Dear Mr. Weinstein-Tull:

I am writing to request that the U.S. Department of Justice assign federal election observers to
supervise the Democratic primary election within the 32nd Senatorial District, scheduled for
Tuesday, September 14th, in Bronx County, New York. It is clear that, without federal
supervision, there is an imminent danger of voter disenfranchisement, fraud and intimidation.

The abovementioned Democratic primary election will be the first time voters will be using
optical scantrons to cast their ballots. Earlier this week, the Bronx Board of Elections could not
guarantee that most or all, the poll sites will have functioning scanners. Therefore, the primary
elections will be done by at least partially with paper ballot, offering tremendous potential for
fraud.

This latest development is a major concern for a community with already depressed voter turnout
and an expressed distrust of government. The change in technology impacts less informed voters
who can be easily manipulated by poll workers to vote for the incumbent, Senator Reverend
Ruben Diaz, Sr., whose aligned poll workers will likely illegally influence campaigns at polling
sites, especially with new paper ballots providing openings for interraction between poll workers
and voters.

The incumbent has a long history of suppressing voter turnout, preparing and distributing
fraudulent propaganda, manipulating elections, and being investigated by the F.B.I. for
corruption. He has also been found liable for improperly spending nearly $5,000 in government
grants intended for a not-for-profit to purchase campaign supplies.

Recently, the incumbent was exposed as possibly violating state election law for not reporting
the free parking spots for his campaign vehicles as in-kind contribution (See,

A week ago, the Male District Leader of the 76th Assembly District, Kenneth Padilla, submitted a
formal complaint with the Board of Elections, against the incumbent, who is also a candidate for
male district leader in the 76th Assembly District, and his campaign committee, Ruben Diaz for
State Senate, for violating the Fair Campaign Code § 6201.1(b).

To ensure that the primary election is fair and voters are not disenfranchised, putting one more
block to Bronx civic participation, I am calling for federal monitors to not only observe these
elections, but to take control of the ballots at the end of the evening and actually conduct the
hand count.
