ITEM-1 CONFIRMATION OF MINUTES OF 32nd MEETING OF COMMERCIAL SUB


COMMITTEE OF NRPC
The minutes of 32nd meeting of Commercial Sub-committee held on 07th April
2017 were issued vide letter No. NRPC/Comml/ 210/CSC (32)/ 2017/ 6177-
6213 dated 31st May 2017. No comment has been received on the minutes.
Commercial Sub-committee may confirm the minutes.

ITEM-2 Presentation by NRPC Secretariat/NRLDC


Presentation on latest CERC’s Regulations/decisions/orders would be made
by NRPC Secretariat/NRLDC.

ITEM-3 Higher POC Charges


Central Electricity Authority vide their letter no. CEA/E&C/RA/POC/3/7/2017-
18/301 dated 29.05.2017 has sought comment/suggestion regarding the
issues of higher POC Charges. As mentioned in the subject letter, some of
the states have raised the issue of higher POC charges and Ministry of Power
has desired a consolidated listing of such issues for comprehensive
consideration of the matter.
Accordingly, NRPC Sectt. vide letter no. NRPC/Comml/202/RTA/2017/6063-
6102 dated 31.05.2017 requested the constituents to flag the relevant issues
of POC charges related to their organization along with suggestion(s) to
resolve the same (Copy enclosed as Annexure-I). Comments/suggestions
from POSOCO, RUVNL, UPCL, BRPL, BYPL, TPDDL & ADHPL (copy
enclosed as Annexure-II) have been received and the same were forwarded
to CEA .The comments of the utilities have been forwarded to NLDC, the
implementing agency for PoC charges mechanism, for comments/views.
Concerned utilities may present the issues in the meeting for discussion.
NLDC, may present its views on the issues raised by the utilities. Other
members may also present their views with respect to PoC charges for

respective utilities, in the meeting.

ITEM-4 Double recovery of BBMB transmission charges by PGCIL & BBMB


(Agenda by HPSEBL)
Himachal Pradesh has share of 168.171 MW in BBMB projects (Bhakra
Complex-100.087882 MW, Pong-11.698474 MW and Dehar -56.385153 MW).
Till 30.09.2016 the charges for transference of this share to HP were being
raised by BBMB on monthly basis and accordingly paid by HPSEBL to BBMB.
However, in the Transmission Charges (PoC) bill raised by Powergrid for the
month of October, 2016, the above MW Share of HP in BBMB projects was
added to the total Long/Medium Term MW entitlements of HP thus increasing
the MW entitlements of HP from 1750.816 MW to 1918.987710 MW.
Accordingly, the PoC bill to HP was raised for amount corresponding to
1918.98771 MW i.e. inclusive of BBMB MW share and HPSEBL has paid the
PoC charges to Powergrid as per their bill, which also included the charges
for HP Mw share in BBMB projects.
Further, BBMB also continued to raise transmission charges bill on HPSEBL
for transference of HP’s share in BBMB project. Thus there was double billing
for the transmission charges for HP share in BBMB projects i.e. by Powergrid
as well as by BBMB. The matter was taken up by HPSEBL with BBMB and
Powergrid in this regard vide letter dated 29.12.2016 (Copy enclosed).
However, to avoid issues of surcharge etc HPSEBL have made payment to
both Powergrid and BBMB as their bills. This practice continued till
31.03.2017 and thereafter Powergrid in the PoC charges bill for the month of
April, 2017 excluded the MW share in BBMB from the total entitlements of HP
and raised bill corresponding to 1750.816 MW i.e. excluding 168.171 MW
pertaining to BBMB projects. Thus now from April’2017 onwards only BBMB is
raising bill for transmission charges for BBMB share and therefore there is no
double recovery.
From the above, it is clear that for the period 01.10.2016 to 31.03.2017
HPSEBL have paid charges for transference of its share of 168.171 MW in
BBMB projects to both Powergrid as well as BBMB. The charges paid to
Powergrid during this period i.e. 01.10.16 to 31.03.2017 for BBMB share
comes out to Rs. 13.1331636 Crore. Matter was taken up with Powergrid for
refund of this amount to HPSEBL, however there is no positive response from
Powergrid in this regard.
POWERGRID may inform the status of refund of the above mentioned
amount of Rs. 13.1331636 Cr.

