MOTION TO SET BRIEFING SCHEDULE FOR RESOLUTION


OF MOTIONS TO DISMISS BY
PLAINTIFF BRENNAN GILMORE

Plaintiff Brennan Gilmore moves the Court to set a briefing schedule for the filing of

motions to dismiss in the above-captioned case. Defendants Alex Jones, InfoWars LLC, Free

Speech Systems LLC, and Lee Ann McAdoo consent to the relief requested by this motion. As

of the time of this filing, Counsel for Defendants Stranahan and Hoft has not provided consent.

On March 13, 2018, Mr. Gilmore filed a complaint initiating the above-captioned case.

(ECF No. 1). On April 10, 2018, Defendants Alex Jones, InfoWars LLC, Free Speech Systems

LLC, and Lee Ann McAdoo filed a motion to dismiss the complaint. (ECF No. 15). On April

17, 2018, Defendants Lee Stranahan and James Hoft filed a motion to dismiss the complaint.

(ECF No. 25). On April 24, 2018 Plaintiff Gilmore filed an Amended Complaint as a matter of

right, pursuant to Federal Rule of Civil Procedure 15(a)(1)(B). (ECF No. 29). Because the

Amended Complaint supersedes the original complaint, the presently pending motions to dismiss

the original complaint are moot. See Young v. City of Mount Ranier, 238 F.3d 567, 573 (4th Cir.

2001) (“[A]n amended pleading supersedes the original pleading, rendering the original pleading

of no effect.”).

Because the motions to dismiss will likely rely on similar legal theories and address

similar facts, it is in the interest of the parties and the Court to set a consolidated briefing

schedule. In the interest of judicial efficiency and convenience, Plaintiff Gilmore hereby moves

the Court to set the following briefing schedule:

1. Motions to Dismiss shall be due May 22, 2018;

2. A single, Consolidated Opposition to all Motions to Dismiss shall be due June 19,

2018

3. Reply briefs shall be due July 10, 2018.
