JUDICIAL AFFIDAVIT

I, CHESTER CASTANEOS, 35 years old, born on Cagayan de Oro City,

married to Jane Doe, employed as a professor at Xavier University- Ateneo de
Cagayan, after having been duly sworn to in accordance with law, hereby depose and
state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicial affidavits to serve as the direct examination testimony of the witness, on the
basis of which the adverse party may conduct their cross-examination on such a
witness, I hereby execute this judicial affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also
state that it was Pedro Delos Santos, investigator of City Prosecutor’s Office of
Cagayan de Oro City who conducted the examination of the undersigned affiant;

That conformably also with section 3 (c) thereof, I hereby state under the
pain of perjury that in answering the questions asked of me, as appearing herein
below, I am fully conscious that I did so under oath, and that I may face criminal
liabilities for false testimony or perjury;

AND UNDER OATH, AVERS THE FOLLOWING:

1. Q : What are the reasons why you are voluntarily came to this Office?
A : Because I want to file a case against Cora Angel, for the crime she
committed against me.

2. Q : If that is the case, can you tell us what is the crime she committed?
A : Yes, Sir. She committed theft.

3. Q : What did she stole from you?

A : My virgin Cola Sir, with a value of ten pesos.

4. Q : How did she stole the Virgin Cola from you?

A : We went out on February 1, 2018 to grab some drinks at Lifestyle
District. After having few drinks, she invited me to her apartment. When we
arrived at her apartment, I fell asleep because I was too drunk. But when I

 regained my consciousness, she already has my virgin cola. I asked her to spit
it out, but she refused to do so.

5. Q : How do you know Ms. Cora Angel?

A : She is a secretary at our Department in Xavier University.

6. Q : What is the nature of Ms. Cora’s employment?

A : She entertain the concerned of students and relay the same to us. She
also does some of our paper works and communication papers in behalf of the
Department and professors.

7. Q : Does she know some of your personal information?

A : Yes Sir. We have known each other since 2013, when I started working
at Xavier University and I learned to trust her.

8. Q : Do you always go out and drink?

A : Not really Sir. This was only the third time.

9. Q : Where does she live?

A : In Diamond Residences, Tomasaco Street, Cagayan de Oro City.

10. Q : Have you ever been there?

A : No Sir. It was my first time.

11. Q : Why did you come with her?

A : Because she invited me Sir, and because I was too drunk, I decided to
sleep shortly at her place so that I can feel better and drive myself home.

12. Q : How did you went to her apartment?

A : She drove my car Sir.

13. Q : Do have a habit of sleeping to another person’s house?

A : As far as I remember, it was the only time I slept in another’s house
because I was too drunk to drive Sir?

14. Q : Were you hesitant to come to her place when she invited you?
A : No Sir, she is my friend and a co-worker; I trusted her.

15. Q : Do you think she planned to steal your Virgin Cola?

A : Yes, Sir. As I said Sir, this was the third time we went out to have some
drinks, but that time, I was too drunk because she insisted to make me drink
more.

16. Q : How much did you drink?

A : We finished a bottle of Jack Daniels, but she stopped drinking before the
bottle was half empty, because according to her, she has a meeting for the day
after.

17. Q : Why did you finish the whole bottle by yourself?

 A : Because she insisted that I finish it Sir since she paid for it.

18. Q : For the meantime, I don’t have further questions, do you have any
statements to add or take away on this affidavit?
A : I don’t have Sir for the meantime.

19. Q : Were you threatened, promised or bribed to make these statements?

A : No Sir. I made it voluntarily with my own free will.

20. Q : Are you willing to sign this affidavit consisting of four (4) pages, to
certify that all the statements you made are true.
A : Yes, Sir.

CHESTER CASTANEOS BARANGY 1, POLICE STATION, Barangay 1, Cagayande
Oro City.
That I have faithfully recorded and translated into English language the
questions asked of him/her and the corresponding answers that he/she gave in
response to the questions asked;

Neither I nor any other person/s coached this witness-affiant regarding the
answers given by her.
