Installation Instructions for Lobestar® Shear/Mixer
Lobestar Mixing and Shearing Eductor Unit Model No.: V VE-U-6S with 6" Housing; 6" Nozzle
Insert and 6” Diffuser/Pressure Recovery Tube

Installation:
1. Survey piping. For maximum performance downstream of the Eductor, piping should have as
few elbows as possible; this should be taken into consideration when designing the piping
system and retrofitting older systems.
2. Downstream pipe should always be as large as or larger than the pipe diameter of the
MIXING EDUCTOR.
3. Maintain Minimum FT/HD.
4. Install the Eductor on a level flat surface.
5. Secure skid base to deck.

Installation Considerations:
1. Inspect the Alfa Laval Vortex Inc. equipment prior to installation, compare the equipment to
the drawings provided.
2. Check to see that the pressure side of the centrifugal pump is connected to the Nozzle end of
the Eductor.
3. The pipe or hose size should be as large as or larger than the model size of the Eductor.
Model V VE-U-6 has a 6" discharge. The downstream pipe must be 6" or larger.
4. Avoid placing obstructions in the downstream pipe. Valves, elbows or any reduction in pipe
diameter will cause a reduction in stream line flow and efficiency loss.
5. When installing elbows or valves in the downstream pipe, the first elbow or valve must be at
least (6) six pipe diameters from the discharge end of the Eductor. Example a 6” Eductor will
have a 36” extension before installing the first elbow or valve.
6. Verify that the pump chosen for this service is sized properly for the intended density of the
slurry, that it will deliver the minimum pressure energy required to maintain a high velocity
stream from minimum to maximum viscosity.
7. If installed, proper venting of the Surge Tank is required during Eductor operation, failure to do
so will cause low product induction and may cause the Surge Tank to collapse, it is critical that
the system have unobstructed vent piping sized properly to prevent a buildup of vacuum in the
Surge Tank.
8. All fasteners should be installed with an anti-seize compound to prevent galling of the
stainless steel components.
9. When installing Victaulic gaskets always thoroughly clean them. Spray them with WD 40 (or
equivalent) after cleaning and prior to installation.
10. Make sure that the grooved pipes and Victaulic couplings fit securely. The Victaulic valves
should clamp flush to one another without pinching the gasket.
11. If installed, inspect the Hopper and insure that no foreign objects are in the Hopper or throat
after installation.

Lobestar Mixing Eductor Operational Guide:
The Lobestar Shear/Mixer is a Venturi device designed on the Bernoulli Principle of "when velocity is high
pressure is low and inversely when pressure is high, velocity is low".

In operation, a centrifugal pump is used to deliver the pressure energy to the Lobestar Shear/Mixer. The
pressurized liquid is converted into a high velocity stream as it passes through the converging shape of the
Nozzle. The resulting high velocity stream generates a low-pressure region around the issuing jet stream
producing a strong suction. Powders, granular materials and other chemical additives dosed in through the
Hopper are drawn-in by the suction and pre-wet under a high "G" force generated in the Radial Premixer.
The slurry then enters the mixing chamber of the Lobestar Eductor to be dynamically sheared and
dispersed. The blended slurry travels through the diffuser (pressure recovery tube) to gradually convert the
high velocity back into pressure at the Eductor discharge with as efficient pressure recovery as possible.

The Lobestar Shear/Mixer has no moving parts. The four (4) major components of the Lobestar
Shear/Mixer are: (1) Hopper, (2) Valve, (3) Radial Premixer, and (4) Lobestar Mixing Eductor. The
Lobestar Mixing Eductor is composed of: (1) Nozzle, (2) Suction Inlet, (3) Mixing Chamber and a (4)
Conical Diffuser.
The orientation of the Lobestar Shear/Mixer is an important consideration for suitable performance. The
direction of flow is from the Nozzle inlet end to the Diffuser discharge end. The pressure line (hose or
pipe) from the centrifugal pump is connected to the Nozzle end of the Eductor. The Diffuser end of the
Eductor is connected to the downstream hose or pipe that is routed to the active fluids system.
The Lobestar Shear/Mixer is designed around a streamline flow stream. A streamline flow is based on a
constant uninterrupted flow. This means that any downstream obstruction will decrease the Eductor
efficiency.