ITEM-5 Default in payment of outstanding dues and surcharge by beneficiaries


(Agenda by NHPC)
The details of outstanding dues for more than 60 days as on 08.07.2017 in
respect of defaulting beneficiaries of NHPC are as under:

The position of outstanding dues has become alarming and NHPC cannot
afford such huge amount of dues unpaid from any beneficiaries for a long
time.
The concerned utilities may liquidate the outstanding dues and surcharge on
priority and update the status.

ITEM-6 Opening of Letter of Credit (LC) (Agenda by NHPC)


In spite of regular follow up, PDD (J&K), BRPL (Delhi) and Rajsthan Discoms
have not provided LC of requisite amount till now. The matter was also
discussed in the 32nd Commercial Sub-Committee Meeting of NRPC. The
amount of LC to be opened by each beneficiary has already been intimated to
all the beneficiaries.
These beneficiaries may open LC for the requisite amounts in favour of NHPC
Ltd. and update the status.

ITEM-7 Consent for purchase of power from Naitwar Mori Hydro Electric Project
(NMHEP), (60 MW) in Uttarakhand (Agenda by SJVN)
This issue of extending consent of the beneficiaries was raised in the last 39th
NRPC & 35th TCC meeting. The consent from beneficiaries viz. Chandigarh,
BRPL, Haryana, J&K, Punjab and Uttarakhand is yet to be received.
Members may convey the consent for purchase of power, indicating the
quantum of power required from this Hydro project.

ITEM-8 Delay in release of payment of energy bills of NJHPS and RHPS by its
beneficiaries (Agenda by SJVN)
As on 03.07.17, a total of Rs. 815.93 Crore (Rs 691.20 Crore towards NJHPS
and Rs 124.73 Crore towards RHPS) is outstanding for a period more than
sixty (60) days from the beneficiaries of SJVN. The beneficiaries who have
not cleared their outstanding dues are GOHP/HPSEB, BYPL, UPPCL and
PDD J&K.
The details of outstanding payments for these beneficiaries are as under:
i) GOHP: An amount of Rs 471.62 Crore is outstanding (i.e >60 days) from
GOHP (Rs. 382.79 Crore for NJHPS and Rs. 88.83 Crore for RHPS).
Govt of HP has assigned their allocated power of NJHPS & RHPS to
HPSEB from Dec 2013 and April 2015 respectively.
ii) PDD J &K: An amount of Rs 58.38 Crore is overdue from PDD, J &K
(Rs. 42.76 Crore for NJHPS and Rs. 15.61 Crore for RHPS) towards
energy supplied from NJHPS and RHPS. During the current FY PDD
,J&K had released Rs 39 Crores in April, 2017.
iii) BYPL: An amount of Rs 147.96 Crore is outstanding from BYPL. SJVN
has regulated the power of BYPL from NJHPS since Sept 2013. Till date,
BYPL has not shown any interest towards lifting of regulation of power
and has not paid any amount since Oct 14.
iv) UPPCL: An amount of Rs 93.42 Crore is overdue from UPPCL which
mainly comprises of late payment surcharge (LPS) (Rs. 77.80 Crore
towards NJHPS and Rs. 15.62 Crore towards RHPS).
The details of outstanding dues in respect of all beneficiaries is enclosed as
Annexure -III.
Beneficiaries may liquidate their outstanding on priority as it is affecting the
cash flow & MOU rating of SJVN and intimate the status in the meeting.

