RULES FOR THE 2018 UC COLLEGE OF LAW MOOT CUP

I. MEMORIALS

1. Sides

a. Each team shall be composed of 5-6 members. Assign a team leader to e-mail
the names of all your members to ucmootingactivity@gmail.com no later than
10:00 PM on 16 February 2018. Please indicate whether you are students of
Legal Writing or Logic, as well as your respective Professors. We will respond
with your respective team numbers.


b. Each team will prepare only one (1) memorial, either Applicant OR
Respondent. There is no need to include your preferred side in the e-mail
required in the previous paragraph.

c. For purposes of these rules, the Applicant is the Federal States of Aves and the
Respondent is the Republic of Renac.

2. Format

a. The memorial may not exceed 5,500 words on 8-1/2 x 11-inch pages, with
one-inch margins at top, bottom, left, and right. Footnotes do count toward the
word limit.

Note: Most word processing programs can provide you with a word
count. Deductions may be taken if the memorial is over the word count.

b. The memorial must be typed and double-spaced. A team does not violate the
double-spacing requirement by including written material properly that is single
spaced, such as a block quote.

c. Each memorial must include the following sections, which do count toward
the word limit:

i. Statement of facts (Must be no longer than 1000 words.)


ii. Summary of arguments;
iii. Argument with point headings;
iv. Conclusion and prayer.

d. Each memorial must also include the following sections, which do not count toward
the word limit:

i. Cover page;
ii. Index of Authorities;
iii. Questions presented;
iv. Statement of jurisdiction;
v. Index of authorities.

e. Arrangement:

The Memorial must consist of the following sections:


i. Cover page;
ii. Index of Authorities;
iii. Statement of Jurisdiction;
iv. Questions Presented;
v. Statement of Facts;
vi. Summary of Arguments;
vii. Main Arguments; and
viii.Conclusion and Prayer for Relief

f. Limit on Use of Authorities


Teams may not use—in memorials or oral argument—any case issued, order decided, or
actions that affect the status of any treaty (for example, signature, accession, ratification,
entry into force) after 20 February 2018.

g. Citations

All citations must conform to the most current version of The Bluebook: A Uniform
System of Citation.

3. Identification

To facilitate grading, names of the team members and the side they represent must be
written on the last page of the memorial.

4. Service of the Memorial

a. Every team must submit an electronic AND a printed copy of its memorial.

b. The memorial should be sent as an email attachment in Word format. Do not send
the memorial as a PDF-file or in several Word files (separating cover page, table of
contents, etc.) This will not be accepted and you will be considered as not having
submitted a memorial.

c. Please name the memorial using your team number (i.e. Team XXXX - Memorial for
the Applicant.doc)

d. The electronic version of the memorial must be received by the Competition


Committee no later than 10:00 p.m. (Philippine Standard Time) on Sunday, 4
March 2018. The printed copy of the memorial must be submitted to the University
of Cebu - College of Law Office on Monday, 5 March 2018.

e. Memorials that arrive after the deadline will receive a deduction for being submitted
late.

h. The memorials should be sent to the Competition Committee, at


ucmootingactivity@gmail.com. Please include the following in the subject line of the
e-mail: “TEAM XXXX 2018 UC MOOT MEMORIAL”.

5. Grading

a. Each memorial will be scored by a panel of judges knowledgeable in the areas of


international and/or environmental law, and human rights law.

b. Memorials will be graded for both content and style. The factors memorial judges
will consider include, but are not limited to, the following:

i. legal substance;
ii. use of authority and extent of research;
iii. issue analysis;
iv. logic and reasoning;
v. clarity and organization;
vi. persuasiveness and thoroughness;
vii. style, grammar, spelling;
viii. citation frequency and form; and
ix. compliance with the rules.

II. ORAL ROUNDS

1. Sides

a. Each team should designate three (3) oralists for the Applicant (first speaker,
second speaker and rebuttal) or two (2) oralists for the Respondent (first speaker
and second speaker) depending on the side you are assigned.

b. Respective sides will be determined on 6 March 2018. You may or may not
be assigned to the side you chose to wrote for your memorial. You will receive
an e-mail along with your schedule.

2. Length of Speeches

a. Each oral round will be limited to one (1) hour; each team will have
fifteen (15) minutes to argue. Maximum of ten (10) minutes for the first and
second speaker and five (5) minutes for rebuttal.

3. Date of Oral Rounds

a. The oral rounds will be on Saturday, 10 March 2018.

III. REMINDERS

1. Teams who have not yet argued are not allowed to watch the oral rounds of the other
teams. After your respective round, you may stay to watch the other rounds.

2. Please be present outside your assigned room at least thirty (30) minutes before your
time slot.

3. The bailiff will call your team number during this time. Late teams will no longer be
accommodated.4. Take note of the order during the oral rounds:

5. Sample script:

Entry of Appearances: Mr./Madame President, Your Excellencies, may it please


this Honorable Court. My name is Juan De La Cruz, first agent for the
Applicant/ Respondent, the Federal States of Aves/Republic of Renac. With me is
my co-agent, Juana De La Coco; and together we humbly enter our appearances
in behalf of the Applicant/Respondent State. May it please the Court.

Beginning a speech: Mr./Madame President, Your Excellencies, may it please


this Honorable Court. My name is Juan De La Cruz, first agent for the
Applicant/ Respondent, the Federal States of Aves/Republic of Renac. For the
first 10 minutes, I will be speaking on the issue of violations of international law.
For the next 10 minutes, my co-agent will be speaking on the issue of
attributability. We would like to reserve 5 minutes for Rebuttal.

Ending a speech: If the Court is no longer in need of my assistance, I now yield


the podium to my co-agent for our second submissions. May it please the Court.