Before Operation:
1. Make sure that there are no valves closed downstream from the SHEAR/MIXER. Start at the
pit and work your way back to the SHEAR/MIXER.
2. Close all of the suction and RADIAL PREMIXER valves, on a single suction model close the
Hopper suction and RADIAL PREMIXER valves.
3. If installed, check the gauges for visibility.
4. If installed, inspect the site glasses for cleanliness and visibility.
5. Visually verify that all fittings and flanges appear to be tight.

Operation:

1. Start the centrifugal pump to pressurize the mixer and begin stream line flow, you must
always follow your company safety procedures for protective equipment and clothing use.
2. Check inlet for proper pressure and vacuum.
3. Prior to mixing or hydration of materials, it is always a good operational choice to take
advantage of the Shear/Mixers ability to clean itself internally, proceed by slowly opening the
RADIAL PREMIXER valve to 100% allow the system to re-circulate in a closed loop for 15

minutes, the additional high volume flow will clean the mixing chamber of the Eductor.
4. After the cleaning operation is complete, close the RADIAL PREMIXER inlet valve.
5. When the vacuum (22” – 29” HG) is achieved, open Hopper feed valve to mix sack material
(NOTE IT IS NORMAL FOR VACUUM TO FALL TO 0 INCHES HG DURING OPERATION)
the Hopper suction will be very strong, keep hands away from the suction throat of the
Hopper.
6. With the Hopper suction valve open, look into the Hopper throat. Adjust the RADIAL
PREMIXER flow to develop a strong vortex in the RADIAL PREMIXER.
7. The RADIAL PREMIXER should always be used while mixing chemicals and Bentonite
through the Hopper.
8. The RADIAL PREMIXER should be closed when not in use.
9. When Mixing Barite from a Surge Tank, use the above cleaning procedure then close the
Radial Premixer inlet valve prior to opening the Surge Tank suction valves.
10. When using the Lobestar Shear Mixer with a surge tank; ensure that the radial premixer valve
and hopper valve are both in the closed position. First open the 4” suction valve nearest the
Lobestar Shear Mixer. Next, slowly open the 6” valve under the surge tank. Vacuum in the
Lobestar Shear Mixer will vary constantly from 0” to 29” during mixing operation; observe the
site glass to see your conveying rate. When mixing is complete, first close the 6” surge tank
suction valve then close the 4” suction valve on the Lobestar Shear Mixer. Operating the
valves in the correct order allows the delivery line to stay clear and prevent dry material from
clogging within the system.
11. It should be noted that Viscosity over 750 centipoises will significantly reduce suction flow,
care must be taken when hydrating Gel so that the Eductor maintains stream line flow, DO
NOT FORCE FEED THE EDUCTOR allow the suction to control the rate and amount of feed.
12. When shutting down the mixing or hydrating operations, you MUST always CLOSE THE
EDUCTOR SUCTION VALVES PRIOR TO STOPPING THE PUMP OR CLOSING ANY
VALVE DOWNSTREAM OF THE EDUCTOR. This will prevent back flow into the Surge Tank
or Hopper.

Trouble Shooting:

1. Problem: Hopper back-flow.


Answer: (1) Restriction in the discharge line, (2) Valve partially closed on feed end, (3)
Insufficient pump pressure, (4) Viscosity too high, fluid stall.

2. Problem: Valve hard to open.


Answer: (1) Clean Mixer Hopper after mixing product, (2) Hand grease valve rubber gaskets, (3)
Before installing Victaulic gaskets, spray with WD 40 or equivalent.

3. Problem: Loss of suction.


Answer: (1) Insufficient pump pressure, (2) Plugged or partially plugged nozzle, (3) High
viscosity, (4) Partially plugged lines down stream.

4. Problem: Premixer not performing.

Partially plugged lines down stream.

Safety Tips:
1. Always wear eye protection while mixing and proper PPE for chemical additions.