ITEM-9 Non Opening of Letter of Credit by certain beneficiaries for power


supplied from NJHPS & RHPS (Agenda by SJVN)
As per mutually signed Power Purchase Agreement, beneficiaries have to
submit a confirmed, revolving, irrevocable Letter of Credit in favour of SJVN
for an amount equivalent to 105% of their average monthly billing of preceding
12 months with appropriate bank as mutually acceptable to parties. The LC is
to be kept valid at all the time during the validity of the Power Purchase
Agreement. The following beneficiaries are yet to submit the requisite Letter of
Credit :
i) Power Development Deptt. of J&K:

Power Development Department of J&K has not yet opened Letter of


Credit for power supplied form NJHPS and RHPS.
ii) BYPL and BRPL:
Both the beneficiaries are yet to submit Letter of Credit for FY 2017-18.
iii) M/s Himachal Pradesh State Electricity Board (HPSEB):
HPSEB is yet to provide Letter of Credit as per the Power Purchase
Agreement signed for supplying of power from RHPS.
GOHP has assigned their equity power share to HPSEB from Dec,2013 &
April, 2015 for NJHPS & RHPS respectively. HPSEB is yet to open the
Letter of Credit for the power assigned to them by GoHP. HPSEB may
provide the LC in favour of SJVN as per terms of PPA.
iv) M/s Uttar Pradesh Power Corporation Limited (UPPCL)
As per the Power Purchase Agreement signed for supplying of power
from RHPS, UPPCL has not provided Letter of Credit in favour of SJVN.
Beside this, UPPCL has not renewed their LC of NJHPS after 30/04/2016.
Besides, the above mentioned defaulting beneficiaries, Rajasthan
Discoms (AVVNL, JVVNL & JDVVNL) had not submitted the LC in spite of
numerous reminders & personal visits. These discoms are requested to
expedite the matter. UPCL has submitted the LC but the LC is not
irrevocable & revolving.
Utilities concerned may open their LC as per the terms of PPA and update the
status.

ITEM-10 Execution of Tri-partite Agreement (TPA) as proposed by Ministry of


Power, Govt. of India (Agenda by SJVN)
Ministry of Power, Govt. of India in its letter dated 22.11.2016 and further
reminders dated 19.12.16, 17.1.2017 and 16.3.2017 requested the State
Governments / UT Administrators to sign / execute the TPA and return the
same to Ministry of Power, GOI for further necessary action at their end. It
was further informed by the Ministry of Power through its letter dated
30.5.2017 that following beneficiary states of Northern Region are yet to sign
/ execute the TPA.

b) Rajasthan
c) Uttar Pradesh
Above beneficiaries may expedite the matter and update the status.

ITEM-11 Acceptance of energy bills through E-mail by DISCOMs (Agenda by


SJVN)
During 30th meeting of Commercial Sub-Committee held on 23.09.2015, it
was discussed in item No. 14 that all energy bills or other communication
transmitted electronically by the generating units may be treated at par with
physical delivery of the documents and date of transmission of energy bills
shall be treated as the date of receipt and committee has taken following
decisions:
i) The next day of bills sent via email would be considered as deemed
date of bill delivery.
ii) Bill would be sent in PDF format along with details in Excel sheet.
However, PDF file would be treated as final bill
iii) Sender of email may set flags to get intimation of read or delivery while
sending the email.
iv) Every utility should give two authentic email IDs preferably on their own
domain along with mobile no. of concern person within a week. A copy
of the same should be submitted to NRPC sectt. For record purpose
All the beneficiaries of SJVN have accepted electronically transmitted
communication and energy bills whereas Rajasthan discoms still not
accepting energy bill transmitted through electronically.
Rajasthan discoms may explain the reason behind non-acceptance of the
decision of CCM.
The sub-committee may discuss.

ITEM-12 Payment of Late Payment Surcharge (LPS) by the Beneficiaries of SJVN


(Agenda by SJVN)
CERC regulation provides for charging of LPS on delayed payments released
by the beneficiaries beyond due dates. Since, LPS is an integral part of
energy bills which is imposed / charged in view of CERC regulation and
provision contained in the Power Purchase Agreement, non-payment of same
is violation of CERC regulation & PPA terms, which attracts penal provision
for encashment of letter of credit and regulation of power. While releasing the
payment of energy bill, the amount of late payment surcharge is being
excluded by the beneficiaries despite the fact that the payments have been
delayed by them.
The beneficiaries may release the LPS amount along with the energy bill
payments and intimate the status.

