This case is regarding the defamation and mental harassment faced by Prem’s Restaurant and Fast
Food, SCO 3, Sector 41 D and owner of Prem’s Restaurant caused by Manika Trehan who posted on
a facebook group “Chandigarh Helpost” having more than 141000 members - “” Look at this Prem’s
Restaurant in sector 41. My female friend needed to use washroom and they refused. Just because
she wasn’t customer there”” dated 13th November,2017 at 9:29p.m.

She attempted to use the public support of the group based on misuse of “ Sarais Act, 1867” which
governs hotels and not restaurants and claimed that restaurants are obliged to let non-customers
have free access to washroom facility. She invoked people to put negative reviews on the facebook
page of the restaurant “Prem’s Restaurant” causing defamation of the business and personal
harassment of the owner through abusive reviews, personal messages and comments on her original
post on Chandigarh helpost.

The incident began with a female who was accompanied by her male friend to the restaurant to use
the washroom was refused by the waiter because of their inebriated condition. This issue did not
even reach the owner Mr. Sanjeev Grover who was present there at the counter and generally
allows non-customers to use the washroom aswell but they just talked to the waiter. Being a private
premise , the owner has the complete right to refuse the use of washroom to non-customers in
order to maintain the ambience of the restaurant and not create inconvenience for the customers
sitting inside.

The women was very politely told to use the public washroom in the same market which is open till
10:00p.m. at night as the waiter couldn’t allow her given their inebriated state as the restaurant is a
family restaurant after which she left the premise at 9:30p.m.

In a while, i.e approx 9:40 p.m. a post was put by Manika Trehan who false claimed that her friend
wanted to use the washroom mentioned above. However, looking at the CCTV footage we found
that Manika Trehan herself came to the restaurant that night to ask for washroom and gave false
information about her friend being in the situation. This lead to provoking of public to act against the
restaurant and the owners all based on the deliberate false information provided by Ms. Manika
Trehan and supporters on the basis of “Sarais Act 1867”.

Soon people started giving poor reviews on the restaurant’s facebook page which led to falling of
rating from 4.1* to 2.8* . This was encouraged by her and her supporters who invoked everyone to
put poor rating on the restaurant, causing defamation of the restaurant.

People also sent highly abusive messages, reviews and comments for both the restaurant as well as
the owners causing a huge mental harassment and later on we had to delete the page.

Examples of such comments are – “ You people are bullshit” , “Let’s go and pee at their doors” ,
“Let’s go and pee on their walls” , “You are not above the law”, ”Worst Restaurant”, “Shit
restaurant” , “How can you deny to use the washroom, you cannot do this” , “ take Rs2 or Rs5 and
charge”, “This restaurant should be shut down” and these can be traced after the post is recovered
as she deleted the post but some of them are attached with this document.

The facebook post was deleted by her in an attempt to hide her act and destroyed the proof of
damage she did to the reputation of Prem’s Restaurant and its owners.

we request the police to recover the deleted post linked