2. Hopper suction has strong vacuum - care should be taken when mixing chemical,
keep hands away from suction throat of hopper.
3. Do not exceed maximum pressure of 120 psi.
4. NEVER! Close a valve down-stream from Mixer, while feed pump is running.

Preventative Maintenance Procedures:


LONG STORAGE PERIOD
Spray heavy coating of WD 40 (or equivalent) on all carbon steel surfaces for protection against severe
seawater environment.

All non-metal parts such as urethane are non-corroding and should not need any surface protection.

Before applying oil coating and storing wash down equipment with fresh water and use soapy
water to clean internals, and then proceed with oily protective coating.

RECOMMENDED REPLACEMENT SCHEDULE FOR OPTIMUM PERFORMANCE

The LOBESTAR® JET NOZZLE, PREMIXER BODY and DIFFUSER are constructed in high density,
high abrasion resistant urethane. Inspections of these parts, for wear, should be done every 3
(three) months for optimum performance. Refer to the Vortex Ventures, Inc. website for the Spare

Questions and Answers about the Lobestar Mixing Eductor:

1) What is an Eductor?

An Eductor is a pump without moving parts. An Eductor is principally synonymous with a jet pump. They
operate on the conversion of pressure energy into velocity to produce a low-pressure region.

2) How are they used?

They are used for the conveyance, compression and mixing of liquids, gases and solids when a gaseous
or liquid medium serves as the motive or primary force.

3) What components make up an Eductor or Jet Pump?

A. Motive nozzle. B. Induction passage (suction).


C. Mixing chamber. D. Diffuser (pressure recovery tube).

4) How does the LOBESTAR MIXING EDUCTOR differ from a conventional Eductor?

“LOBESTAR” MIXING EDUCTOR differs by using a unique three-dimensional nozzle. The nozzle orifice
configuration has a circular core with elliptic shaped lobes around the radius of the circular core. This
nozzle geometry generates a coherent turbulent flow pattern that energizes the boundary in the diffuser
section of the Eductor, providing efficient pressure recovery and intimate mixing in a short time to length
scale.

5) How is the efficiency of an Eductor/Jet Pump determined?

A. Vacuum/inlet pressure ratio. B. Pressure recovery.

6) What is the maximum solids-to-liquid concentration that can be expected?

Several pounds of solids per gallon liquid depending on the flow characteristics, bulk density and
required solubility.

7) What type of valve is used with an Eductor?

Slide gate, ball and butterfly valve are suitable. If powdered polymers are mixed, slide gate valves are
recommended to avoid passage obstruction. Valves should never be used for dosing or metering control.

8) Why is a valve needed?

A valve is necessary to prevent flow-back caused from blockage or high pressure-drop that may cause
"stall" in the downstream flow. It is used in start-up and shut down to prevent surges. It is also needed
where the discharge line is at a higher elevation than the Eductor.

9) What effect does viscosity of the motive liquid have on the performance of the Eductor?

The lower the viscosity is, the greater the vacuum. Viscosity over 750 centipoises will significantly reduce
the suction flow. The vacuum can control the rate of induction of feed and mix.

10) In what ways can an Eductor be fed?

A. Manual dosing. B. Volumetric feeder.

11) Can slurry be re-circulated after mixing?

Yes. Remember, the higher the viscosity becomes the lower the suction will be if powder is continued to
be fed into the system.

A. The centrifugal force imparted on the mixture prevents lumping and "fisheyes".

mixture. The entrained air bubbles in the mixture will continually expand as the pressure gradient

Limited Warranty and Liability

VORTEX VENTURES warrants all standard LOBESTAR® SHEAR/MIXER products manufactured and furnished by it to be
free of defects in material and workmanship for a period of one year from the date of shipment from SELLER. SELLER warrants
all parts, fittings and accessories manufactured by SELLER to be free from defects in material and workmanship for a period of
one year from the date of shipment from SELLER’S factory. THESE WARRANTIES ARE SUBJECT TO THE FOLLOWING
TERMS, CONDITIONS, LIMITATIONS, AND EXCLUSIONS:

SELLER’S obligation under the warranty as described herein shall be enforceable only if BUYER installs, uses and maintains
SELLER’S products, parts, fittings, and accessories in accordance with generally accepted operating practices within the
applicable and appropriate industry.

