1) Mr A buys a XVII century painting from a dealer in Bologna without any

documentation asserting the lawful provenance of the object. He exports the painting

unlawfully to the UK. After a couple of years he lends the painting to a Museum for

an exhibition. The Italian government informs the Museum that the painting ia a

national treasure and it was stolen and illegally exported. Italy then sues Mr A to

obtain the restitution of the painting. What are the possible solutions according to (i)

the Unidroit Convention; (ii) the Basel Resolution? Can Mr A be considered a good

faith buyer? If so, how can this circumstance affect the outcome of the controversy in

the case that UK law is applied? And in the case Italian law is applied?
