The undersigned granted the Division's motion (without objection) to amend the alleged violation description of Citation 1, Item 3, to read as follows: “At the time of inspection, it was determined that a shelf next to the telephone in the Smelter Control Room on the east side of the facility located at 2700 South Indiana Street, Vernon, was not maintained as free as practicable of accumulations of lead.” ‘The parties herein agreed as follows: It is stipulated by and between the parties that this stipulation and the terms and conditions set forth herein are not intended to be and shall not be construed by anyone as an admission of any wrongdoing whatsoever by Appellant, except for purposes of administration and enforcement of the California Occupational Safety and Health Act in proceedings before the Appeals Board, and that the stipulation shall not be used in any other proceeding between the parties or involving any other person, whether said proceeding be legal, equitable, or administrative in nature. The parties further stipulate that no findings or coriclusions have been made by any trier-of-fact regarding the citations and fines at issue herein. ‘The parties further stipulate that Appellant has entered into this agreement in order to avoid protracted litigation and costs associated thereto. To serve as a re-cap, when I met with you I provided you with a booklet entitled User's Guide to Cal/OSHA. The booklet discusses how employers in the State of California are required to make use of known controls to reduce or eliminate recognizable hazards in the occupational setting. The booklet also explains that employees have a right to file a complaint and discuss concerns with Cal/OSHA, and that there are protections under the Labor Code against any sort of discrimination against a worker who speaks with Cal/OSHA. The booklet enlarges on the issues we discussed, including that there are actually two “Cal/OSHAs.” One, the Enforcement Unit, conducts inspections in workplaces based usually on accidents or complaints, and may issue Page 2 citations carrying monetary penalties if violations of Title 8, California Code of Regulations (CCR) are observed. The Consultation Unit, on the other hand, will give employers an inspection on their request without the issuance of citations, penalties or fees, and a visit from Consultation will not prompt an inspection from the Enforcement Unit. The Cal/OSHA Consultation Service does not share information discussed with employers with the Cal/OSHA Enforcement Unit. It has been determined that the following proposed citations be issued as outlined below: GENERAL VIOLATIONS: 8CCR 5157 (012) Permit Required Confined Spaces: Not adequately marked/warning signs. 8 CCR 2340.12 (@) Opening in 120 volt live electrical junction box. BCR 5198 (AX) ‘Lead-containing dustin smelter control room (designated as a clean zone). Also enclosed is 2 U.S. Department of Labor print-out listing the most-frequently cited OSHA standards at the federal level for companies having the same SIC (Standard Industrial Classification) code as Exide Technologies Battery Recycling. The print-out is for your information only, to assist you in future hazard recognition inspections in your workplace. At the time of the inspection | also provided a flyer that discussed how the Title 8 Safety Orders can be obtained without charge, on-line at: hitp:/\www.dir.ca.gov/samples/search/query.htm again invite your attention to this informative webpage, and suggest you consider contacting the State of California’s free, confidential Cal/OSHA Consultation Service, so that you might expand on issues pertaining to occupational safety and health that we discussed. Citations initially carry what are called “proposed” penalties. Penalties and penalty amounts do not become permanent until after employers are offered an orfunity to come into the Monrovia office and meet with the Dist ager in what is called an “informal conference.” At that time you may bring up any disagreements you may have with a Cal/OSHA finding. It is strongly recommended that you contact the Monrovia District Office and set up an appointment with the District Manager for an informal conference as soon as possible if you have any disagreements with these findings. Currently, the total proposed penalty for the violations listed above is currently set at $650. Page 3 If an informal conference does not prove to be satisfactory, you may request a formal appeal, You have 10 working days from date of receipt of citations to file for an informal conference and 15 working days from date of receipt of citations to file for a formal appeal. The directions for filing a formal appeal are contained in this package. An informal conference may be requested anytime after an appeal is filed up to the hearing date. California Code of Regulations, Title 8 requires that copies of the enclosed citations be posted in a conspicuous place in the work area for three working days or until the conditions are abated, which ever is longer. Also enclosed is a form entitled "Statement of Abatement of General Violations." This form needs to be filled out and returned to the Monrovia District office of DOSH with statements indicating what steps your establishment has taken to abate the cited violations. If Exide Technologies elects to appeal a Cal/OSHA finding, the forms are not due until after a final determination in the appeal has been issued by the appropriate jurisdiction. Add 5 mL ashing acid, Cover with a watenglass. Let stand 30 min at room temperature, NOTE: Start a reagent blank at this step. 5. EVALUATION OF METHOD: Issues 1 and 2 ‘Method, 7300 was originally evaluated in 1981 {2,3}. The precision and recovery data were determined at 2.5 ‘and 1000 ug of each element per sample on spiked fiters. The measurements used for the metho evaluation in issues + and 2 were determined with a Jarrel-Ash Mode! 1160 Inductively Coupled Plasma Spectrometer operated according to manufacturer's instructions. Issue 3 Inthis update of NIOSH Method 7300, the precision and recovery data were determined at approximately 3x ‘and 10x the instrumental detection limits on commercially prepared spiked fillers [12] using 25,0 mL. as the final sample volume. Tables 3 and 4 list the precision and recovery dala, instrumental detection limits, and analytical wavelengths for mixed cellulase ester (MCE) and polyvinyl chloride (PVC) fillers. PVC Filters which can be used for total dust measurements and then digested for metals measurements were tested and ound to give good results. If the area to be sampled is in a confined area and a template cannot be used, measure the sampling area, and delineate the area to be sampled with masking tape 2. Remove a mipe from its package, and untold it 3. Wipe the surface to be sampled using fingertips held together and applying firm pressure. Use an overlapping 'S' patter to cover the entire surface with horizontal strokes. Fold the exposed side of the wipe in, and wipe the same area using vertical ’S!-strokes, Fold the wipe again to reveal an unexposed surface, and wipe the surface a third time as described in step 3 6. Fold the wipe, exposed side in, and place it into a clean hard-walled sample cantainer (¢.9., 50-mL centrifuge tube). Seal securely and label the sample container. NOTE: Compositing of wipe samples is not recommended, because (a) they cause sample preparation and analytical aitficulties, and (b) site-specific analytical information is lost 7. Clean the template in preparation for the next wipe sample using water or a wipe. A disposable template may also be used. 8. Remove gloves and discard, Clean gloves should be worn for each new sample. 9. Field blanks: 10% of samples, at least three per batch. Ten of the elements found in SRM 2711 were recoverable within the same range. These are: silver, arseric, cadmium, cobalt, copper, manganese, nickel, phosphorus, lead, and zine.