ITEM-13 Request for immediate release of THDCIL’s overdue payments by its


beneficiaries (Agenda by THDCIL)
THDCIL India Limited (THDCIL) has been supplying energy from Tehri HPP
and Koteshwar HEP generating stations to all the beneficiaries of Northern
Region. Despite repeated reminders and vigorous follow-up, some of the
beneficiaries have been making payments very slowly and much beyond the
due dates. This is causing severe financial hardship to THDCIL as they have
to draw loans towards their working capital requirements suffering substantial
annual interest burden.
As on 07.07.2017, an outstanding amount of Rs. 2230 Cr. approx. is due for
payment. The details of major defaulters are as under :-

BSES Yamuna Power has made payment of Rs. 2 Cr. only during the current
financial year so far and an amount of Rs.290.39 Cr. is still outstanding on
them. BRPL & BYPL are deducting TDS on Late Payment Surcharge bills but
the payment of LPS is not being released against LPSC bills.
Besides, an amount of Rs. 3.19 Cr. towards Late Payment Surcharge is
outstanding on PSPCL, Punjab for a long time.
THDCIL has been earnestly requesting bilaterally as well as through this
forum to get the payment released by the beneficiaries but there has not been
much headway.
Working capital liquidity is of utmost importance for uninterrupted services,
therefore, release of payments by Disoms will help in improvement of present
cash crisis of THDCIL and to maintain uninterrupted services.
THDCIL has requested the above beneficiaries to release the outstanding
amount as mentioned above, which is due for more than 60 days and to
inform a time bound plan to liquidate the old outstanding dues.
The issue of non/delayed payment by Delhi Discoms e.g. BRPL and BYPL
was discussed in 35th TCC and 39th RPC meeting held on 01st and 02nd
May,2017, wherein Secretary (Power), Delhi had assured to look into the
matter.

ITEM-14 Request for opening of Letter of Credit (Agenda by THDCIL)


Despite various requests and reminders, the following Discoms have not
opened Letter of Credit for Financial Year 2017-18:

Deviation Pool Account Fund of NR is being maintained & operated by
NRLDC, in accordance with the CERC Regulations. As per Regulations 10 (1)
of “Deviation Charges Related matters” the payment of charges for Deviation
shall have a high priority and the concerned constituents shall pay the
indicated amounts within 10 days of issue of statement of Charges for
Deviation including Additional Charges for Deviation by the Secretariat of the
respective Regional Power Committee in to the “Regional Deviation Pool
Account Fund” of the concern region.
The Status of Deviation Charges is attached as Annexure IV.

Defaulting entities are requested to open the LC against Deviation Charges as


per the Regulations of CERC. The matter has already been communicated
vide NRLDC letter dated 27th June 2017 to the concerned entities.

ITEM-18 NRLDC Fee & Charges (Agenda by NRLDC)


Amount of Rs 27.27 Lakhs is Outstanding against PDD J&K (Jan-17part and
Feb-17 to Apr-17) and Rs 55.64 Lakhs is Outstanding against NTPC (Apr-17)
towards NRLDC Fee & Charges.
NFL (National Fertilizer) has allocation from Bhakra complex and Pong as
such NFL is being treated as regional entity. NFL has not register itself with
NRLDC and has also not released any payment against NRLDC Fee &
Charges. DSM Charges payable to NFL have also been kept under hold.
NRLDC is sending the hard copies of bills to all the users. The bills are also
being mailed to all users on the day of billing and soft copy of bills are also
available to the link http://nrldc.org/bills.aspx & http://nrldc.in/bills.aspx.
NRLDC intends to go for paperless billing.

NRLDC vide letter dated 27-04-2017 has sent the reconciliation statements of
NRLDC Fee and Charges for the billing period Nov-16 to Mar-17 to all the
users. The users were requested to send the duly signed and verified copy of
reconciliation statement as a token of acceptance by 19.05.17. Only Railway,
Nptha Jhakri, Rampur, Uri, ADHPL, NTPC (All), Patran, NRSS XXXI (B), and
KWHPS reconciliation have been received.

