Resumen:
Abstract
Many people know and are affected by the problem of the legislation in our
country and as this comes being affected from different forms by without I number of
“implicancias” which are not indeed but in agreement with the needs of the population
and with the microindustralists generally. The problem in which this investigation
concentrates is that one to which we denominated normative empirismos, breaches
and theoretical discrepancies of the regulation and standardisation in the enterprise
activity in front of the group of being able.
The influence of the groups of being able is exerted in different forms and its
influence begins with the press in which it uses to facilitate the profit of his interests; the
bad thing is that they do not consider that in the way towards its objective defending
lies and averages truths fomenting a false culture that it damages and/or it informs to a
society that well is not taken care of with true information on the part of the state.
The law Mypes this made to formalize the sector and to collect with more facility
the taxes more does not stop to promote is what mainly the interviewed people
respond.
To this answer we added that the intention when promulgating the law Mypes is
for formalizing but as we demonstrated with the following transcription that nor to
formalize it serves this law (To copy task that speaks of 90% of, microindustralists that
did not benefit with kindness of the TLC).
For that reason we concluded that in fact it does not obtain any of the
objectives, neither the formalization nor the promotion.
Law 1086 contains a valuable aggregate at first but at heart it is not another
thing that the very surreptitious form to stimulate the micro industralist to become
serious and is with the advantages that the law offers to the worker of the Mypes; so
that the state knows that the great majority of the members of the Mypes their micro
and small companies conforms the children and other relatives. So that when
considering the law the labor advantage of the worker looks for to motivate that
although it is by that benefit is obtained the formalization, which is not bad but the
formalization looks for all cost, to all this but with ineffective measures, another very
different thing and it would be if the development of the Mypes sector did not hit the
interests of the members of the groups of being able.
There if preferential credit with low interests to the Mypes sector and the
treatment of sunat would be granted, also serious adapted and if the state it had not
resigned to act like regulating being of the market to orient the policy of price of
products which would assure a relative stability in the prices the market, the takeoff of
evident serious the Mypes sector
Supposition that the state or the commissioners to legislate does not notice that
the preferential credit, the preferential treatment of sunat and the regulation of the
market are the advisable thing for the development of the Mypes sector, is of absolute
clear naivete they know that it but the generalized conception that motivates to the
groups of being able and the unpatriotic conduct genuflexa and of the governors does
not allow take the suitable and true own measures so that the Mypes sector develops.
I. INTRODUCCIÓN:
En este trabajo de tesis, bajo el desarrollo de una investigación hecha a
microempresarios y abogados, así como en base a hechos a reales que suceden en
este país, la misma que teniendo en cuenta; opiniones de diversos especialistas en el
tema mypes, y contrastando con la misma historia del Perú, logramos establecer por
que el sector mypes no desarrolla desde que el estado intervino en el supuestamente
para impulsar su desarrollo.
También demostramos por que las últimas legislaciones dadas por los
gobiernos de turno del Perú no cumplen su propósito.
Resaltamos en este trabajo, vista la historia del sector mypes que el estado
intervino en el por qué el desarrollo del sector choco con los intereses de las grandes
empresas.
PRIMERA CARACTERISTICA:
A raíz de esta crisis todos los países del mundo empezaron a analizar el
problema de cómo actuar para que les afecte lo menos posible.
Solía decir Víctor Raúl Haya de la Torre cuando hablaba de economía que
cuando a la economía norteamericana le daba un resfrío a la de los países pobres
corría el riesgo de darles una pulmonía fulminante de manera que sabiendo el riesgo,
todos los países que alguna dependencia económica tenían con el país del norte se
tienen que obligar a tomar medidas inteligentes para sortear la crisis.
“…La guardianía del estado también supone una vigilancia política de las elecciones
para conseguir buenos administradores políticos y bomberos calificados, de tal modo
que se asegure una sucesión en los cargos y del congreso, por la vía de los lobbies.
De este modo se maneja el Estado y se evita que se independice, se fortalezca o se
vuelque en otra dirección…”

SEGUNDA CARACTERISTICA:
Pero el paseo por todos los canales de TV del periodista Cesar Hildebrandt a
traves de los años completa nuestra aseveración cuando señalamos la influencia de
los grupos de poder en la prensa en el Perú.
Por otro lado, también existe el criterio de utilizar la densidad de capital para
definir los diferentes tamaños de la micro y pequeña empresa. La densidad de capital
relaciona el valor de los activos fijos con el número de trabajadores del
establecimiento. Mucho se recurre a este indicador para calcular la inversión
necesaria para crear puestos de trabajo en la pequeña empresa.
Con respecto a la pequeña empresa industrial, la describe como empresa que tiene un
tamaño de 5 a 19 personas ocupadas y una densidad de capital de aproximadamente
3000 dólares por puesto de trabajo. Su base tecnológica en moderna y la
productividad es mayor que en la microempresa: Es capas de generar excedentes,
acumular y crecer teniendo entonces una mayor estabilidad económica que el sector
microempresarial.
V. CLASIFICACIÓN DE LA EMPRESA.
- Según la propiedad:
1.- Empresas de propiedad social: Cuyos propietarios son los trabajadores de las
mismas, el fondo de estas van al fondo nacional de propiedad social, reciben apoyo de
la corporación financiera de desarrollo.
e.- Sociedad anónima: Esta representada por acciones (títulos valores que
representan una parte alícuota), los socios pueden ser 2, no existen un numero
máximo de acciones ni de socios por lo cual puede alcanzar grandes dimensiones en
su capital. Pueden ser: Sociedad anónima cerrada y Sociedad anónima abierta.
VI. CONCLUSIÓN
- La inviabilidad de las leyes Mypes 28015 y 1086 las que hasta los mismos ex
ministros de estado como es el caso del ex ministro de trabajo Fernando
Villaran, sostenga en los medios de comunicación masiva que del 100% de los
empresarios que se formalizan en un ano el 50% de ellos no resisten pasar el
primer ano y regresan a ser informales; o lo señalado por la revista quehacer
que el 90% de las micro y pequeñas empresas en el Perú por ser informales no
se beneficiaran de las bondades del TLC con USA; es mas que suficiente de
que las leyes 28015 y 1086 no valen para lograr la formalización.
Y que sigamos hablando de micro y pequeña empresa en el Perú y que ellas
mueven el 90% de la economía y dan mas trabajo que siguen siendo micro y
pequeñas empresas es que la promoción tampoco da resultados, de ahí para
sostener que estas leyes son inviables por los resultados que se tienen a la
vista