SELLER’S obligation under the warranty as described herein shall not apply to any products, parts, fittings, and accessories
which (a) have been repaired or altered outside of SELLER’S factory unless by a SELLER’S factory repair person or authorized
warranty service personnel; or (b) have been subjected to misuse, negligence, fire, accident, act of war or God.

SELLER’S obligation under the warranty as described herein shall not be enforceable unless and until BUYER has paid for all
such products, part, fittings and accessories in full.

SELLER’S obligation under the warranty as described herein shall not be enforceable where BUYER’S use of SELLER’S
product is in violation of federal, state or local laws or regulations.

EXCLUSIONS OF WARRANTIES AND LIMITATIONS OF BUYER’S REMEDIES: BUYER and SELLER hereby expressly agree
that BUYER’S sole and exclusive remedy against SELLERS shall be for the repair or, at the SELLER’S option, replacement of
any product, part, fitting or accessory that, upon SELLER’S examination, is found to SELLER’S satisfaction to have been
defective when shipped from SELLER’S factory, and only then if; (a) BUYER, notifies SELLER in writing of the defects and
SELLER receives such notification within the warranty period; and (b) BUYER, within thirty (30) days of such notification, either
at SELLER’S option: (I) properly tenders such product, part, fittings or accessory to SELLER for inspection; or (ii) properly
disposed of such product, part, fitting or accessory in accordance with all applicable federal, state and local laws and regulations.
BUYER expressly agrees that no other remedy (including, but not limited to, incidental or consequential damages for lost profits,
lost sales, injury to persons or property, or any other incidental or consequential loss)
shall be available to BUYER. THE WARRANTY DESCRIBED IN THIS PARAGRAPH SHALL BE IN LIEU OF ANY OTHER
WARRANTY, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF
MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE.

SERIES 761

Vic®-300 MasterSeal™ butterfly valves are designed for pressures ranging from vacuum to
300 psi/2065 kPa and for bi-directional, dead end services to full working pressure. The valve
GEAR OPERATOR LEVER LOCK 10-POSITION HANDLE
features a patented seat design that assures full 360° sealing. The pressure-enhanced seat HANDLE WITH MEMORY STOP
compresses to form a larger seating area as the pressure increases. The seat design also
­contributes to the low breakaway torque capabilities of the MasterSeal valve.
Available in 2 – 12”/50 – 300 mm sizes the valve is offered with a standard ISO mounting
flange to accept most gear and power actuators. Vic-300 MasterSeal butterfly valves
2 – 6”/50 – 150 mm are offered with a 10-position handle that may be configured for infinite
variable service with memory lock stop and is pad-lockable. Sizes 8”/200 mm valves are
available with a lever lock handle that may be configured for infinite variable service with memory stop and is padlockable. 2 – 12”/50 – 300 mm
sizes are available with a gear operator and can easily be configured into three way assemblies. Vic-300 Masterseal butterfly valves accommodate
2”/50 mm of insulation. An additional 2” neck extension is available when more than 2”/50 mm of insulation is needed. A 4½”/120 mm long Hand
Wheel Input Shaft Extension is available for valve sizes 2 – 8”/50 – 200 mm and a 3½”/90 mm long Hand Wheel Input Shaft Extension is available
for 10 – 12”/25 – 300 mm valve sizes. Note: Hand Wheel Input Shaft Extensions are not for use with Chain Wheels.
Available seats include EPDM for water services to +250°F/+121°C. Vic-300 MasterSeal valves are also offered with permanently lubricated Nitrile
material that is recommended for oil, air, and gas services. For specific material specifications on varied services please request ­publication 05.01.
For dry gas service, Victaulic recommends the lubricated nitrile option. Valves with standard disc and EPDM seat are UL classified to ANSI/NSF 61.
Victaulic also offers a tamper resistant option for 2 – 8”/50 – 200 mm size Vic-300 MasterSeal butterfly valves.
NOTES:
A padlockable valve refers to those valves which can be padlocked to lockout equipment for preventing inadvertent valve operation. When used in
conjunction with an appropriate lockout/tagout systems, multiple padlocks may be used. The valve may be padlocked either fully open or fully closed.
A tamper resistant option is meant to deter theft, vandalism or other malicious activity. The handles and associated components are assembled with
tamper resistant fasteners which are designed for one time assembly. Attempts to defeat the padlock by partial disassembly of the valve will likely
result in evidence of such activity. The valve may be padlocked either fully open or fully closed.

