26 Court Hearing

He came home belligerently drunk and tried to start a fight with me against my will and ultimately ended up
punching me in face. He also violently assaulted my other roommate Ali.

I, JACOB LEVENTHAL, am the Petitioner in this action and have personal knowledge
Los Angeles, California from August to November of 2017. The apartment lease
explicated that the Respondent, our other two roommates, and me were all students.
2. On Sunday, November 19, 2017, at approximately 3 a.m., the Respondent entered our
shared bedroom belligerently drunk and began to shake my shoulders back and forth as I
slept, waking me up. This was not the first time he woke me up for no reason, but this
time he attempted to verbally initiate a fight, by yelling loudly in my face, “Do you
wanna fight!” I responded to every provocation by denying him and telling him that I just
wanted to go back to sleep. He didn’t listen. He hovered over me while I laid in bed. I
then got out of bed to get my two other roommates in the other room. I then returned to
my room with them and got back in bed. We were all arguing and then the Respondent
hovered over me again and tried to start a fight again. I again told him no but he started
swatting at me. After telling him not to touch me several times and him not listening, I
gently pushed him away with my foot and was immediately punched in the face. My
roommate Ali tried to push him off of me but then the Respondent started choking him
and tried to jam his fingers into Ali’s eyeball. In self-defense, Ali punched behind him
and hit the Respondent in the face and immediately ran into his bedroom and locked the
door. The Respondent then waited outside of Ali’s door and started banging on the door
calling him an “Arab” and saying that he wants to fight. Ali yelled from before the door
to tell the Respondent to go away and go to bed. The Respondent refused. At that point,
my other roommate Andrew and I went to go get The Lorenzo’s (the name of our
apartment building) security. We returned to the room with security and the Respondent
was still outside of Ali’s room banging on the door. Ali heard that security had arrived so
he opened up his bedroom door and was immediately attacked again when the
grabbed Ali.
3. The Lorenzo told the Respondent that it would be best for him to leave that night; he
4. The Lorenzo security told us that we had the option to either call LAPD or the
university’s Department of Public Safety (DPS) but suggested that DPS was a better
option because “it would probably be easier.” We ended up calling DPS. When DPS
arrived, they took photographic evidence of injuries and damages to the room. They also
asked each of us for an account of what happened. Afterward, DPS gave us a LAPD
incident report number and said that if we want to press charges we can contact LAPD
5. Because The Lorenzo did not formally evict the Respondent (who kept his key to our
apartment) that night because they said they “could not evict him for 72 hours.” It was
unclear where he was staying, so I took refuge at the DoubleTree at 120 S Los Angeles St
for the next two nights. The Lorenzo later reimbursed me for that cost.
6. As a result of the incident, I had multiple bruises and cuts on my upper lip, I was

Respondent, it was reflective of a pattern of aggression and lack of self-control that I had

9. When the Respondent came back to the bedroom to collect his things, The Lorenzo did
not have a security detail monitoring his visit as they had previously promised me, and
the Respondent cut my MacBook laptop charger in half and stole my pair of Ray Ban
10. The Respondent, who had signed his housing lease asserting that he was a student and
had presented himself as a student at the University of Southern California (USC) to me,
my roommates, our peers, and on social media, was revealed to be not a student by
USC’s Department of Public Safety (DPS). DPS also told me that the evidence they
found did not point to him being a student at any nearby institute of higher education.
11. Despite The Lorenzo evicting the Respondent and giving me a verbal affirmation that he
would be banned from the premises, through social media and first-hand witness
accounts, I learned that the Respondent frequented both my apartment building and my
university after the incident of violent physical assault, often at late hours of the night. I
have video documentation of at least one of these incidents at the university, and
witnesses and security cameras can confirm that the Respondent was at my apartment
12. Despite my numerous emails and phone calls to the management at my apartment
complex, The Lorenzo refuses to step in and ban the Respondent from the grounds.
13. I am currently still living in my original bedroom at The Lorenzo. The Respondent, who
attended, is in my physical proximity constantly. LAPD issued a warrant for his arrest on
two counts of battery (LAPD Newton Division report number 171324418), but the case
has been moved from Newton to the “CA,” which will reevaluate the case. Detective Lin
told me that this would take 4 to 6 months. In the meantime, I fear for my physical safety
