SYMBIOSIS LAW SCHOOL, PUNE

COMMON MOOT FOR: CONSTITUTIONAL LAW-II & LAW OF CRIMES I

INTERNAL ASSIGMENT-II (Mandatory)

II YEAR (SEMESTER-III) B.A/B.B.A, LL.B (ACADEMIC YEAR 2018-2019)

1. CONDUCTION OF MOOT

1.1. Date of the Moot: The Moot shall take place on the March 11, 2018 (Sunday) from
8.30 a.m. onwards.
1.2. Moot shall consist of 2 stages: Memorials Submission and Oral Pleadings.
1.3. Allotment of Sides: The students are allotted their sides according to their Roll Nos.
Appellant: All Students with Odd Roll nos. shall be representing the Applicant in the
present matter for both Oral Pleadings and Memorial Submission.
Respondents: All Students with Even Roll nos. shall be representing the Respondent in
the present matter for both Oral Pleadings and Memorial Submission.
1.4. Memorial Submission The participants are required to submit memorials on behalf of
Appellant or Respondents, as the case may be, to the judge just before the oral
pleadings.
1.5. Oral Pleadings: The participants are required to plead on behalf of Appellant or
Respondent, as the case may be.

2. MEMORIAL

2.1. Each student must prepare memorial on behalf of the party allotted to them according
to the Roll Nos.
2.2. The memorials are to be submitted to the Judges at the time of the Oral Pleading i.e on
March 11, 2018 (Sunday)
2.3. The memorial shall contain the Name & PRN of the participant.
2.4. The Cover Page of the Memorial must have the following color scheme:
Blue: Appellant Cover Page Red: Respondents Cover Page

2.5. The Cover Page of each Written Submission must contain the following information:
a) The Name & PRN should be mentioned on the upper right-hand corner.
b) The Name & Year of the Internal Component.
c) Name of the forum resolving the dispute.
d) Jurisdiction
e) The name of the Case / Parties
f) The party for which the Written Submission has been prepared.

2.6. The memorials must contain the following:


a) Cover Page; (max. 1 pg.)
b) Table of contents; (max. 2 pgs.)
c) List of Abbreviations; (max. 1 pg.)
d) Index of Authorities;
e) Statement of Jurisdiction; (max. 1 pg.)
f) Statement of Facts; (max. 1 pg.)
g) Issues Presented; (max. 1 pg.)
h) Summary of Arguments; (max. 2 pgs.)
i) Arguments in detail; (max. 15 pgs.)
j) Prayer (max. 1 pg.)

NOTE: The maximum page limit for the Ancillary pages is 14 pages and the Arguments
Advanced is 16 pages.

2.7. Legal Argument Limited to Pleadings Section


Substantive, affirmative legal argument or legal interpretation of the facts of the
Internal Component Problem must only be presented in the "Arguments Advanced"
section of the Memorial, including the Conclusion and/or Prayer for Relief (except
insofar as such argument may be summarized in the "Summary of Pleadings" or
anticipated in the "Questions Presented").

2.8. Index of Authorities


Each Memorial must include an "Index of Authorities." The Index must contain a list of
all legal authorities cited in any section of the Memorial (Cases, Books, Treaties,
Conventions, Legislations, and Articles etc.). The Index must include a description of
each authority adequate to allow a reasonable reader to identify and locate the authority

in a publication of general circulation. Include the page number(s) of the Memorial on
which each authority is cited.

2.9. Statement of the Facts


Statement of the Facts should be limited and concise to the stipulated facts in the
problem. Facts should be relevant and material facts. The Statement of the Facts should
not include unsupported facts, distortions of stated facts, argumentative statements, or
legal conclusions.

2.10. Summary of the Pleadings


Summary of the Pleadings should consist of a substantive summary of the "Pleadings"
section of the Memorial in brief and concise manner, persuasively stating the key
arguments with factual support. Do not include case laws or other legal authorities.

2.11. The Memorial shall be formatted according to the following specifications:


a) Typed on standard A4 size page.
b) Font type: Times New Roman.
c) Font size for body text: 12; the text of the written submission must have 1.5 (1.5
lines) spacing. Font size for the cover page may be 14 or 12.
d) Font size for footnotes: 10; text of footnotes should be single-spaced (1.0).
e) Margin: 1 inch margin on each side of the A4 size page. Quotations of sources of 50
words or more in any part of the memorial should be block quoted, indented and
must be in italics.
f) The participant should include Header and Footer in their memorials to the effect
that the Header should mention the full Name of the Internal Component and the
Footer should mention the side on whose behalf memorial is submitted along with
Page Number at Bottom of the Page.

3. METHOD OF CITATION OF AUTHORITIES

Participants should cite their legal authorities which they seek to place reference to in the
following manner. Citations may also conform to the current edition of The Bluebook: A
Uniform System of Citation (Harvard University, U.S.A.). When is a citation needed?
Whenever you quote directly from a source, make assertions about the law, or directly
paraphrase a legal source, you are expected to support your statement with a legal citation.

4. ORAL PLEADINGS

4.1. Date of the Oral Pleading: The Oral pleadings shall be held on March 11, 2018
(Sunday)
4.2. Time Limit
The speaker will be allotted 10 minutes.
a) Extension of Time at Judges' Discretion: Judges may, at their discretion, extend
Student’s oral pleading time beyond the stipulated Student’s oral pleading time.
b) Scope of Pleadings: A Student’s oral pleading are limited to the scope of the
Student’s Memorial submitted to the Judge on day of the pleadings itself. No
amendments to the said memo will be entertained.

NOTE: Participants will not be allowed to make any further oral argument after the
stipulated time.

5. MARKING SCHEME:

 The moot is out of 20 marks inclusive of the Oral Rounds and Written Submission.
 The students shall be marked out of 5 Marks for their Memorial (For marking criteria,
refer to 2.4 to 2.11 above)
 The students shall be marked out of 15 for their Oral Rounds as per the following
marking criteria:

a) Knowledge of the facts,


b) Proper and articulate analysis of the issues arising out of the facts,
c) Understanding of the international / national legal principles directly applicable to
the issues,
d) Ability to explain clearly international / national legal principles in general
adherence to the time allotted,
e) Knowledge and use of legal sources: treaties, custom, general principles of
international / national laws,
f) Ingenuity (ability to argue by analogy from related aspects of international/
national law,
g) Logic and reasoning,
h) Organization and clarity,
i) Persuasiveness &
j) Deference to the court.

6. SCOUTING

Participants are not allowed to interact with any other Participant any time after
their Pleadings and should leave the Venue after completion of the Rounds.

7. COPYRIGHT

7.1. Symbiosis Law School, Pune, shall have the right to assert copyright over the
memorials of the Participants and reserve the right to publish any memorial.

7.2. Further use and exhibition of these materials, electronically or otherwise, shall be the
exclusive right of Symbiosis Law School, Pune and they shall not be responsible for
any liability to any person for any loss caused by errors or omissions in this
collection of information, or for the accuracy, completeness, or adequacy of the
information contained in these materials.