VALVE TORQUE REQUIREMENTS Source:


These torque values were derived from test data with non-lubricated valves in water at ambient
temperatures with EPDM seals. For other material and service conditions, apply a suitable service
factor.

Torque Factors:
All torque values are for normal conditions (i.e. the valve is operated at least once a quarter, disc
corrosion is expected to be minor, the media is clean and non-abrasive, and the chemical effects
upon the elastomer are minor).

Typical fluid torque factors commonly used in the industry are:


Water: 1.0; Lubricated service: 0.8; Dry gases: Lubricated nitrile “T” seat seals are recommended
for dry gases wherever chemically appropriate. See material torque factor below.

Material Torque Factors:


“E” = 1.0; “O” = 1.2; “T” = 0.8

Cycling Factor:
Torque will typically increase as the valve is cycled. A factor of 1.5 should be applied for the first
5000 cycles and another 1.5 applied for all additional cycles. The higher number should be used
if there are more than one cycle per hour.

Actuation Factor:
There are no actuation safety factors applied. A factor consistent with the consequences of not
actuating should be applied. A minimum factor of 1.2 is recommended for directly actuated valves
and 1.5 for 3-way assemblies.

Combining Torque Factors:


When multiple torque factors apply, they are combined by multiplying them. Example: For an
EPDM seal and a 5000 cycle factor the combined factor would be 1.0 X (1.5) = 1.5.

Note:
Under certain high flow conditions, the hydrodynamic torque can exceed the seating torque. Large
butterfly valves are not recommended for use in a free discharge condition, such as filling an
empty line with fluid at the full rated pressure.

TYPICAL SPECIFICATIONS Butterfly valves 2 – 12"/50 – 300 mm shall be rated to 300 psi/2068 kPa and be both ­bi‑­directional
and dead-end service capable to full rated pressure. Body material shall be ductile iron with blow-
out proof stainless steel stems and electroless nickel coated ductile iron disc. Seat material shall be
EPDM (or lubricated nitrile or fluoroelastomer) and have a full 360° continuous contact with the seat-
ing surface. Stem seals shall be of the same material grade as the seats. Disc shall be offset from
the centerline of the stems and shall be connected to the stem without the use of fasteners or pins.
Valve ends shall be grooved. Valve shall have standard ISO flange mounting for ease of ­actuation.
Operators shall be as specified by choice in valve table. The standard handle valve 2 – 8"/50
– 200 mm shall include latch lock, infinitely variable and memory stop features. Manufacturer
– Victaulic – Vic-300 MasterSeal Valve or approved equal. Valve with EPDM seat is UL classfied to
ANSI/NSF 61.

IMPORTANT INSTALLATION When installing a Victaulic butterfly valve into a piping system, follow the instructions supplied with
CONSIDERATIONS the coupling. Refer to the notes below for applications/limitations.
When using butterfly valves for throttling service, Victaulic recommends the disc be positioned no
less than 30 degrees open. For best results, the disc should be between 30 and 70 degrees open.
High pipeline velocities and/or throttling with the disc less than 30 degrees open may result in noise,
vibration, cavitation, severe line erosion, and/or loss of control. For details regarding throttling ser-
vices, contact Victaulic.
Victaulic recommends that flow velocities for water service are limited to 20 ft. per sec./6.1 m per
sec. When higher flow velocities are necessary, contact Victaulic. When dealing with flow media
other than water, contact Victaulic.
Victaulic recommends good piping practices and installing the valve five pipe diameters away from
other components.

