ABC (ALLIANCE FOR BARANGAY CONCERNS V COMELEC RESPONSE OF ABC ON MAURICIO’S PETITION FOR

GR No. 193256/ March 22, 2011 DISQUALIFICATION


J. Peralta  ABC, as a political party, is allowed by law to be registered and
run under the party-list system of representation
FACTS:  COMELEC has approved petitioner’s registration and

HELD:
YES. COMELEC HAS JURISDICTION OVER THE PETITION FOR
CANCELLATION OF REGISTRATION AND ACCREDICATION OF
PARTY- LIST
 As provided by Article IX-C of the Constitution, COMELEC has
the authority to register political parties, organizations or
coalitions, and the authority to cancel the registration of the same
on legal grounds.
 Furthermore, COMLEC’s authority to cancel registration is
likewise reflected in Section 6 of RA 7941, which provides that it
may motu propio or upon verified complaint cancel or refuse
registration of any party, organization, or coalition

HOWEVER, WITH REGARD TO QUALIFICATIONS OF PARTY-


LIST NOMINEES/ REPRESENTATIVE, IT IS HRET THAT HAS
JURISDICTION AND NOT COMELEC
 Although it is the party-list organization that is voted for in the
elections, it is not the organization that sits as and becomes a
member of the House of Representatives, but it is the party-list
nominee/representative who sits as a member of the House of
Representatives.
 Furthermore, as provided by Section 17, Article VI of the
Constitution, Since the representative of the elected party-list
organization becomes a member of the House of Representatives,
contests relating to the qualifications of the said party-list
representative is within the jurisdiction of the HRET

CONCLUSION:
 The jurisdiction of the HRET over contests relating to the
qualifications of a party-list nominee or representative is derived
from Section 17, Article VI of the Constitution,
 While the jurisdiction of the COMELEC over petitions for
cancellation of registration of any national, regional or sectoral
party, organization or coalition is derived from Section 2 (5),
Article IX-C of the Constitution