Entities are requested to verify the Reconciliation statements and send the
duly signed copy as a normal practice. In case non receipt of any
communication till 08.08.2017, it will be presumed that statement stands

ITEM-27 TDS Certificates against STOA Charges (Agenda by NRLDC)

Deduction of TDS on open access charges are being made under two heads
– one for POSOCO and one for POWERGRID, as per the payment schedule.
It is observed that details of TDS being deducted by the applicants under the
two heads while making the payment for short term open access bilateral
transactions are not being sent to the NRLDC on a regular basis.

NRLDC has intimated that TDS being deducted is to deposited with the Tax
authorities by the 7th of every month for the previous month & details be
submitted by the 10th of every month for the previous month along with
challan numbers. TDS Certificates may be submitted on a quarterly basis
after filing of return and reconciliation can be carried out subsequently.

Non submission of details of TDS/proof of depositing TDS with the Tax


authorities would be treated as default in payment of open access charges in
terms of Regulation 19(1) of the CERC Open Access in Inter-State
Transmission Regulations 2008 and NRLDC may be constrained to take
action accordingly.
“19. (1) In case of default in payment of the application fee or the charges
specified under these regulations, the nodal agency may, in its discretion,
decide not to schedule the transaction, or to cancel the scheduling of already
scheduled transaction or not to entertain any application of such persons in
future until such time the default is cured.”

it by mail. As such DCD is required to be kept in charged condition.
Of late, there have been issues with the GPRS communication for 15 sites for
which SAT has been completed.
POWERGRID may take up the issue on priority basis with the vendor and
update the status for award of AMR for new locations.

Inputs of NLDC on the issues raised by Principal Secretary, Energy, Govt. of Rajasthan 

 
1. Suspect  Theory:  The  mechanism  for  sharing  of  transmission  charges  in  India  has  evolved 
over  the  last  three  decades.  Many  methods  like  contract  path  methodology,  MW‐mile 
methodology, short run marginal cost pricing, long run marginal cost pricing etc. have been 
discussed  in  literature.  Considering  the  uniqueness  of  the  Indian  Power  system,  Average 
Participation,  Marginal  Participation,  and  Zone  to  Zone  methods  were  considered  suitable 
for  further  discussions.  The  hybrid  of  average  and  marginal  participation  methods  was 
adopted  after  nationwide  consultation  and  discussions  in  various  fora  involving  industry 
experts and academicians across the country. In accordance with the practices in the world, 
load  flow  studies  give  accurate  signals,  provided  assumptions  are  correct.  Further,  the 
hybrid  method  is  based  on  load  flow  studies  and  provides  an  elegant  way  of  handling  a 
multiple organization‐multiple licensee scenario.  
 
2. Divergence in projected and actual data: As per sub‐clause (d) of clause (1) of Regulation 7 
of the Principal Regulations, DICs have to submit the projected generation and demand data. 
However,  Rajasthan  has  not  submitted  data  with  regard  to  forecasted  generation  and 
demand  for  1st  quarter  and  2nd  quarter  of  FY  2016‐17.  As  per  the  provisions  of  the 
Regulations,  the  peak  demand  and  generation  is  projected  based  on  the  last  three  year’s 
data. Forecasted generation is further normalised with respect to forecasted All India Peak 
Demand Met to arrive at Approved Injection. The projected peak demand of each State/UT 
thus arrived is normalized with the projected All‐India peak demand met of the Application 
Period  under  consideration.  Consideration  of  generation  and  demand  data  along  with  the 
network  elements  for  PoC  computations  are  discussed  and  finalized  in  the  Validation 
Committee  meeting.  Validation  Committee  is  chaired  by  Chief  (Engg.),  CERC  and  member 
secretary  of  regional  power  committees,  heads  of  RLDCs,  senior  officers  from  CTU,  SLDCs, 
generating  companies  and  inter‐state  transmission  licensees  are  the  members  of  the 
Validation Committee. 
 