Radial Eductor® Installation Guide
For Radial Eductor® models: RE-2-USF-M1, RE-1.5-USF-M1, & RE-1-USF-M1 (Radial eductors with
female NPT inlet connection):
Check the jet nozzle insert to verify that it is in place and properly installed as shown in Figure 1.

Coat the male NPT threads on the existing piping manifold that will thread into the inlet of the Radial
Eductor® with white lithium grease and hand tighten the Radial Eductor® onto the male NPT threads.
CAUTION: Do not over torque the threads for risk of thread stripping.

Torque values based on lubricated threads: 2” Steel – 75 ft/lbs


3” Steel – 80 ft/lbs

All pipe thread connections should be torque wrench tightened using pipe sealant / lubricant during
installation.

- Turns past hand tight guidelines;


- 1/8”-2” turn 2-3 times, stopping in the desired orientation

Terms and Conditions of Sale

These terms and conditions, the attendant quotation or acknowledgement, and all documents
incorporated by reference therein, bind the company(s) which issues the quotation or acknowledgement
for the provision of services (Services) and/or the sale of goods (Goods) to be provided hereunder by
Seller (Alfa Laval Vortex Inc.), hereinafter Seller, and the Buyer, hereinafter Buyer, and constitute the
entire agreement (Agreement) between Buyer and Seller regarding such sale and/or provision.

1. PRICES: Unless otherwise specified by Seller, Seller’s price for Goods and/or Services shall remain in
effect for thirty (30) days after the date of Seller’s quotation to Buyer or acceptance of Buyer’s order for
Goods/Services, whichever is delivered first, provided an unconditional, complete authorization for the
immediate manufacture and shipment of goods within a ninety (90) day period. Seller shall have the right
to change the price for Goods/Services to Seller’s price in effect for the Goods/Services at the time the
order is released to final manufacture in the event Buyer does not issue such unconditional, complete
authorization for manufacture and shipment. Seller’s stenographical and clerical errors are subject to
correction.

2. DELIVERY AND DOCUMENTATION: All shipping dates are approximate and are based upon Seller’s
prompt receipt of all necessary information from Buyer to properly process the order. Notwithstanding
any provisions to the contrary in this or other documents related to this transaction, and regardless of
how price was quoted, whether EX-WORKS, FOB or otherwise, legal title to the goods and risk of loss
thereto shall transfer to Buyer upon delivery to the freight carrier at the Sellers shipping point. Seller shall
provide Buyer with that data/documentation which is specifically identified in the quotation. If additional
copies of data/documentation or non-standard data/documentation are to be provided by Seller, they
shall be provided to Buyer at Seller’s price then in effect. Packaging costs included in Seller’s quote is
limited to palletizing and shrink wrapping. All other packaging costs are the sole responsibility of the
Buyer. All export costs including but not limited to freight forwarding, air or ground freight, taxes, tariffs, or
any other cost are at the Buyer’s sole expense.

3. EXCUSE OF PERFORMANCE: Seller shall not be liable for delays in performance or for non-
performance due to acts of God, war, riot, fire, labor trouble, unavailability of materials or components,
explosion, accident, compliance with governmental requests, laws, regulations, orders or actions, or
other unforeseen circumstances or causes beyond Seller’s reasonable control.

4. TERMINATION AND SUSPENSION BY BUYER: Buyer may terminate or suspend its order for any or
all of the Goods/Services covered by the Agreement, provided that Buyer gives Seller reasonable
advance written notice of such termination or suspension and reimburses Seller for all losses, damages,
costs and expenses arising from such termination or suspension. Notwithstanding any of the foregoing
to the contrary, Buyer’s minimum reimbursement for termination shall be the following restocking charges
based on the quoted or accepted price of the order: twenty-five percent (25%) upon receipt and
acceptance of Buyer’s order, fifty percent (50%) after thirty (30) days following receipt and acceptance of
Buyer’s order, sixty percent (60%) upon completion of but prior to shipment of Buyer’s order.

