Topic 1 Dealings and Registration of Dealings

Tutorial 01

1. What is the meaning of “dealings” under the National Land Code 1965?

2. Discuss briefly the procedure for presentation of registration of an instrument of


dealing. You may take example of any Borang for illustration.

3. With reference to the relevant cases, distinguish between the terms “registration”
and “presentation for registration”.

4. Discuss the roles of the Registrar / Land Administrator when effecting the
registration of an instrument of dealing.

5. (a) With reference to an instrument of dealing in the prescribed Form (i.e. Transfer
in Borang 14A), identify and briefly discuss all the relevant provisions of the
National Land Code 1965 related to all particulars mentioned in the prescribed
Form. Do the same exercise on your own for Charge in Borang 16A.

(b) Based on the brief facts stated below, attempt to fill in both Borang 14A and
16A accordingly. You may exercise your discretion to create additional facts
to complete the forms.

(i) A licensed developer company transfers a piece of land to a


Malaysian citizen for a monetary consideration.

(ii) A local company charges its landed property to Malayan Banking


Berhad to secure for banking facilities (fixed and overdraft) of RM2
million.

For the above exercises, you shall bring a copy each of Borang 14A and 16A
to the class.

6. The High Court in Island & Peninsular Development Bhd. & Anor v. Legal Adviser,
Kedah & Ors [1973] 2 MLJ 71 merely held that the power of correction under section
380 of the National Land Code 1965 may be confined only to errors or omissions made
by the registering authority.

How would your advice be to overcome / solve this mistake if it is committed by your
client?
