R E S O LUTIO N

The respondent MARLON STOCKINGER is charged of the crime in violation of

Republic Act 9262 or THE ANTI-VIOLATION AGAINST WOMEN AND CHILDREN in a
complaint filed by PIA WURTZBACH-STOCKINGER.

In support of his complaint, the herein complainant attached the following documents;

1. Medical Findings of Dr. Dwyane Wade;

2. Affidavit of Shamcey Stockinger
3. Affidavit of Dr. Bienvenido Torres

Statement of Facts

Based on thecomplaint filed by Pia Wurtzbach-Stockinger the facts of the case are stated
hereunder:

On the night February 24, 2010, the accused went home

seemingly mad about something and took it out on the complainant
by punching her on the face which resulted to the loss of 5 of my front
teeth. That on several occasions, the accused continued to physically
and sexually abuse the complainant. That ever since the accused left
on May of 2016 to work in Riyadh, Saudi Arabia, he never gave
financial support for the family including their 5 minor children. In
addition, the accused had likewise committed marital infidelity which
caused extreme psychological distress and emotional anguish on the
complainant.
CONTRARY TO LAW.

In the medical examination conducted by Dr. Dwyane Wade on February 25, 2010 upon
the complainant revealed that the complainant lost 5 front teeth which is casued by an extreme
blow to the face.

In the affidavit of Shamcey Stockinger, she testified that her father, herein accused, would
contantly physically abuse their mother and has never communicated with them ever since the
accused left to work in Riyadh, Saudi Arabia. She likewise testified that she had to stop her
education because of their lack of financial capability to send them all siblings to school.

In his counter-affidavit, accused Marlon Stockinger denied all of the accusation against
him and averred that he never physically nor sexually abused the complainant. He likewise
denied not giving financial support to this family and that he also did not commit marital
infidelity as the woman he purportedly has an affair with, as the complainant avers, is in fact
just his chidlhood friend and a lesbian, making it impissible to have any sexual relations with
her.

Analyses/Findings and Recommendations

The acts aforementioned are violative of Republic Act No. 9262 or Anti-Violence Against
Women and Their Children Act of 2004 which provides that:

"Violence against women and their children" refers to any act or a series of acts committed by
any person against a woman who is his wife, former wife, or against a woman with whom the
person has or had a sexual or dating relationship, or with whom he has a common child, or
against her child whether legitimate or illegitimate, within or without the family abode, which
result in or is likely to result in physical, sexual, psychological harm or suffering, or economic
abuse including threats of such acts, battery, assault, coercion, harassment or arbitrary
deprivation of liberty. It includes, but is not limited to, the following acts:

A. "Physical Violence" refers to acts that include bodily or physical harm;

B. “Sexual Violence” refers to an act which is sexual in nature, committed
against a woman or her child. It includes, but is not limited to xxx treating a
woman or her child as a sex object, making demeaning and sexually suggestive
remarks xxx.
C. “Psychological Violence” refers to acts or omissions causing or likely to cause
mental or emotional suffering to the victim such as but not limited to
intimidation, harassment, stalking, damage to property, public ridicule or
humiliation, repeated verbal abuse, and marital infidelity.
D. “Economic Abuse” refers to acts that make or attempt to make a woman
financially dependent which includes, but is not limited to xxx withdrawal of
financial support or preventing the victim from engaging in any legitimate
profession, occupation, and xxx solely controlling the conjugal money;

The Accused MARLON STOCKINGER failed to convice the prosecutor that he did not
commit any of the accusations made against him by the complainant and that there is probable
cause that he is guilty of the charges against him based from the evidence presented by the
complainant.

WHEREFORE, IN VIEW OF THE FOREGOING, it is most respectfully

recommended that an information for the crime in violation of Republic Act 9262 or the Anti-
Violence Against Women and Children be filed against the respondent MARLON
STOCKINGER. A bail bond of P240,000.00 is recommended