5. LIMITED WARRANTY: Subject to the limitations contained in Section 6 and except as otherwise
expressly provided herein, Seller warrants that the Goods manufactured or Services provided by Seller
will be free from defects in materials or workmanship under normal use and care until the expiration of
the applicable warranty period. Seller warrants Goods for twelve (12) months from the date of shipment.

Consumables and Services are warranted for a period of 90 days from the date of shipment or
completion of the Services. Products purchased by Seller from a third party for resale to Buyer (*Resale
Products) shall carry only the warranty extended by the original manufacturer. Buyer agrees that Seller
has no liability for Resale Products beyond making a reasonable commercial effort to arrange for
procurement and shipping of the Resale Products. If Buyer discovers any warranty defects and notifies
Seller thereof in writing during the applicable warranty period, Seller shall, at Seller’s option, promptly
correct any errors that are found by Seller in the Goods/Services, or repair or replace F.O.B. point of
manufacture that portion of the Goods found by Seller to be defective, or refund the purchase price of the
defective portion of the Goods/Services. All replacements or repairs necessitated by inadequate
maintenance, normal wear and usage, unsuitable power sources, unsuitable environmental conditions,
accident, misuse, improper installation, modification, repair, storage or handling, or any other cause not
the fault of Seller are not covered by this limited warranty, and shall be at the Buyer’s expense. Seller
shall not be obligated to pay any costs or charges incurred by Buyer or any other party except as may be
agreed upon in writing in advance by an authorized Seller representative. All costs of dismantling,
reinstallation and freight and the time and expenses of Seller’s personnel for site travel and diagnosis
under this warranty clause shall be borne by Buyer unless accepted in writing by Seller. Goods repaired
and parts replaced during the warranty period shall be in warranty for the remainder of the original
warranty period or ninety (90) days, whichever is longer. This limited warranty is the only warranty made
by Seller and can be amended only in a writing signed by an authorized representative of Seller. Except
as otherwise expressly provided in the Agreement, there are no representations or warranties of any
kind, expressed or implied, as to merchantability or fitness for particular purpose, or any other matter,
with respect to any of the Goods or Services.

6. LIMITATION OF REMEDY AND LIABILITY: Seller shall not be liable for damages caused by delay in
performance. The sole and exclusive remedy for breach of warranty hereunder shall be limited to repair,
correction, replacement or refund of purchase price under the limited warranty clause in section 5. In no
event, regardless of the form of the claim or cause of action (whether based in contract, infringement,
negligence, strict liability, other tort or otherwise), shall Seller's liability to Buyer and/or its customers
exceed the price to Buyer of the specific Goods manufactured or Services provided by Seller giving rise
to the claim or cause of action. Buyer agrees that in no event shall Seller's liability to Buyer and/or its
customers extend to include incidental, consequential or punitive damages. The term “consequential
damages” shall include, but not be limited to loss of anticipated profits, loss of use, loss of revenue, loss
of production or reservoir and cost of capital.

7. PATENTS: Subject to the limitations contained in Section 6, Seller shall defend any suits brought
against Buyer based on a claim that use of the Goods manufactured by Seller constitutes an infringement
of a valid patent of the United States, and shall pay any damages awarded therein against Buyer,
provided that Buyer promptly notifies Seller in writing of the filing of such suit or the threat thereof;
permits Seller to control completely the defense or compromise of such claim of infringement; and
provides all reasonable assistance and cooperation requested by Seller for the defense of such suit. In
the event that only the Goods manufactured by Seller are held to be infringing in such suit and their use
is enjoined, Seller shall, at its sole option and expense, provide a commercially reasonable alternative,
including, but not limited to, procuring for Buyer the right to continue using the Goods, replacing them
with a non-infringing product or modifying them so they become non-infringing. Buyer agrees that Seller
shall not be liable for infringement, and that Buyer shall fully identify Seller thereof, if infringement is

based upon the use of Goods in connection with goods not manufactured by Seller or in a manner for
which the Goods were not designed by the Seller or if the Goods were not designed by the Seller or if the
Goods were designed by the Buyer or were modified by or for the Buyer in a manner to cause them to
become infringing. Buyer agrees to honor all of Seller’s patents, to only buy products covered by the
patents from the Seller, and not to assist any other party in any work to damage or conflict the legitimacy
of the patents.

