Complainant has investigated the facts and circumstances of this offense and believes the following
establishes probable cause:

On September 7, 2017, Minneapolis Police were dispatched to Unity Hospital in Fridley regarding sexual
assault that occurred in downtown Minneapolis outside a bar located at 715 Hennepin Avenue South,
Minneapolis, Hennepin County, Minnesota. Adult female Victim explained to police that she and a female
friend had stayed after hours at the bar because her friend knew the bartender. Victim left the bar at
approximately 6:00 a.m. and sat on a seat directly in front of the bar and called her mother for a ride home. 

While Victim was waiting for her mother, two men unknown to Victim approached her on the sidewalk and
stood on either side of her. The men leaned over Victim and forcibly lifted-up her shirt to expose her
breasts. Each man sucked on Victim’s nipples. The man who had his hair pulled back in a bun pushed his
hand inside Victim’s underwear and penetrated her vagina with his hand. The men told Victim, “You want it
dressed like that,” and “You like this.” Victim did not consent to the sexual contact or sexual penetration. 

Both men pulled down their pants to expose their penises to Victim. Each man grabbed Victim by her head
and attempted to force her toward his penis. Victim intentionally dropped her head and buried her face in
her lap so that she wouldn’t be forced to put the men's penises in her mouth. 

Eventually, a passerby told the men to leave Victim alone, and the men walked away. Victim’s mother
picked her up at approximately 7:00 a.m. and brought her to Mercy Hospital for a sexual assault
examination. 

Minneapolis Police viewed Safezone camera footage of the sexual assault. The video shows two men
standing over Victim for an extended period of time and groping her. The video shows the men standing,
surrounding the Victim, and groping Victim as she sat in the chair. The men appear to prevent Victim from
leaving the chair. One male had braided hair that is pulled back in a bun and he is wearing a black hooded
sweatshirt and has large white headphones around his neck. The second male wears a blue long-sleeved
shirt and a black baseball cap. The men eventually leave Victim alone and walk together northbound on
Hennepin Avenue. 

The Minnesota Bureau of Criminal Apprehension (BCA) analyzed a DNA swab from Victim’s left nipple.
The swab contained amylase, a constituent of saliva. The swab revealed a single-source male DNA profile
that matches the known DNA sample for RICHARD JAY HOGAN, Defendant herein. Sergeant Faulconer
compared arrest photos of Defendant to the Safezone camera footage, and Sergeant Faulconer
concluded that Defendant was the man in the blue long-sleeved shirt and black baseball cap. 

On April 12, 2018, Sergeant Faulconer travelled to Olmstead County Jail where Defendant is currently
incarcerated for Failure to Register as Predatory Offender (Defendant was adjudicated delinquent of
criminal sexual conduct in 2004 in Jackson County, Missouri). In a recorded, Miranda-compliant interview,
Defendant viewed the Safezone camera stills and confirmed that he was the male in the blue shirt and
black baseball hat. Defendant denied knowing his fellow perpetrator. Defendant viewed a six-photo array
consisting of Victim and five photos of random women. Defendant selected Victim’s photo and explained
that he seemed to remember his fellow perpetrator speaking with Victim on Hennepin Avenue. Defendant
denied any sexual activity with Victim, and Defendant could not explain why his DNA was on Victim’s left
nipple. 

The BCA determined that the DNA swab from Victim’s right nipple contained a major mixture of two or

more individuals. Known adult male Co-Defendant could not be excluded as contributing to that mixture.
Hennepin County, MN
Sergeant Faulconer learned that Co-Defendant was cited by Minneapolis Police for public urination on
September 6, 2017, the day before the sexual assault. Sergeant Faulconer viewed body-worn camera
footage from the public urination citation: Co-Defendant was wearing the same clothing and he had the
same large white headphones around his neck on September 6th as he did when he sexually assaulted
Victim on September 7. Co-Defendant is currently homeless and his whereabouts are unknown. 

This complaint against Defendant to issue via warrant. Defendant has a criminal history of criminal sexual
conduct and failure to register as a predatory offender and he is an active threat to public safety.