Transmission  charges  are  to  be  known  upfront  and  it  should  give  proper  signal  to 
beneficiaries and generators. Therefore, truing up or post facto adjustments should not be 
done. 
 
3. Apportionment of GSS Cost: Present methodology was finalised by the Hon’ble Commission 
after  detailed  analysis  and  due  consideration  of  various  issues  raised  by  stakeholders. 
Charges  corresponding  to  sub‐stations  are  included  in  the  total  monthly  transmission 
charges to be recovered. Transmission charges are assigned to each transmission line of ISTS 
licensees for recovery of total transmission charges. These charges are assigned on the basis 
of average cost computed for different voltage levels and conductor configuration. 

Addition of any sub‐station in a control area may result in marginal increase in charges at a 
particular  node.  However,  the  charges  of  other  nearby  nodes  may  decrease  as  the  total 
demand is constant. 

4. Intended Use vs. Actual Use: Generators/IPPs should be encouraged to apply for LTA for full 
quantum  i.e.  installed  capacity.  Implementation  of  General  Network  Access  (GNA)  may 
address the issue raised by Rajasthan to some extent.

5. Billing  of  ISTS  Charges  for  675  MW  power  from  BBMB:  Regulation  3  of  Central  Electricity 
Regulatory  Commission,  (Sharing  of  Inter‐State  Transmission  Charges  and  Losses) 
Regulations, 2010 provide as under: 
Quote 
“Yearly  Transmission  Charges,  revenue  requirement  on  account  of  foreign  exchange  rate 
variation, changes in interest rates etc. as approved by the Commission and Losses shall be 
shared amongst the following categories of Designated ISTS Customers who use the ISTS:‐ 
(a) Generating Stations (i) which are regional entities as defined in the Indian Electricity Grid 
Code (IEGC)  or (ii)  are having LTA or  MTOA  to ISTS and are connected either to STU or 
ISTS or both  
(b) State  Electricity  Boards/State  Transmission  Utilities  connected  with  ISTS  or  designated 
agency  in  the  State  (on  behalf  of  distribution  companies,  generators  and  other  bulk 
customers  connected  to  the  transmission  system  owned  by  the  SEB/STU/  intra‐State 
transmission licensee)  
(c) Any  bulk  consumer  directly  connected  with  the  ISTS;  and  Any  designated  entity 
representing a physically connected entity as per clauses (a), (b) and (c) above.

Accordingly transmission charges of Inter‐State Transmission System shall be shared as per 
provisions of the CERC (Sharing of Inter‐State Transmission Charges and Losses) Regulations. 
Further, Appellate Tribunal in its judgement dated 14.12.2012 in Appeal No. 183/2011 filed 
by BBMB has already declared the transmission system of BBMB as Inter‐State Transmission 
System.  
 
Further, CERC, vide its order dated 12.11.2015 in petition no. 251/GT/2013 and order dated 
30.09.2016  in  Review  Petition  No.  5/RP/2016,  has  allowed  the  Normative  O  &  M 
expenditure of BBMB transmission system for the period 2009‐14. Hon’ble Commission in its 
order  dated  12.11.2015  has  further  directed  BBMB  to  file  necessary  petition  for 
determination of transmission tariff for the period 2014‐19 in accordance with provision of 
the 2014 Tariff Regulations. The scheduling of power from the generating units of BBMB is 
being  done  by  Northern  Regional  Load  Despatch  Centre  similar  to  the  other  ISGS.  Hon’ble 
Commission  in  its  order  dated  21.03.2016  directed  that  the  commencement  of  scheduling 
from the units of BBMB under ABT would be done with effect from 1.6.2016. 
 