8. INSTALLATION: Buyer shall be responsible for receiving, storing, installing, starting up and
maintaining all Goods. Seller shall provide a quotation for Services to assist Buyer in these functions if
requested.

9. TAXES: Any tax or governmental charge payable by the Seller because of the manufacture, sale or
delivery of the Goods, or provision of Services, may at Seller's option be added to the price herein
specified. The foregoing shall not apply to taxes based upon Seller's net income.

10. TERMS OF PAYMENT: Subject to the approval of Seller's Credit Department, terms for shipments
within the U.S. are Ex-works, net 30 days from date of Seller's invoice in U.S. currency, except for
applicable milestone payments covered below. Terms for export shipments are Ex-works, which Seller
requires payment in full before shipping, in U.S. currency. If any payment owed to Seller hereunder is not
paid when due, it shall bear interest at a rate to be determined by Seller, which shall not exceed the
maximum rate permitted by law, from the date on which it is due until it is received. Seller shall have the
right, among other remedies, either to terminate the Agreement or to suspend further deliveries under
this and/or other agreements with Buyer in the event Buyer fails to make any payment hereunder when
due. Buyer shall be liable for all expenses attendant to collection of past due amounts, including
attorneys' fees. Unless otherwise provided in Seller's written quotation, Buyer shall make periodic
milestone payments when the purchase price of this Agreement exceeds $100,000. In such cases,
invoices shall be issued by Seller and paid by Buyer based on the following milestones: Milestone 1: 30%
of price upon acceptance of order by Seller. Milestone 2: 30% of price upon release of approved
drawings by Seller. Milestone 3: 40% of price upon shipment of Goods by Seller. Seller reserves the
right to designate additional Milestones where the Agreement provides for Services in excess of $50,000.

11. INTELLECTUAL PROPERTIES - ENGINEERING SERVICES AND PROPRIETARY DRAWINGS:


The Engineering Services and Proprietary Drawings required to fabricate the goods and services quoted
shall remain the property of the Seller. Any information, documents, data and computer programs
developed during the course of the scope of the project shall remain the property of the Seller. The
Engineering Services and Proprietary Drawings apply to the goods and services quoted and cannot be
utilized for goods and services not specified within the scope of the designated Purchase Order. Buyer
may negotiate with Seller a separate license to use the stated Engineering Services and Proprietary
Drawings on additional projects. Upon acceptance of these terms and conditions by Buyer, and delivery
of the Goods specified in the accompanying purchase order, Seller hereby grants to Buyer a limited
license for use of the patented and proprietary technology used to produce such Goods. Buyer agrees
not to replicate, reproduce or copy any component, part or finished Good, or assist or aide any party that
Buyer may reasonably expect might replicate, reproduce or copy any such Good or component thereof.

12. BUYER SUPPLIED DATA: To the extent that Seller has relied upon any specifications, information,
representation of operating conditions or other data or information supplied by Buyer to Seller in the
selection or design of the Goods and/or provision of the Services and the preparation of Seller's
quotation, and in the event that actual operating conditions or other conditions differ from those
represented by Buyer and relied upon by Seller, any warranties or other provisions contained herein
which are affected by such conditions shall be null and void, unless otherwise mutually agreed upon in
writing.

13. GENERAL PROVISIONS: Buyer shall not assign its rights or obligations under the Agreement
without Seller's prior written consent. There are no understandings, agreements or representations,
express or implied, not specified in this Agreement. No action, regardless of form, arising out of
transactions under this Agreement, may be brought by ether party more than two (2) years after the
cause of action has accrued. Any modification of these terms and conditions must be set forth in a
written instrument signed by a duly authorized representative of Seller. This Agreement is formed and
shall be construed, performed and enforced under the laws of the State of Texas. If any provision of this
Agreement is invalid under any statute or rule of law, such provision, to that extent only, shall be deemed
to be omitted without affecting the validity of the remainder of the Agreement.
