According to PRESIDENTIAL POWERS (TEMPORARY MEASURES) ACT 10 20

When it appears to the President that a situation has arisen or is likely to arise which needs to be
dealt with urgently in the interests of defence, public safety, public order, public morality, public
health, the economic interests of Zimbabwe or the general public interest; and the situation cannot
adequately be dealt with in terms of any other law; and because of the urgency, it is inexpedient to
await the passage through. This means that the president can make regulations on his own

In so doing, the President informs the parliament as stated in presidential powers act. The president
can only do that if he considers it inexpedient to do so because of the urgency of the situation,
before making any regulations in terms of section two the President shall cause a notice to be
published in the Gazette or in any other manner he considers appropriate. By this. He does not
inform the parliament and makes his own descission. This is in accordance to section of the
Presidentail power act. Unless they are earlier repealed, regulations made in terms of section two
shall expire and cease to have any effect on the one hundred and eighty-first day following the date
of commencement of the regulations.
There are various cases where the president used these powers. This is for example Amendments
Affecting Voter Registration Procedures. Previously, section 24(1) of the Act said that every person
wishing to be registered as a voter must go to the appropriate registration office and get an official
claim form completed on his or her behalf by the voter registration officer. This applied to
everyone, even claimants well able themselves to complete the prescribed claim form satisfactorily.
Now, the amendment substitutes a more sensible provision under which a person wishing to be
registered as a voter must complete the official claim form and submit it to a voter registration
officer at a voter registration centre. As an exception to this general rule a claimant may request a
voter registration officer’s assistance to complete the claim form and the officer must comply with
that request. This was done to ensure self registration and made the citizens to to feel free to
register. This also change responds to civil society protests and suggestions made in the interests of
speeding up the voter registration process.
The other case is the case of the Presidential Powers (Temporary Measures) Amendment of Reserve
Bank of Zimbabwe Act and Issue of Bond Notes) Regulations, 2016Number 133. this was the
declaration of the bond notes to be valid as the country’s currency. The president exercised his
power because there wre various arguments concerning the issue of bond notes and bond coins.
This also helped to reduce the crisis in Zimbabwe since there was no revenue in the country due to
externalisation of funds.
Moreso, the other case is that of the Presidential Powers (Temporary Measures) (Amendment of
Criminal Law (Codification and Reform Act (Chapter 9:23)) (SI 3/2014) this purported to create
“piracy on the high seas” an offence in Zimbabwean law this amendment was not in fact necessary
as piracy was already an offence under our common law.
The last one just to mention is Presidential Powers (Temporary Measures) (Amendment of Money
Laundering and Proceeds of Crime Act (Chapter 9:24)) Regulations, 2014 (SI 2/2014)
in conclussion, the constitution provides for the president to have the powers to act on his own for
public interest. This act act also be against the constitution because it might violet the huma rights
for example the POSA act which violeted the citizens right to freedom of gathering.
