He stated the applicant is requesting a reduction from $19,532 down to $1,953; in 1996, the County had an unsafe structure issue on this property; the County demolished the house and a lien was recorded in the amount of $8,256.97 to cover the demolition costs; the County abated excess weeds and grass ns 18 times from 1996, until the property was annexed in the City of St. Cloud in 2014; each abatement constituted an individual lien a property for a combined total of $11,275.44; the total lien amount on the property at this time is $19,532; the County costs are $8,438; interest amounts to $10,915; and the recording fees total $180. He jicated the County Staff is unable to recommend approval of the reduction request as requested by the ap, as the current County policy does not allow for reductions for building condemnations or repeat code violation cases. Mr. Donald Shroyer, 2803 Palmetto Court, property owner, explained having purchased the subject property, and also the property to be addressed in Regular item #22, as an initiative started by the City of St. Cloud, He expounded there was an Interlocal Agreement between the City and the County to annex the enclaves in the area; Resolution. 2014-196R was adopted by the City regarding the annexation of the properties; a press 20 Minutes - BCC ~ Regul: 15 February 2016 release was issued called “Operation Rolling Down the River,” which resulted in 29 felony arrests, 8 search warrants service, and the removal of large amounts of drugs from the blighted area; a press release was issued regarding the clean-up attempts and improvements in that area by the City of St. Cloud; and therefore, he purchased these vacant properties in an attempt to assist in the clean-up of the area. He conveyed having the knowledge that the liens existed on the properties, He noted some of the liens have been satisfied; the City of St. Cloud has a practice to remove 10% of the liens if the property is purchased in a blighted area. He opined the reduction amount he is requesting is in line with the practice of the City of St. Cloud. He pointed out one tax certificate is being held by an individual, with the County holding the remainder of the tax certificates. He believed tax roll values would continue to be lost if the value is not restored of the properties. ‘There were no public comments regarding this request. Commissioner Hawkins relayed not being in support of reducing any Code Enforcement liens and supporting the recommendation of the County Staff. In response to Commissioner Grieb, Mr. Shroyer confirmed having knowledge of the liens on the properties, as he had Stewart Title perform an owners and encumbrances search conducted, He conveyed having purchased the properties against the advice of rela $1,000 per parcel. Commissioner Grieb opined the situation to be unfortunate; however, by Mr. Shroyer knowing that the liens existed makes it difficult for the Board to make the decision to reduce the liens, as there are many individuals that purchase property unaware that liens exist. She supported the recommendation of the Staff not to reduce the Mr. Shroyer opined interest would continue to accrue, the properties would not produce tax revenues, and the area will continue to be blighted by not reducing the liens. A MOTION was made by Commissioner Arrington that the Board uphold the recommendation of the County Staff to deny the request for a reduction of multiple Code Enforcement Liens and Unsafe Structure Lien recorded against property located at 614 Bibbens Street; property owner, Donald Shroyer. Mr. Donald Shroyer, 2803 Palmetto Court, property owner, expressed a willingness to strike the property to the County as it has no value. n Minutes - BCC - Regular 15 February 2016 Mr. Andrew Mai, County Attorney, recommended Mr. Shroyer contact his office to discuss the issue and evaluate the situation. Commissioner Hawkins indicated a public purpose would be needed to take on the burden of maintaining the properties, Commissioner Grieb referred to the copy of the deed provided with the agenda backup information and noted a notary signature was provided for only one of the principles, which may ereate an issue for the transfer of the property and a title issue. Commissioner Harford conveyed being a proponent in opposition to reduction of liens. He recalled the Board having approved lien reductions in the past for properties that were purchased by individuals who cleaned up the properties. He opined Mr. Shroyer is trying to make a change in the area and the fact that he is a City of St, Cloud elected official has no bearing on the issue. He expressed concern of this property not being in a taxable manner based on actions done by owners previous to Mr. Shroyer. He pointed out the survey stakes were noticed at the site for the future Valencia Campus and College Station, as well. The water appears to have been initiated in the late 80's but was discontinued in 2004 due to home demaltion.
