APPLICATION UNDER SECTION 437 OF THE CODE OF CRIMINAL

PROCEDURE 1973 FOR GRANT OF BAIL

It is respectfully submitted as under:-

1. That the present application under section 437 of the Code of Criminal Procedure 1973
is being filed by the Petitioner for seeking grant of bail in FIR No. 0012 registered at
Police Station Maqsudan, Jalandhar. The present petition is being moved as the
Petitioner has been arrested on 11/01/2018 in connection with the said FIR. The
petitioner is now in judicial/police custody.
2. That the accused is innocent and is being falsely implicated in the above said case as
he has nothing to do with the matter.
3. That the accused is a law abiding citizen of India. The accused is gainfully carrying on
the work of contractor at village Sraikhaas, Jalandhar.
4. That the accused is a responsible person and is living at the above mentioned address.

5. That in this incident accused is innocent person. The fight was begin by the
complainant itself by giving a sudden and grave provocation to the accused. The
complainant files the FIR for the same, FIR No. 12 registered at police station
Maqsudan, Jalandhar. In the FIR complainant not give true information to police.

6. That the investigation of the Police is completed and the accused/applicant is no more
required by the Police for further investigation.

7. That the applicant is willing to furnish surety and bail bonds to the satisfaction of this
learned court in case he is ordered to be released on bail. The applicant is also willing
to join the investigations and bind himself by the terms and conditions laid down by
the law or by this Hon'ble court. It is further submitted that the applicant is not at all

 required for the investigations. However, if the applicant is required for investigation,
the applicant/accused undertakes to be present as and when required in accordance
with the law.

8. That the accused/applicant undertakes to appear before this Hon’ble Court on each
and every date of hearing, if released on bail.

9. That the accused/applicant further undertakes not to abscond or temper with the
prosecution evidence, if released on bail.

10. That the accused/applicant further undertakes to abide by all the terms and conditions,
which may be imposed by this Hon’ble Court, if released on bail.

It is, therefore, most respectfully prayed that:-

(a) That the applicant may be ordered to be released on bail and this application
for bail may kindly be allowed;
(b) That till the decision of this application interim bail may be granted to the
applicant;
(c) That the directions may be issued to the police to get the applicant/accused
medically examined at the immediately;
(d) Such other orders be also passed in favor of the applicant as deemed fit and
proper in the facts and circumstances of the case and in the interest of justice.

AFFIDAVIT
I, Gehlot Ajay aged 23 S/o. Gehlot Jagdish R/o 6-5-1/2/4 Vinayak Chowk Adilabad,
Telangana , do hereby solemnly affirm and declare as under:-
1. That the deponent is the brother of the accused/applicant.
2. That the accompanying application under section 437 CrPC has been drafted at my
instance and under my instructions.
3. That the contents of paras 1 to 10 are true and correct to the best of my knowledge.
4. That I further solemnly affirm and declare that this affidavit of mine is correct and
true, no part of it is false and nothing material has been concealed therein.
5. That this is first application for bail under section 437 Cr.P.C. on behalf of the
accused/application and no such bail application has earlier been filed decided or is
pending in any court including the Hon’ble High Court of Punjab and Haryana,
Chandigarh.