2nd  proviso  to  definition  of  Approved  Injection  stipulated  in  Central  Electricity  Regulatory 
Commission,  (Sharing  of  Inter‐State  Transmission  Charges  and  Losses)  Regulations,  2010 
provides as under:

Provided  further  that  where  long  term  access  (LTA)  has  been  granted  by  the  CTU,  the  LTA 
quantum,  and  where  long  term  access  has  not  been  granted  by  the  CTU,  the  installed 
capacity  of  the  generating  unit  excluding  the  auxiliary  power  consumption,  shall  be 
considered for the purpose of computation of approved injection.  
Unquote 
 
Based on the above proviso, approved injection from generating stations of BBMB has been 
computed  and  corresponding  allocations  have  been  added  to  the  withdrawal  quantum  of 
beneficiaries.

Further,  BBMB  had  submitted  the  details  of  Yearly  Transmission  Charges  (YTC)  for  4th 
quarter  of  2016‐17.  The  YTC  details  submitted  by  BBMB  have  been  considered  in  PoC 
computations for 4th quarter of 2016‐17. As per the extant Regulations, CTU has to collect 
the transmission charges from all DICs on behalf of all ISTS transmission licensees and then 
disburse the collected amount to these transmission licensees. 
 
6. Comparison  of  ISTS  Charges  of  Kerala  and  Rajasthan  for  Q3  of  2016‐17:  PoC  charges  are 
dependent  on  the  specific  location  of  each  entity  (injection/drawl)  in  the  grid.  As  per  the 
load flow study case considered for 3rd quarter of 2016‐17, Rajasthan is drawing more power 
from outside the state thereby utilizing more ISTS network to meet its demand. Final Billing 
is done on the basis of Approved Withdrawal (LTA) quantum. 

Transmission Charges Payable = (Sum of PoC rate, HVDC rate and Reliability Support charge 
rate) x Approved Withdrawal 

At  present  (Q4  of  2016‐17),  PoC  slab  rate  varies  from  Rs.  83787  /MW/Month  to                             
Rs. 333036 /MW/Month. Such large difference in minimum and maximum slab leads to a situation 
where utilities falling in higher slabs feel aggrieved. As per para 7.1.(3) of the tariff policy  

“the  spread  between  minimum  and  maximum  transmission  rates  should  be  such  as  not  to  inhibit 
planned development/augmentation of the transmission system but should discourage non‐optimal 
transmission investment”. 

Implementation of the above provision of tariff policy will help in addressing grievance of a number 
of utilities.

Sir,

On the subject cited above kindly refer to your office letter no. NRPC/Comml
/202/RTA/2017/6063-6102 dated 31.5.2017 whereby relevant issues ofPoC charges related to
our organization have been sought.
In the matter it is to inform that since inception of PoC mechanism, the transmission
charges have increased many folds. Following data of the last 7 years reflect the excessive
hike in the transmission charges:-

From the above illustrations it is evident that percentage increase in energy in the last 7-
8 years is approximately 55% whereas percentage increase in Transmission charges is
approximately 361%. Such abnormal hike in POC bill(s) of UPCL as a result of
implementation of the Sharing Regulations, 2015 resulting into retail tariff shock.
In view of such abnormal increase in the transmission charges and its consequential
adverse impact on retail tariff of UPCL it is requested to examine and review the factors
which are responsible for such abnormal hike in POC bills of UPCL and to take immediate
remedial measures to revise abnormal POC bill amount and thus enable UPCLto fulfill its
mandate to supply power to its consumers at affordable cost as stated in Section 61 of the
Electricity Act, 2003.

This is refers to your letter no. NRPC/CommIl202/ RTN 2017/ 6063-6102 dated 31 May 2017 on
the aforesaid subject, our comments/ suggestion on POC charges are as under:

i. Hydro power projects does not utilize its whole Long Term Access (L T A Quantum) during
most of the months of the year as it generates for few hours per day based on variable
available water inflow. The POC rates for Hydro Generators should be considered
accordingly. There should have been a level playing field for Hydro Power Generators
(having PLF upto 50%) compared to Thermal Power Generators (having PLF upto 95%).

2. POC charges are not sensitive to quantum of flow and distance and hence are not in line
v.;ith r'~at i onal Electricity Policy.

3. Modalities needs to design where POC charges are levied only for used/accessed
transmission element by a respective DIC .
