #6836
assisted with the inspection. An inventory was conducted on the truck tractor and all items listed were consistent with
the driver’s statements.
No critical driver or vehicle violations were found prior to the collision. (Pre-Collision)
